Paraskar, in July, 2015, had filed an application for discharge on the grounds that the allegations leveled against him were false and claimed that he had enough evidence to prove that the victim fabricated the case with an intention to implicate him and teach him a lesson.
Suspended police officer Sunil Paraskar was on Friday discharged from an alleged rape case which a 26-year-old model had slapped against him in May 2014. While the Dindoshi sessions court is yet to put out the detailed order copy, the victim said she would definitely approach the Bombay high court to seek justice. Paraskar, in July, 2015, had filed an application for discharge on the grounds that the allegations leveled against him were false and claimed that he had enough evidence to prove that the victim fabricated the case with an intention to implicate him and teach him a lesson.<!– Dna_Article_Middle_300x250_BTF –> Paraskar, who was represented by lawyers Rizwaan Merchant and B Jagtaap before the sessions court, in the discharge application asked, “Is it possible for a girl, who has been allegedly raped, to continue maintain a pally relationship with the accused and keep sending messages to him on a friendly note?” Stating that the entire case was false and fabricated, Advocate Jagtaap said, “We have evidence in the form of the video recording, produced by one of the lawyers who initially appeared on behalf of the victim, showing the victim – while discussing the case with the advocate – stating that she wants to fix the IPS officer permanently.” He further said the defence was quite clear while arguing the matter. “Our stand was that the evidence in the charge sheet is so weak that – even if the court proceeds with recording the evidence – the case would not culminate in conviction and proceeding with the case would be a waste of court’s precious time. The police had hurriedly registered the case without verifying the facts.” Meanwhile, the prosecution claimed that the entire act of balancing and evaluating the evidence would only come at the later state of trial. “Prima facie there was enough evidence. However, the decision of either approaching the higher authorities would be taken only after going through the detailed order copy,” the prosecution said. Paraskar had been charged with various sections of the Indian Penal Code, including 376(2) (rape by a police officer), 376 C (intercourse by superintendent of jail, remand home, etc) and 354(D) (stalking), which the model had accused against the officer.
