Uber cab rape case: Delhi court grants life sentence to driver Shiv Kumar Yadav

An Uber cab driver was on Tuesday sentenced to life imprisonment till his natural death for raping a woman executive in his taxi 11 months ago by a Delhi court.

“Convict (Yadav) is sentenced to rigorous imprisonment for life which shall mean imprisonment till his remaining natural
life for the offence under section 376 (2)(m) (committing rape causes grievous bodily harm) of the IPC,” the judge said and
also imposed a fine of Rs 21,000 on him.

The court also directed the Delhi Legal Services Authority to give compensation to the victim and to take care of the family of the convict.

Moments after pronouncement of the judgment, Yadav, his wife, father and two minor daughters started crying inconsolably. His wailing wife also fainted in the courtroom.

The judgment handing out life imprisonment comes  two weeks after the court convicted him in the case. The court had found that there was sufficient evidence against Yadav and that all prosecution witnesses had supported the case against him. The court had convicted him under sections relating to rape, abduction, criminal intimidation and causing hurt.

In December last year, a 27-year-old woman was raped in an Uber taxi, which she had hired to return home from a dinner party in Gurgaon.

According to the police, the woman had dozed off on the back seat of the car, and she later woke up to find that the car had stopped at a secluded spot. When she tried to raise an alarm, the driver is said to have assaulted and raped her.

The driver Yadav was arrested on 7 December, 2014 from Mathura and is currently in judicial custody.

The Supreme Court had earlier set aside the Delhi High Court order allowing the accused to re-examine 13 prosecution witnesses, including the victim.

After Yadav was arrested, it came to light that he had a history of alleged sexual assault and had five cases of sexual assault registered against him.

After the incident, the Delhi government had banned several app-based companies and had cancelled the licence application of Uber. However, the government act of cancelling the licence was set aside by the Delhi High Court.

Last month, the woman voluntarily ended her lawsuit against Uber in a US court, which she had filed in January, according to a Reuters report. This was after Uber argued that the driver had a contract with Uber BV, a Netherlands-based entity which had no US operations.

SC clears path for dance bars to re-open in Maharashtra, but tells cops to ensure ‘no obscenity’

New Delhi: Potentially clearing the path for outlawed dance bars in the state, the Supreme Court on Thursday stayed the operation of Maharashtra Police Act that prohibited dance performances at eating places, beer bars and restaurants.

The apex court, while ordering the stay, said that the Maharashtra police would ensure that women’s dignity was not affected by the working of the dance bars, NDTV reported.

Noting that the provision was brought back in the Maharashtra Police Act in 2014 after being held ultra vires in 2013 by the apex court, the bench of Justice Dipak Misra and Justice Prafulla C Pant said that it is “appropriate to stay the provision” that prohibits the dance performances.

However, the court made it clear that the dance performances should not be remotely explicit or have kind of obscenity.

Maharashtra chief minister Devendra Fadnavis, said the government would abide by the court’s decision.

“The state government believes that the law it had passed on dance bars was appropriate,” he said.

In 2009, the Supreme Court had struck down a similar law, after which the state government passed a fresh law in 2014, the Times of India reported.

While setting aside the ban on dance bars, the Supreme Court had questioned why the state government did not consider it indecent for women to be working as receptionists or bartenders at such bars, the Hindustan Times reported.

Delhi High Court declines anticipatory bail plea, AAP MLA Somnath Bharti faces arrest

The Delhi High Court on Tuesday rejected Aam Aadmi Party (AAP) MLA Somnath Bharti’s anticipatory bail plea, clearing the way for his possible arrest, news channels reported.

“This petition (for anticipatory bail) is dismissed,” Justice Suresh Kait said.

Bharti had approached the court seeking protection from arrest in a case of domestic violence case filed by his wife.

Speaking to the media, the AAP leader’s lawyer say that he would approach the Supreme Court to seek protection from arrest.

The public prosecutor in the matter, however, said that Bharti, as a responsible citizen, should co-operate in the investigations, and said that his arrest was possible.

Earlier, the court had pulled the MLA for going to the police station late at night, saying, “If he loves going to the police station, then I will send him from here….Once you (Bharti) get relief, you act like a lion and go here and there.”

Bharti had said he has joined investigations on three occasions, and also claimed that the police was prejudiced against him due to his issuance of a notice to the Commissioner of Police in a separate matter which has ‘led to the malicious and vindictive conduct of the commissioner in the case in order to frame and persecute him’.

His anticipatory bail plea stated that as he was the chairman of the Privileges Committee of the state Assembly, Bharti was tasked to issue notice to the commissioner for breach of privilege in a matter.

Seeking cancellation of the non-bailable warrant issued against him, Bharti said it had no purpose as he was not absconding from the law.

The Delhi Police has registered an FIR against Bharti under sections 307 (attempt to murder), 498A (cruelty towards partner in marriage), 324(voluntarily causing hurt by dangerous weapon), 406 (criminal breach of trust), 313 read with 511 (attempt to cause miscarriage without woman’s consent), 420 (cheating) and 506 (criminal intimidation) of IPC.

Udhampur faces second terror attack in as many days, two cops injured

Just a day after a terror attack in Udhampur claimed the lives of two BSF constables, yet another attack has taken place in the Basantghar area of the town.

According to TV reports, two militants opened fire on a police post in Basantghar injuring two Special Police Officers (SPOs) injured in the process. A CNN-IBN report confirmed that the police are having difficulty in tracing the terrorists due to darkness. Quick Reactions Teams have been rushed to the encounter site, the report said.

Earlier in the day, two encounters reportedly took place in Pulwama and one suspected Lashkar-e-Taiba militant was gunned down by security personnel.

On Wednesday, a terror attack suspected to be originating from Pakistan left two BSF constables dead on the crucial Jammu-Srinagar highway, but one of the two terrorists involved was captured alive.

Mohammed Naved, a resident of Ghulam Mustafabad area in Faislabad town of Pakistan, along with another terrorist Noman alias Momin, had fired at a BSF convoy on the highway at Simroli at around 8 am on Wednesday. BSF jawans had retaliated, killing Noman while Naved managed to escape towards a village in the nearby hills where he took three villagers hostage.

The villagers had managed to capture him and called the police who took him into custody, giving the Indian security establishment a prize catch which points to Pakistani involvement in the attack.

Pakistan on Thursday had rejected India’s assertion that Naved was of Pakistani-origin and asked India to refrain from making “accusations”.

“We have also seen media reports and I will not offer any comment on that issue. We expect the Indian authorities to share information with us on the claims that are being made in the media,” Pakistan Foreign Office spokesperson Syed Qazi Khalilullah had said on the arrest of the terrorist in India.

However, a Pakistan-based man on Thursday identified himself as the father of Mohammad Naved, contradicting Pakistan’s stand that the terrorist was not from Pakistan.

Long overdue? RK Pachauri removed as TERI chief over sexual harassment charges

Bengaluru: Renowned climate scientist RK Pachauri, who is battling charges of sexual harassment by a junior colleague, was on Thursday sacked as chief of The Energy and Resources Institute (TERI) by its top decision making body.

The decision to show the door to Pachauri as Director General of the non-profit think-tank, TERI, was taken by its Governing Council that has some of the influential names of corporate India, at a meeting held in Bengaluru.

The Council chose Bureau of Energy Efficiency (BEE) Director General Dr Ajay Mathur as successor to 74-year old Pachauri, who was allowed by a Delhi court recently to enter his office premises while keeping the head office and a branch in Gurgaon off limits for him.

“The Governing Council (GC) of TERI at its meeting held in Bangalore today took a decision to appoint Dr Ajay Mathur, currently Director General of the Bureau of Energy Efficiency (BEE), Government of India, as the Director General (DG) of TERI,” the environment body said in a statement.

Pachauri has been booked on charges of molestation, stalking, sexual harassment (Sections 354, 354A, 354D of IPC) and criminal intimidation (Section 506 of IPC) on a complaint by a 29-year-old woman in February 13.

Pachauri quit as the chairman of the Nobel Prize-winning UN Intergovernmental Panel on Climate Change (IPCC) earlier this year after the woman in her complaint, alleged that he sent her inappropriate emails, text and WhatsApp messages, charges that were denied by him.

“…Pachauri will not continue… The long term interest of TERI is paramount,” Kiran Mazumdar Shaw, chief of biotech giant Biocon, who is on the Governing Council, told PTI after the meeting.

The Council also includes non-executive chairman of the board of HDFC Deepak Parekh, banker Naina Lal Kidwai, veteran investment banker Hemendra Kothari and Earth Sciences and Secretary Shailesh Naik.

Mathur will take up his new responsibilities as soon as he is in a position to do so, subsequent to being relieved from his current responsibilities by the Government of India after a brief period of transition, the TERI statement said.

“Pachauri has led and built TERI over the last 34 years from a concept to a major, financially autonomous, professionally dynamic organisation on the global stage,” it said.

It said the decision to appoint Mathur was the culmination of an extensive search process and an intensive evaluation of candidates from across the globe.

“All efforts will be made to aid and assist Dr Ajay Mathur in a smooth and expeditious transition, as the latter assumes responsibility as TERI’s new chief executive,” it said.

The statement said the Council is certain that the 1,200 persons working for TERI in different parts of the world would “welcome this development, and extend all their support towards a smooth transition…”

The Delhi court’s decision last week allowing Pachauri access to all TERI offices in the country except the ones in Delhi and Gurgaon had come after the police sought cancellation of his anticipatory bail, saying he was influencing witnesses and misusing the liberty of bail.

Pachauri had told the court that there was “nothing on record to suggest that he has ever influenced witnesses or any other persons related to the present case or interfered in the investigation.”

The complainant, a research analyst, had alleged in her application that “free and fair investigation” cannot be carried out if Pachauri was “allowed to roam around freely”.

Delhi Law Minister Jitender Singh Tomar arrested, says AAP; BJP calls it ‘drama’

Deepening the crisis in Delhi government, reports on Tuesday quoted the Aam Aadmi Party (AAP) saying that the Delhi police have arrested Law Minister Jitender Singh Tomar. Earlier reports did not confirm whether Tomar was arrested or detained for police questioning but it was later reported that he was arrested over the alleged fake law degree case.

PTI reported that the police arrested the Aam Aadmi Party leader from his house on Tuesday morning and took him to Hauz Khas police station for further questioning. Tomar was arrested on the basis of a criminal complaint filed by the Bar Council of India, according to CNN-IBN. Times Now reported that an FIR had been filed against Tomar at 3.30 am on Tuesday.

Tomar has been charged under various IPC Sections including 420 (cheating). Speaking to CNN-IBN and said, “I am with some inspectors who are taking me to the Hauz Khas police station without any notice.”

He added that 30-40 police officers had come to his office to take him to the police station. “This is being done to tarnish the image of the AAP. This is political harassment,” Tomar said.

AAP leader Sanjay Singh also tweeted about Tomar’s arrest and alleged that he had been arrested without any prior notice.

Delhi police commissioner BS Bassi refused to comment on the incident and said that he would give a statement only after receiving a full report.

BJP leader Nupur Sharma said that it was all a ‘drama’ by AAP and it was not sure whether Tomar had been arrested or just detained.

“It’s too early to say. We don’t really know if he has been arrested or detained,” Sharma said. “The AAP is just playing on emotions and doing drama.”

Nepal earthquake upgraded to 7.9 on Richter scale, Modi calls for emergency meet

Tremors were felt across north and eastern India as an earthquake with a revised magnitude of 7.9 on the Richter scale took place with its epicentre in Nepal. Initial reports from Nepal said several buildings were damaged and people were being rushed to hospitals.

In India, the tremors were felt in parts of Delhi, Bihar, West Bengal, Uttar Pradesh, Ranchi, Rajasthan and Assam, according to TV reports.

Prime Minister Narendra Modi has called for an emergency meeting at 3 pm this afternoon and has spoken to the President of Nepal as well as the CMs of Bihar and Assam.

Bihar CM Nitish Kumar said all forces are on the ground and information is being collected from all the districts.

According to PTI, the tremors in Delhi and the NCR region lasted for a full minute and began at 11.44 am.

The epicentre of the quake was 83 km north-west of Kathmandu, Nepal, according to ANI. The Indian Meteorological Department (IMD) said that the magnitude was 7.5.

PM  Modi also tweeted about the earthquake, saying the government was in the process of find out more information.

As a result of the earthquake, a stampede reportedly took place in Kutchery, Varanasi, reported ANI.

Bihar Chief Minister Nitish Kumar was taking stock of the situation and talking to the state administration after the earthquake took place.

DG of Meteorological Department LS Rathore also said that aftershocks of 6.6 magnitude were felt following the initla tremors. MET Director GL Gautam called the earthquake a “massive earthquake”.

The Delhi Metro services in the national capital were temporarily suspended, according to reports. Mobile services in Patna were also affected.

No casualties or damages have been reported in India so far. Further details are awaited.

However, the US Geological Survey says it expects heavy damage in Nepal.

Tremors were also felt in Pakistan. Mohammad Shahab, a resident from Lahore, Pakistan, says he was sitting in his office when the earthquake rocked the city.

He says the tremors continued for a while but now the situation is normal in the city.
