Hitting at finance minister Arun Jaitley, Delhi government on Monday said there is no question of giving a “clean chit” to him when an investigation into its alleged financial irregularities is yet to start.”No clean chit has been given to anyone in Delhi cricket body investigation. The enquiry is yet to begin,” Delhi’s deputy chief minister Manish Sisodia.The BJP said the AAP government should apologise to Jaitley for charging him with corruption in DDCA even though its own report found nothing culpable against him.Sisodia raised a number of questions on financial irregularities in DDCA’s functioning and in giving tenders for work already done.”Election commission of DDCA, Serious Fraud Investigation Office (SFIO), and fact finding committee have found scams involving crores of rupees. How fake companies were created and given tenders and how payments were given for work which had already been done,” he asked.”The election commission reports also say that private cricket academies are being run under the umbrella of DDCA. There is no scope for students of school and colleges to participate in league matches of DDCA,” he said.Sisodia said an inquiry commission headed by former solicitor general Gopal Subramaniam that the city government set up has yet to start its probe, and that Jaitley would have a lot to answer for.Chief Minister Arvind Kejriwal also said he would not apologise for targeting Finance Minister Arun Jaitley on the DDCA issue as his government’s panel did not give anybody a clean chit.The Chief Minister tweeted, “BJP almost begging me for an apology, won’t oblige them. Amid frequent face offs between the government and opposition, Finance Minister Arun Jaitley on Wednesday said political discourse in the country has become “more vulgar”.”Though extremely popular to say, the anti-corruption law must be made more and more stringent and more and more unreasonable. That is the more popular way these days in politics, particularly when political discourse also tends to become more vulgar,” Jaitley, under fierce opposition attack over alleged irregularities in Delhi’s cricket body, said delivering the annual Intelligence Bureau lecture.<!– Dna_Article_Middle_300x250_BTF –>Jaitley’s comments came amidst the ongoing tussle between the Arvind Kejriwal government and the Centre over alleged corruption in the Delhi and District Cricket Association where he was the president for about 13 years till 2013. Suspended BJP MP Kirti Azad too alleged there were financial irregularities in the DDCA when Jaitley was at its helm.Jaitley has refuted the allegations and filed civil and criminal defamation cases against five AAP leaders, including Kejriwal. About “continuing mandamus”, Jaitley said the whole idea behind the move was to make sure that investigating agency does its job.”This process has gone on for two decades and you have cases of economic offences which are investigated by several agencies, state police, CBI and other agencies which requires an introspection and analytic view, a continuing mandamus alerts the investigation,” he said. Continuing Mandamus is a writ of Mandamus issued to a lower authority by the higher authority in general public interest asking the officer or the authority to perform its task expeditiously for an unstipulated period of time for preventing miscarriage of justice.The Finance Minister said there are not too many cases in which investigating agencies in a case involving continuing mandamus have ended investigation in favour of the accused. “The golden rule which most investigating agencies follow is that if a court is conducting a continuing mandamus, it is easier to file a charge sheet and let the court decide whether evidence exists or not,” he said.Therefore, Jaitley said, after 20 years of this experiment, a call has to be taken, including by the courts, whether the imbalance between a fair investigation and rights of the accused have been created by an institution of continuing mandamus.It is an instrument which can be used rarely in cases where there is reason to apprehend that an honest investigation is not being carried out. “To make continuing mandamus a regular practice, may have a tendency to create an imbalance in the criminal jurisprudence due to the reasoning adopted in the judgement of cases,” he said.

Delhiites may have to cough up a fine of Rs 2,000 for violating the odd-even rule as the AAP government’s transport department has proposed a penalty scheme during the 15-day trial period of road-rationing experiment starting January 1. Sources said that the final proposal has been submitted to the government and Chief Minister Arvind Kejriwal will soon take a final call on this issue.The Delhi government had recently asked the department to prepare a proposal to finalise the penalty that will have to be paid for the violation of odd-even rules.<!– Dna_Article_Middle_300x250_BTF –>As per the transport department’s proposal, under Section 115 of Motor Vehicle Act, government has powers to restrict the use of vehicles and the violation of this rule would entail punishment of Rs 2,000 as prescribed under Section 194 of the Act, said an official.”A proposal of imposing a fine of Rs 2,000 for violating odd-even rules has been sent to government. CM will take a decision in a review meeting soon to be held on odd-even scheme. Once government gives its nod to proposal, it will be sent to Lt Governor for his approval,” a source said.They also said that government was also contemplating to give special powers to the traffic police, as it was delegated during Commonwealth Games 2010 to implement the odd-even formula so that cops can “strictly” prosecute drivers.To curb rising pollution level in the national capital, the AAP government has decided to introduce odd-even scheme to be implemented starting January 1. Government will install remote censor cameras on some roads to access traffic loads during this scheme.According to the government’s plan, it will run 6,000 additional buses to accommodate numbers of passengers after the implementation of odd-even scheme.

First, that it violates the federal structure of the Constitution. Finding himself acting as a shield to cover an officer under investigation, the Delhi chief minister has attempted to focus attention on me. He repeats endlessly that I misled the Parliament on the Delhi raid and that he has a series of allegations to make against me in relation to my tenure as President of the DDCA – Delhi’s cricket body. The Congress transiently joined Mr. Kejriwal’s company for the reason that its own leaders are in the dock for more than one reason,” he wrote. The Finance Minister also said that no personal allegations were ever made against him with regard to cricket administration, but admitted that there were certain irregularities. “Even though I am not concerned with cricket administration since 2013, a Member of Parliament has been writing to various governmental bodies with regard to Delhi’s cricket affairs. The UPA Government seized upon the opportunity and referred the complaints to the SFIO which investigated all his complaints over a period of time and submitted a detailed Report on 21st March 2013. The Report concluded in relation to the DDCA being registered under the Companies Act, that:- “thus, in a nutshell, there are certain irregularities / non-compliance or technical violations, but no fraud (was) noticed as alleged,” he wrote. “These technical and procedural violations were all compoundable and were compounded by Members against whom they were alleged. The SFIO, under the UPA regime, investigated and could not find a shred of evidence against me. No personal allegation was ever made against me nor did I ever feel the need of contradicting it. There are fake allegations such as escalation of cost of construction of a stadium. When work expands, cost escalations are integral. A brand new 42,000 capacity world class stadium was constructed by the EPIL, a public sector body at a total cost of around Rs.114 crores. At the same time, the UPA Government renovated two stadiums. The Jawaharlal Nehru stadium was renovated at a cost of over Rs.900 crores and Dhyan Chand stadium was renovated at a cost of over Rs. 600 crores,” he added. “I have felt the need for stating the above in order to counter any unsubstantiated, non-specific allegations. I have left cricket administration in 2013. By referring to some facts of 2014 and 2015, he (Kejriwal) can’t drag me in,” Jaitley said.

The CBI on Wednesday spoke to the media to address all the allegations made by AAP on Tuesday after the agency raided the CM’s Office in corruption case. CBI spokesperson Devpreet Singh said that the raids were conducted as per procedure and that the office of Delhi CM Arvind Kejriwal was neither searched nor sealed. “Blatant incorrect information is being spread by certain quarters since yesterday to discredit agency with intent to obstruct investigation. CBI categorically denies having seized any material during searches which are not relevant to investigation. Police said prima facie the baby died due to suffocation after a heap of clothes fell on it when the parents were preparing to clear out of the jhuggi and hence no case was registered. The baby’s grandmother, however, said it was wrong on the part of the railways to deny any connection of the demolition drive with the death of the child, saying “the officials never informed us in advance”. “They had made a plan to demolish the shanty and had surrounded the area. There was chaos and when police started chasing us, we started running and in that moment the luggage fell on the child and he died after that. Had they informed us in advance, we would have not come in their way,” the victim’s grandmother said, adding “As police started chasing us and throwing our items, we panicked. We want rehabilitation.” Kejriwal, who visited the site late last night, slammed the railways for undertaking the demolition drive at a time when the temperature saw a sharp drop. He ordered officials to immediately provide blankets and food to those who were rendered homeless following the drive.Earlier in the day he told the reporters, “A child has died here. It is a very sad thing and I think that a murder case should be registered against the officers. Compensation will be taken from them. It should be deducted from the salaries of the officers who have conducted these raids.” In a series of tweets, Kejriwal had said, “Railways have demolished 500 shanties in this extreme cold. One child has died. God will never forgive them. Had instructed the local SDM to arrange for food and shelter. This policy has been framed as per the provisions of DUSIB Act, 2010; Special Provisions Act, 2011, Master Plan of Delhi 2021 and various landmark judgements of Supreme Court of India and High Court of Delhi,” it said.The AAP government also said this demolition is against the decisions taken in the meetings held between Chief Minister Arvind Kejriwal and senior railway officers on May 8 and September 22 this year. “The Delhi Slum and J J Rehabilitation and Relocation Policy envisages that shanties in Delhi will not be demolished without rehabilitation of eligible dwellers as per provisions of the said policy. “Whether the dwellers are eligible for rehabilitation or not can be ascertained only after the joint survey and eligibility determination by Delhi Urban Shelter Improvement Board (DUSIB) and Land Owing Agency, which in this case is Railways. But unfortunately no such survey was conducted by Railways before carrying out this demolition,” it said.It also alleged that railways did not even inform DUSIB about the demolition “thereby causing a great hardship to the dwellers as even the relief arrangement such as food and water etc. could not made for the victims of this demolition.”

Many such suggestions are pouring in. We will try this Odd Even Formula once. If it is successful then we can implement it again. If not then it can be dropped. Currently, there is no structured platform to seek public opinion. The work for forming mohalla sabhas is on and of 3,000 mohalla sabhas, we have formed some 2,700 and maps for remaining are being prepared. Once that takes place then we can have a platform. But there are some decisions at the gram sabha level, district and state,” he said.He said the Delhi model cannot be applied anywhere else as there are multiple agencies and “no single command”.Highlighting the issue of land acquisition, Kejriwal said when the Delhi government planned to procure new buses it needed around 500 acres of land.”But the DDA asked for Rs 4 crore per acre. Now, the total cost of buses is less than the cost of land required. The DDA gives land only for building school. For even building a hospital or university, the Delhi government has to shell out Rs 4 to 10 crore,” Kejriwal said.

In a sign of growing bonhomie between the two leaders, Delhi Chief Minister Arvind Kejriwal today met his West Bengal counterpart Mamata Banerjee here.The meeting took place at Parliament House during which Banerjee introduced several of her party’s MPs to the Delhi Chief Minister. The government may also allow movement of trucks only after 11 PM as they slow down overall vehicular movement which was pointed out to be a major contributing factor to pollution from vehicular emission.The city government will also make it mandatory for vehicles to have Euro VI standards for vehicular emission from 2017. Delhi Dialogue Commission Vice Chairperson Ashish Khetan said the idea has been borrowed from foreign countries.Officials from Delhi traffic police said they are yet to receive an official communication from the Government and only after that they will be able to comment on the feasibility of the proposal. Delhi traffic police has a staff strength of 5,500, who work in shifts in a day. Former cop Kanwaljit Deol said enforcement of the policy is going to be very difficult. “More than depending on the traffic force to collect penalty from commuters and enforce the rule, it should be like a drive based on people who would volunteer to follow it,” she told dna.

2014 rally case: Bombay HC denies Arvind Kejriwal exemption from appearance

The Bombay High Court on Friday refused to exempt Delhi Chief Minister Arvind Kejriwal from appearing before a magistrate court here tomorrow on a complaint lodged against him in connection with a rally last year. In March last year, the complaint was lodged against Kejriwal for holding a rally in suburban Mankhurd here without prior and requisite permissions from traffic police. Kejriwal had approached the high court seeking quashing of the FIR and exemption from appearing before the Kurla metropolitan magistrate court.<!– Dna_Article_Middle_300x250_BTF –>His lawyer Mihir Desai argued that Kejriwal had nothing to do with taking permissions and FIR can be registered against the local party member concerned. The bench asked Desai to withdraw the petition and seek discharge from the case before the magistrate. Delhi cabinet approves two changes in new Jan Lokpal Bill

Following backlash from expelled AAP leaders Prashant Bhushan and Yogendra Yadav and the opposition in Delhi assembly over a ‘diluted’ anti-corruption legislation, the Delhi cabinet on Thursday approved two amendments to its new Delhi Jan Lokpal Bill, 2015. According to AAP legislators, the amendments are in line with those proposed by veteran social activist Anna Hazare. The new members will include another judge from Delhi high court, any eminent personality selected the rest of the committee members and the Lokpal chairman from the next term. For removal of Lokpal, there would be a high court enquiry first before referring the matter to the Delhi assembly, where two-thirds of the Delhi assembly can vote to remove the Lokpal. However, in the 2011 bill, a Lokpal could be removed only after being found guilty of wrongdoing by courts and a presidential clearance. However, the rest of the provisions of the bill have been kept unchanged. It is likely to be tabled in the house on Friday.AAP leaders Kumar Vishwas and Sanjay Singh met Anna at Ralegan Siddhi on Tuesday, who had suggested the amendments. AAP’s VAT amendment bill proposes paying in advance for imported goods, heavy penalty for tax evaders

The Arvind Kejriwal government is likely to table a new Value Added Tax (Third) Amendment Bill, 2015, in the assembly this session to enable collection of tax in advance on goods imported from outside India. According to a provision in the bill, the government can collect a certain percentage of the value added tax on imported goods at the time of customs clearance, while the rest of the tax can be collected later after further calculation, sources said. The tax will also have to be paid in advance on goods not meant for sale or consumption in Delhi, which will be later adjusted or refunded by the government.<!– Dna_Article_Middle_300x250_BTF –>Industry sources claimed that prices of imported goods will go up, since dealers have to pay a lump sum amount of money on goods even before they are sold. Delhi government officials, however, dismissed the claim saying the bill doesn’t propose an increase in taxes and that dealers will pay the same amount of taxes, just in different phases. At present, goods worth Rs 10,000 crore are imported every month through the three land ports and the international airport of Delhi. A major quantity of liquor, chocolates and perfumes, among other items of regular use are imported by the country.The bill has a provision to impose strict punishment on tax evaders, with an imprisonment of a year if the tax evasion amount is more than Rs 1 crore, and a fine of minimum Rs 50,000, which can also go up four times the evaded tax amount. The bill was cleared by the Delhi cabinet on Wednesday and is likely to be tabled in the assembly on Thursday. The winter session of the Delhi assembly is set to go on till Friday.The bill proposes to set up special courts and special public prosecutors for tax evasion cases. It also proposes a provision where officials of trade and taxes department can carry out investigations on tax evasion cases and also prosecute offenders before the metropolitan magistrate court without referring complaints to the police. “The bill, once cleared by the assembly, will solve two purposes. Firstly, Delhi government will have an authentic information of the exact number of companies in Delhi which import goods and what goods they import,” said a government official, adding that it will empower the government officials who will not have to depend on the Delhi police to investigate and prosecute a tax evader.The bill will also enable the government to ensure dealers install a point-of-sale device to keep a tab on tax evaders.

Metropolitan Magistrate Kapil Kumar ordered that the MLA, an accused in the 2013 rioting case, be taken into custody while noting his conduct of not complying with court’s order directing him to appear. Delhi Chief Minister and Aam Aadmi Party convener Arvind Kejriwal on Monday claimed that the party is not in the race for 2019 elections and asked its members to not run after polls even as he indicated that the party could get a Delhi-like opportunity in Punjab.”We are not here for power politics. People ask if AAP is in race for 2019? We are not in any race. Delhi’s win was miraculous. We just have to keep working hard and honestly. Don’t run after elections. All indications are that you are going to get the same opportunity in Punjab,” he said in his address at AAP’s National Council meeting. Why should we give them an opportunity to install Swaraj?” Listing AAP government’s achievements, Kejriwal said, “We completed a flyover before deadline. Metro also completed its project ahead of deadline. But what is different is, we saved Rs 100 crores on it”.”Manishbhai (Sisodia) is today tabling a historic bill today. The National Council is the body of founding members of the party, while National Executive is the second highest decision-making body of the party. The Council ratifies all the decisions taken by the party. According to the party’s Constitution, the National Executive has to be reconstituted every three years. The tenure of the present members of the National Executive ends this month. The AAP was formed in November 26, 2012.Founding members Prashant Bhushan, Yogendra Yadav, Ajit Jha and Anand Kumar, who were expelled in April this year, are to be replaced by new members.

AAP government to reward citizens for uploading pictures of their bills on app

In another attempt to fill up their depleting coffers, the ruling Aam Aadmi Party government in Delhi will rope in citizens to join an ongoing offensive against tax evaders. The motivation here for people could be a hefty sum of prize money, that could reach up to Rs50,000.It’s simple. According to sources, the Arvind Kejriwal government will be launching an application on the scheme “Bill Banwao, Inaam Pao”, which can be downloaded on your phone, to upload the pictures of bills provided by your shop, restaurant, grocer, with basic details, such the name of the establishment and the TIN mentioned in the bills.<!– Dna_Article_Middle_300x250_BTF –>One per cent of those uploading the pictures of their bills will get a reward of double the bill amount through a lucky draw. That means one out 100 people will be rewarded with double the amount mentioned in pictures of invoices that (s)he uploads on the app.Sources said the initiative will help the government in two ways. First, the prize money and the lucky draw will encourage citizens to ask for proper invoices whenever they buy any product or avail of a service.Secondly, with several invoices handy, the VAT department would be able to keep a check on specific establishments to ensure they do not manipulate the bills and subsequent taxes they pay the government.A senior official said that the app is nearly ready and will be launched by this month end. Delhi would be one of the first governments in the country to launch such an app.”The initiative will help citizens to participate in governance. They will now insist on bills, which will lead to instances of tax evasion going down,” an official said.The app will also enable citizens to report fake or kachha bills – one of the most common ways adopted by most shops in the city to evade taxes – to the government, so that VAT inspectors can locate and crack down on the particular establishment. However, this one comes without a reward.Bills given by restaurants have two components, the VAT which goes to the Delhi government and the service tax that goes to the central government, while those provided by shops mostly carry only the VAT.Value added tax (VAT) accounts for a major source of revenue for the Delhi government. The AAP government has set a target of Rs24,000 crore for the current fiscal year of 2015-16, Rs5,500 crore more than the approximately Rs18,550 crore raised last year.Dna recently reported that the tax department will be increasing the VAT on jet fuel by five per cent to increase its collections.

Sources said the action was taken after he aligned with ‘Swaraj Abhiyan’, the group founded by Yadav and Prashant Bhushan. They added that suspension action has been taken against at least 2-4 members ahead of the NC meeting.

A scattered opposition sent out the first signs of an attempted cobbling up of a possible alliance against the BJP at the historic Gandhi Maidan here on Friday during the swearing-in ceremony of Nitish Kumar as the chief minister of Bihar for the fifth time. Lalu’s sons Tejashwi and Tej Pratap took oath after Nitish Kumar and were rewarded with plum portfolios. Tejashwi was given the post of deputy chief minister with PWD portfolio while the elder son Tej Pratap got health and environment ministries.Remarked LJP leader Chirag Paswan, MP, “After Nitish, it was the turn of Lalu sons and senior RJD leader Abdul Bari Siddiqui. It’s clear now that Lalu will dictate the government.” Lalu supremacy also left discontent among ministry hopefuls with Shyam Rajak (JD-U) even unwilling to participate in the oath-taking ceremony.Observers meanwhile opine that the absence of both Samajwadi Party and the BSP in the grand coronation should be taken as a dampener in the larger design of cobbling up of an effective alliance against the BJP.
