At times, there could be bonafide mistakes. But when cases are registered against officials, it gives the world an impression that they are corrupt,” an official said, adding that it not only causes severe damage to their reputation, but also brings huge stress to them and their family.”Even before a conclusion is arrived at, people jump the gun and call the officer corrupt,”the official said.Another official said that lieutenant governor Najeeb Jung had earlier sent a directive that all complaints will have to be looked by the vigilance department first before being forwarded to the ACB.”However, in the current situation, the directive is not being followed and ACB is directly registering all complaints,” the official said.According to officials, since Delhi is not a state, setting up the institutional mechanism is the only option to protect bureaucrats from getting caught in the Delhi government-Centre war.According to sources, while Kejriwal told the officials that the Delhi government will support them if they are targeted, setting up an institutional mechanism will need the support of the Centre.”The CM said he can implement our suggestion, if the Centre agrees,” an official said.Since the ACB in Delhi is controlled by the Centre, the association will also meet the union home secretary and Jung next week with the suggestion.The move comes after the recent raids at secretary to Delhi Cm Rajendra Kumar’s office and home by the CBI and after a case was registered by the ACB against vigilance secretary Chetan B Sanghi, on old complaints.

All saw some measure of success, with the French government apparently hailing the move after only one day.However, a report in The Guardian, from 2014, warned that such restrictions, if put in place arbitrarily, can backfire. Mexico City saw driver buying cheaper, less inefficient cars to get around the ban, raising the pollution levels after an initial drop. Bogota, Columbia, saw drivers using off peak hours to do more driving, after the authorities restricted cars during peak hours, leading to more emissions. Beijing, too, after a successful run saw people buying more cars.If the Delhi government has to make a success out of this scheme, even a short term one, it will have to chart out a plan to plug such gaps.

A PIL was on Monday moved in the Delhi High Court against Aam Aadmi Party (AAP) government’s plan to restrict plying of private vehicles having odd and even registration numbers on alternate days from January 1 in the national capital to combat air pollution.The matter was mentioned before a bench of Justices Badar Durrez Ahmed and Sanjeev Sachdeva who listed it for hearing on December 9.The petitioner, Shweta Kapoor, has sought directions restraining implementation of the policy, saying “imposition of such a policy/law would be contrary to public interest and has been imposed without any public debate or discussion and without understanding the situation and facts and circumstances in India”.<!– Dna_Article_Middle_300x250_BTF –>The plan is expected to be implemented from January 1, 2016.The petition, filed through advocate R K Kapoor, has questioned whether the AAP government has the power to modify the vehicular movement in the national capital.Terming the national capital’s public transportation system as “undeveloped and unsafe”, the petitioner has said that it would create problems for women who travel alone as well as differently-abled persons who use modified vehicles to commute.Shweta, who is also a lawyer, has said in her petition that “curtailing the constitutional rights of the citizens by following unreasonable and arbitrary measures as is being done in the present case by the respondents is only going to add to the chaos and shall not actually uproot the actual causes of pollution from the city which include dust, entry of trucks inside the city and traditional ways of waste disposal”.She said the government has not paid any attention to dust from construction sites and has focused only “on a limited question of private vehicular pollution”.”The respondents have failed to check the main cause of concern of pollution in Delhi and are targeting mercilessly and arbitrarily the helpless citizens of this city,” the PIL said.”Simple measures which could have caused the pollution to reduce in the city are better management of traffic and traffic signals and their synchronization, and better road construction technology in Delhi,” it said.

Fifth AAP MLA Akhilesh Tripathi arrested by Delhi police since government formation

The case was lodged following allegations that on March 8, 2013, the accused along with other AAP supporters had gathered at Azadpur area in Noth Delhi and entered into a quarrel with complainant Bittu Jha.

According to officials, Akhilesh Tripathi, MLA from Model Town area of the Capital, was sent to two days judicial custody making him the fifth legislator from the AAP to be arrested since the party formed a government here. Tripathi was brought to the court by the police in pursuance of a non-bailable warrant (NBW) issued against him by the court earlier for his non appearance. Metropolitan Magistrate Kapil Kumar ordered that the MLA, an accused in the 2013 rioting case, be taken into custody while noting his conduct of not complying with court’s order directing him to appear.<!– Dna_Article_Middle_300x250_BTF –>According to police officials, an FIR was registered against Tripathi in 2013 for alleged offences under Sections 147 (punishment for rioting), 148 (rioting armed with deadly weapon), 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object), 323 (causing simple hurt) and 506 (criminal intimidation) of the IPC. Surinder Singh, AAP MLA from Delhi Cantonment, was arrested in August for allegedly assaulting an NDMC employee and passing casteist remarks. All of them are currently on bail.Meanwhile, on Thursday, there was a massive chaos in the Delhi assembly on Thursday with Aam Aadmi Party legislators unanimously voting to extend the suspension of BJP lawmaker OP Sharma for his sexist remark about AAP leader Alka Lamba till winter session. “We had asked the BJP to take action against its legislator, but they have conveniently ignored that. On the other hand, the Delhi police has arrested our legislator at their behest,”an AAP legislator said. Toughening their stand against Sharma, AAP lawmakers demanded that Sharma be sent to jail. “We will not budge from our demand. He must be sent to jail and disqualified,” Lamba said. A group of persons allegedly vandalised the car of Aam Aadmi Party MLA Sharad Chauhan after a scuffle between them and the men accompanying the Narela legislator at outer Delhi’s Bakoli village, police said on Tuesday. The incident was reported around 11.30 PM when Chauhan was returning home and the road outside Bakoli village was clogged due to a marriage procession, said a senior official. When Chauhan’s driver asked for way, some members of the marriage party, who were suspected to be in an inebriated state, allegedly hurled abuses, leading to a scuffle between two groups, said the official.<!– Dna_Article_Middle_300x250_BTF –>During the scuffle, some of them allegedly vandalised the MLA’s car. AAP suspends NRI cell co-convener Munish Raizada for ‘anti-party activities’

Aam Aadmi Party (AAP) has suspended its Chicago-based co-convener of NRI cell Munish Raizada from the primary membership for indulging in “anti-party activities by putting internal affairs in public domain.” Raizada, who had been handling AAP’s overseas affairs, was associated with the party right from its formation and before that with India Against Corruption (IAC).AAP has alleged that Raizada was recently involved in “anti-party activities” by putting its internal affairs in public domain and the action came after his reply failed to convince the leadership, party sources said. A disciplinary notice was sent to Raizada on November 7 and he was suspended from the membership yesterday, which was convyed to him through an e-mail sent by the party’s overseas affairs wing. The email states, “You (Raizada) have not only put internal party correspondence in public domain but also shared it with undisclosed recipient(s), clearly showing that you have no intention of stopping your anti-party activities of creating structures or forums without the permission of the party and misleading volunteers.”<!– Dna_Article_Middle_300x250_BTF –>”We thereby relieve you from any organisational responsibility given and suspend your primary membership of AAP with immediate effect,” it said. The mail has also been sent to AAP leaders Kumar Vishvas, Adarsh Shastri, Preeti Sharma Menon and others. Refuting the charges levelled against him, Raizada said, the truth is that AAP has lost its democracy within. “I was trying to keep it alive by having talks on common platform. I have been suspended from the party, but as a solider of democracy and the party, I would be striving for it,” he told PTI from Chicago.Raizada, along with Jai Nath Misra of London have launched an internal group called Lokpal, which they said was a platform of volunteers of AAP and its main objective was to have an assessment whether AAP was on the path of Swaraj and inner democracy or not. “Every volunteer is Lokpal in himself. I was very much impressed with the ideology with which (AAP convener) Arvind Kejriwal had raised a hope among all the Indians. Even I donated from my pocket into the party fund. But I did not anticipate that internal democracy from the party would die this way,” he said.He also termed expulsion of leaders Yogendra Yadav and Prashant Bhushan from AAP as “unfortunate” and said that had there been internal democracy in the party, this situation would not have arisen.”

Kejriwal also mocked Prime Minister Narendra Modi, saying unlike his monthly radio programme, the Aam Aadmi Party government speaks the ‘Mann Ki Baat’ of the common man.

“Our government gives less speeches and works more. There are few parties which speak more and work less. They face Bihar-like situations. We speak your ‘mann ki baat’, not our ‘mann ki baat’,” Kejriwal said.

The chief minister was speaking at the inauguration of the city’s first ‘Polyclinic’ at east Delhi’s Gandhi Nagar constituency.

On Sunday, Kejriwal termed the Bihar poll verdict a referendum against the Modi government and hoped that after these results, the Centre’s interference in Delhi and other states will end.

The panel has recommended that the MLAs’ salary should be increased to Rs. 50,000 from the current Rs. 12,000 and Rs. 70,000 for assistance. It has also recommended for a conveyance hike from Rs. 6,000 to Rs. 30,000. ‘We have gone into various aspects relating to the expenses and there are so many other considerations, on the basis of which we have decided that they should get this salary on these levels of allowances,’ Expert Committee member Rajiv Malik told the media.

Since then, he has been in police custody. CNG fitness scam: AAP accuses L-G Jung of shielding culprits

New Delhi: The Aam Aadmi Party on Thursday accused Lt Governor Najeeb Jung of trying to “shield” real culprits by allegedly “forcing” the Anti Corruption Branch (ACB) to file a “half-baked chargesheet” in the multi-crore CNG fitness scam.

“The AAP is of the categorical view that the LG, whose own role in this scam is suspect, is trying to shield the ministers of the then Congress government of Delhi and also its top officials, some of whom have since retired.”

“The Lt Governor of Delhi has misused his position by having forced the ACB to file a half-baked chargesheet in undue haste in the Rs 100 crore CNG fitness scam to save the real culprits who were behind this huge loss to the state exchequer,” the AAP said in a statement.

The ACB, last week, filed the chargesheet in the CNG fitness case, a move that has not gone well with the state government at a time when it had ordered a ‘Commission of Inquiry’ to probe the matter.

Last month, Union Home Ministry had termed the set up of Commission of Inquiry by the Delhi government as “illegal, invalid.”

Accusing the LG of consistently “suppressing” the probe, the party said Jung needs to come clean on the issue.

“The LG, who first tried to unsuccessfully hide behind an inquiry committee set-up by him to deny the sanction to prosecute and question the officers involved in the scam, has now taken a complete U-turn by forcing the ACB to file a chargesheet against junior officers, in a desperate bid to deflect attention from his own dubious role and that of the real culprits involved in this mega scam,” it said.

The party said it is “intriguing” that the LG, who had issued a public statement on June 9 to justify his decision of having denied prosecution sanction to certain top officials, whom the ACB had wanted to prosecute, has now suddenly changed his stand.

The post was shared more than 65,000 times and the following day, Jasleen was seen narrating her ordeal to various news channels.On Sunday evening, Jasleen had also filed a police complaint, as a result the man, later identified as Saravjeet Singh, was arrested under section 354 (Assault or criminal force to woman with intent to outrage her modest) and 509 (Word, gesture or act intended to insult the modesty of a woman).<!– Dna_Article_Middle_300x250_BTF –>However it did not end there for Jasleen, who by then was being discussed on various social media websites.While internet users wrote in support of Jasleen and encouraged her for stranding up to the alleged eve teaser, there were many more who attacked Jasleen over a varied number issues and called for a thorough investigation accusing her of falsifying the case.Jasleen began to trend on Twitter when some users took screen shots of her previous posts which she had written in support of the Aam Aadmi Party and attacked her for the same. By the time of filing this story, more than 5000 people had tweeted about the incident with hundreds of them sharing photographs of Jasleen with AAP leaders including Arvind Kejriwal.So much so, the mother of the accused told reporters that Jasleem was Aam Aadmi Party worker and was accusing her son falsely to gain publicity.”It is unfortunate that people are converting a social issue into a political one. I had a horrible experience and I really hope that people would debate on it rather than seeing which political party I favour. If I really was motivated I would have criticised Delhi police and lied about their inaction but I have been repeatedly saying that the cops have been cooperative from the start,” Jasleen told dna.According to her, the incident took place on Sunday evening in west Delhi. “He passed lewd remarks which I don’t even want to repeat. When I told him that I was clicking his picture and would file a police complaint against him, he posed for the photo and dared me to approach police against him. He threatened me with dire consequences if I complained about him,” said Jasleen.She said that his obscene comments were heard by at least 20 other commuters standing nearby at the traffic signal, but no one stood up for her. Armed with his photograph and his motorcycle number, she approached the police who soon registered a case.”I want an investigation into the case. Otherwise why would have filed the case in the first place,” Jasleen said. She added that while she was happy to have seen so much support for standing up against the accused the accusations leveled at her have disturbed her. “All I want is to feel safe while walking on the streets of Delhi. Is it too much to ask for,” she remarked.

The party’s reaction came after the tussle between AAP government and the L-G over the appointment of Swati Maliwal as the Delhi Commission of Women chief.

“The L-G’s office under instructions from the central government has attempted to thwart the appointment of Delhi Commission of Women Chief,” AAP said in its statement. Senior AAP leader said that citing procedural lapses, attempts have been made to decline Delhi Government to run and appoint members to the crucial Delhi Commission of Women.

“The L-G’s office has acted as an extension of the central government led by the BJP when it publicly criticized and declined permissions to the new DCW chief…The central government through the office of Honourable L-G is trying to undermine the democratic mandate of the people through its action,” it said.

The Delhi Electricity Regulatory Commission (DERC) had last week approved a tariff hike of up to six percent for the three distribution companies operating in the region. The hike, which will come into effect from today, will be applicable for the next three quarters.

Delhi Law Minister Jitender Singh Tomar arrested, says AAP; BJP calls it ‘drama’

Deepening the crisis in Delhi government, reports on Tuesday quoted the Aam Aadmi Party (AAP) saying that the Delhi police have arrested Law Minister Jitender Singh Tomar. Earlier reports did not confirm whether Tomar was arrested or detained for police questioning but it was later reported that he was arrested over the alleged fake law degree case.

PTI reported that the police arrested the Aam Aadmi Party leader from his house on Tuesday morning and took him to Hauz Khas police station for further questioning. Tomar was arrested on the basis of a criminal complaint filed by the Bar Council of India, according to CNN-IBN. Times Now reported that an FIR had been filed against Tomar at 3.30 am on Tuesday.

Tomar has been charged under various IPC Sections including 420 (cheating). Speaking to CNN-IBN and said, “I am with some inspectors who are taking me to the Hauz Khas police station without any notice.”

He added that 30-40 police officers had come to his office to take him to the police station. “This is being done to tarnish the image of the AAP. This is political harassment,” Tomar said.

AAP leader Sanjay Singh also tweeted about Tomar’s arrest and alleged that he had been arrested without any prior notice.

Delhi police commissioner BS Bassi refused to comment on the incident and said that he would give a statement only after receiving a full report.

BJP leader Nupur Sharma said that it was all a ‘drama’ by AAP and it was not sure whether Tomar had been arrested or just detained.

“It’s too early to say. We don’t really know if he has been arrested or detained,” Sharma said. “The AAP is just playing on emotions and doing drama.”

While hearing the Aam Aadmi Party government’s plea for qaushing of the notification, the high court refused to stay the notification which has given the L-G primacy in the administrative mechanism of the capital.

The Centre on Friday received a shot in the arm from the Delhi High Court as well as from the Supreme court over the battle between Arvind Kejriwal led-government and the Union home ministry following the latter’s May 21 notification clipping the state government’s power with Lieutenant Governor as its points man.While hearing the Aam Aadmi Party government’s plea for qaushing of the notification, the high court refused to stay the notification which has given the L-G primacy in the administrative mechanism of the capital.<!– Dna_Article_Middle_300x250_BTF –>Earlier in the day, the apex court refused to stay the high court’s single judge’s observations in a recent order, which had termed as “suspect” the Centre’s notification, saying they were “only tentative in nature” without expressing any opinion on its validity.As per the notification, “Delhi government’s Anti Corruption Bureau (ACB) police station shall not take any cognisance of the offences against officers, employees and functionaries of the Central Government.” Justice Rajiv Shakdher of high court while issuing notice to the Centre on Kejriwal government’s plea, sought home ministry to file the practice followed in the past on posting of officers in Delhi and other union territories.”What was happening in the past? Was the earlier government (Delhi government) allowed to move officers? I want factual data as to how it has been carried in the past in Delhi and other Union Territories,” the court said seeking Union of India’s affidavit in this regard by August 11.The court also said two orders of postings made by the city government to be placed before the L-G for deliberation and if he wants any clarification regarding the proposal then he may ask for it from council of ministers.A battery of lawyers, including senior advocates Indira Jaising, HS Phoolka, Dayan Krishnan appeared for the city government in the case.During the argument, Jaising challenged the “constitutional validity” of the notifications saying as a consequence the”day-to-day functioning and administration of the Delhi government is being hampered.””The curbs on the elected government’s powers were affecting work in crucial departments such as power, water and health was virtually coming to a standstill,” she said.Constitution gives “equal weightage” to the opinion of the chief minister or other ministers as to the opinion of the LG, she argued.Defending the Centre, additional solicitor general Sanjay Jain, countered AAP government’s contention saying that cadre controlling authority is the central government and it can post which officer to which union territory and in which department.He added that when the officers are posted by the Central government how can they (Delhi government) “tinker” with that.Meanwhile, dealing with the Centre’s plea seeking stay on the high court’s May 25 judgment which termed as suspect the notification, the Apex Court sought Delhi government’s response in three weeks and decided to examine court order on the jurisdiction of NCT government’s anti-corruption branch (ACB) to arrest policemen.The vacation bench headed by Justice A K directed the high court to hear it independently AAP government’s plea without being influenced by the observations made by the single judge on the notification.”Insofar as observations made in para 66 are concerned, we find that they pertain to notification (of May 21) which was issued after the judgment was reserved by the high court. Neither the Union of India was party who had issued this notification nor was there any occasion to any hearing on the said notification…. We, therefore, clarify that the observations made therein were only tentative in nature without expressing any opinion on the validity of notification and it would be open to the High Court to deal with the said petition independently without being influenced by any observations made in para 66 of the order.”

Women safety: Delhi government to deploy marshals in city buses

“As per our plan, 2,500 personnel of civil defence and home guards are now being trained as marshals in first phase.

In order to ensure security of women in public transport, Delhi Government has decided to deploy 2,500 marshals in buses plying in the city.The government is currently providing training to personnel of Home Guard and Civil Defence as marshals to prevent and deter crime, especially against women passengers, in Delhi Transport Corporation (DTC) and orange colour cluster buses.”As per our plan, 2,500 personnel of civil defence and home guards are now being trained as marshals in first phase.<!– Dna_Article_Middle_300x250_BTF –>They will patrol in buses in groups. Each group will have 3-4 marshals. They will soon start patrolling buses,” Transport Minister Gopal Rai said.According to the government, the marshals will be given walkie-talkies so that they can contact each other.”The idea behind deploying these marshals in groups is that they can prevent and deal with crime completely in buses.If one marshal is deployed in buses, so he may not be able to prevent two or three persons involved in crime and in view of this, we have decided to deploy marshals in groups. Some officials even suggested that a mechanism to put in place a ‘parallel or political bureaucracy’ favouring the ‘Aam Aadmi Party agenda’ has already gained momentum. The AAP government, in March, had appointed 21 MLAs as parliamentary secretaries to each cabinet minister to “fast-track work”. AAP leader Sanjay Singh meets farmer Gajendra’s family in Dausa

Dausa(Rajasthan): Senior Aam Aadmi Party leader Sanjay Singh on Friday met the grieving family of Gajendra Singh, the farmer who allegedly hanged himself from a tree at Jantar Mantar in Delhi where AAP’s farmers’ rally was in progress.

Singh visited Nangal Jhamarwada village in Bandikui area of Dausa district and met with Singh’s children and other family members.

After sitting quietly for a while before the daughter and sons of the deceased farmer, Singh went inside a room to meet his father, wife and other members.

He consoled the family members there.

Earlier, the family had rejected an apology by Arvind Kejriwal for continuing with the AAP rally in Delhi, while the farmer hanged himself to death and demanded a CBI probe into the incident.

“What will happen now after this apology? My brother has died. Kejriwal did not stop the rally for even two minutes after the incident,” the farmer’s sister Rekha told reporters in the village.

The complaint against either men are not specified. However, reports state that the party is angry that both were seen at Bhushan and Yogendra Yadav’s press conference, hours after the two were removed from the NE by the National Council on March 28.
Sharma has written back to the national secretary asking what the charges against him are and why he hasn’t been given a chance to defend himself. Calling himself an active and involved NE member he says that ideally the party should have referred any complaints against him to the lokpal to investigate. This has not been done. He sarcastically congratulates the party on being able to organise it’s national executive meet so quickly these days that many people cannot attend them, such as the March 31 meeting where Sharma was suspended in his absence. He ends his reply with a demand for an investigation into the complaints and his suspension.
Rakesh Sinha’s highly critical letter from March 30 also questioned the party on NE meeting where members were not informed. He had asked why he was not invited for the “emergency” meeting post the national council, when decisions to reconstitute the lokpal and disciplinary committees were taken. “The issue I feel most uneasy about is the treatment we have given to our outgoing Lokpal. While appointment of new Lokpal was indeed due I wonder if our outgoing Lokpal was given adequate opportunity to name his successor as envisaged in our rules,” his letter read. He had also alleged that Bhushan and Yadav were removed from the NE without charges of “anti-party activity” against them being referred to the lokpal.
The National Executive is now a much shrunken body, comprising largely Arvind Kejriwal’s loyalists. On Wednesday night NE member from Tamil Nadu Christina Samy quit the body, saying in her resignation letter, “All I am left with today is an uncertainty, I doubt if AAP still holds the same strengths and whether its integrity is still intact. If what Prashant Bhushan and Yogendra Yadav claim are false, why was the system we ourselves created – the internal lokpal – not implemented.”
By quickly and openly shedding anyone who raises any question, the party is emerging as a much harsher version of itself. The questions being raised the most is how the party that championed the position and the sanctity of the lokpal, is now undermining it with each step.
