CBI registers disproportionate assets case against IAS officer

Trapped by CBI
Sanjay Pratap Singh, who was the principal secretary of Delhi government’s welfare department, was arrested by the probe agency on December 8, along with his PA, when he was caught red-handed in a trap laid by the CBI. This was after a complainant, who is apparently an AAP volunteer, approached the CBI and accused Singh of demanding a bribe from him.

CBI has claimed to have recovered five voice recordings from the email account of Rajendra Kumar, Secretary to Delhi Chief Minister Arvind Kejriwal, purportedly carrying his oral instructions to allegedly influence contracts in favour of Endeavour Systems.CBI sources on Wednesday said that Kumar who initially refused to share his email password to sleuths during his detailed examination had later provided the details. The sources claimed that scrutiny of his email account resulted in discovery of five audio recordings pertaining to the period of 2011-13 which carry his purported instructions to the officers handling tenders and contracts to allegedly manipulate and favour Endeavour Systems, which is also named in the FIR.<!– Dna_Article_Middle_300x250_BTF –>The voice samples of Kumar, a 1989-batch IAS officer of AGMUT cadre, have been taken as per legal procedures and matched forensically, the sources claimed adding that the said conversations could bring more people into scrutiny. The CBI said that it has registered a case against Kumar and others on allegations against the officer that he abused his official position by “favouring a particular firm in the last few years in getting tenders from Delhi government departments”.Kumar has been booked under 120-B of IPC (criminal conspiracy), and 13(2), 13(1)(d) of the Prevention of Corruption Act (Criminal conspiracy, criminal misconduct etc) for allegedly favouring a private company in five contracts worth Rs 9.5 crore during 2007-14.”The accused allegedly facilitated award of contracts worth Rs 9.50 crore(approx) to the said company through ICSIL and misused his official position as public servant. The accused were instrumental in award of projects to the said private company in Delhi Transco Ltd; Health and Family Welfare Department, GNCTD; Delhi Jal Board and Department of Trade and Taxes, GNCTD,” CBI had said in the statement after the registration of the case.

The Central Bureau of Investigation today registered a disproportionate assets case against as IRS officer posted at Employees Provident Fund Organization in New Delhi. According to the CBI, the amount being contested as disproportionate to the official’s income is more than six crore rupees.The official, named Sanjay Kumar, a IRS-1991 Batch is the Financial Advisor as well as the Chief Accounts Officer posted at Employees Provident Fund Organization. Making his stand on intolerance debate and puraskar wapasi public for the first time, chief minister Devendra Fadnavis on Thursday hit back at Congress by saying people of the country were always tolerant and even assimilated invaders. He added that the returning of awards stopped after the Bihar election results. The CM was talking during a discussion in the state assembly on Dr Babasaheb Ambedkar and Constitution, held to commemorate the father of Indian Constitution’s 125th birth anniversary. The event witnessed political one-upmanship and trading of allegations. Expressing his displeasure, Fadnavis said the discussion could not attain the height it deserved because his predecessor Prithviraj Chavan used the platform for political purpose.<!– Dna_Article_Middle_300x250_BTF –> Citing the example of emergency, Fadnavis said when lakhs of people were put behind the bars, it was courts that provided relief to the Indian democracy. He said it was strange to see that those who used emergency to silence the Opposition are now citing the misuse of the central bureau of investigation (CBI). He added that the government has a vindictive approach towards the Congress leaders. Chavan said it was Atal Behari Vajpayee who tried to bring in the word Samrasata in the Constitution. He, however, failed because the word is used by RSS, said Chavan. He questioned as to whether surrender by all leaders for a single leader was the meaning of Samrasata. He cautioned that this kind of unilateralism would usher in an autocratic rule, posing danger to the Constitution, plurality, diversity and rich heritage of the country. Chavan also cited Dr Babasaheb Ambedkar’s statement, saying howsoever good was the Constitution, it depended upon the quality of people for whom it was made. If people are bad, the Constitution would prove to be futile in ushering in the welfare state, he said. To that Fadnavis replied why were the fundamental issues of poverty and illiteracy not solved when the Constitution was in the hands of good people of Congress for almost six decades?

An FIR was lodged on Saturday by the Haryana Vigilance Bureau against the then Chairman and Chief Administrator of HUDA for alleged irregularities in allotment of industrial plots in Panchkula three years ago when the then Chief Minister Bhupinder Singh Hooda was at the body’s helm.The FIR was lodged even as Haryana Chief Minister Manohar Lal Khattar recommended CBI probe into the alleged irregularities during the previous Congress government. The Vigilance Bureau registered the case under relevant sections of the IPC and the Prevention of Corruption Act against the then Chairman of the Haryana Urban Development Authority (HUDA), a post held by Hooda, as also former IAS officer DPS Nagal and two other officials of the authority. The FIR does not mention Hooda by name but names of others — Nagal, then HUDA chief finance officer S C Kansal and another official B B Taneja, besides 13 beneficiaries, figure in it, a senior Vigilance Bureau official told PTI.<!– Dna_Article_Middle_300x250_BTF –>Hooda dubbed the move as “political vendetta” unleashed by the BJP government. “They (BJP) have unleashed political vendetta against us (the Congress leaders),” the former Chief Minister told PTI while reacting to the development. We don’t initiate any action by targeting anyone.” Khattar said the state’s advocate-general has favoured a probe by an independent agency and added the matter will be referred for a CBI probe.Outspoken Haryana Minister Anil Vij also said, “This matter will be probed by CBI. Large-scale irregularities have taken place in plot allotments, which were distributed to favourites by the previous regime.”Senior Congress leader Shakeel Ahmad hit out at the BJP government for targeting political opponents.

A magistrate’s court on Friday allowed former media baron Peter Mukerjea, arrested in connection with the Sheena Bora murder case, to get home food in Arthur Road prison in Mumbai where he has been lodged.”Permission is granted to provide home food to accused (Peter) in jail under proper supervision of jail superintendent,” Magistrate R V Adone said while allowing the plea moved by Peter earlier this week through his lawyer Kushal Mor.Peter had requested that he be allowed to get home food as he is a “senior citizen with heart ailments and is on medication to lower his cholesterol”. Apart from CBI, the jail officials had also opposed Peter’s plea saying they can provide less spicy and less oily food for Peter.<!– Dna_Article_Middle_300x250_BTF –>Peter (59), husband of prime accused Indrani Mukerjea, was arrested on November 19 for his alleged role in the murder conspiracy and has been in CBI custody. Peter has been kept at the high-security jail where Khanna and Rai are also lodged.In 2012, Sheena (24), Indrani’s daughter from previous relationship, was allegedly strangled in a car by Indrani and Khann, and her body was burnt and dumped in a forest in Raigad, about 84 kms from Mumbai. CBI has maintained that the murder could be the fallout of some financial transactions.The agency had said that Peter, during his interrogation, disclosed investment of crores of rupees made by him and Indrani abroad. The agency is expecting information from Interpol on the details of an account opened by Indrani in a bank in Hong Kong.

AAP launches direct attack of corruption against Arun Jaitley

A CBI raid against a serving IAS officer in the Delhi government snowballed into a major duel between Delhi chief minister Arvind Kejriwal and union finance minister Arun Jaitley on Thursday. BJP MP Kirti Azad, further queered the pitch by relentlessly reiterating corruption charges against Delhi and District Cricket Association (DDCA) during 13-year tenure of Jaitley as its president.Arun Jaitley, in a blog, promptly countered the charges politically and said Kejriwal seems to believe in “untruth and defamation delivered in language that borders on hysteria.”<!– Dna_Article_Middle_300x250_BTF –>His reaction came after the Aam Aadmi Party (AAP) gunned for Jaitley. Calling the irregularities a ‘Commonwealth Scam of Cricket’, AAP leaders alleged that crores of rupees were siphoned off through fake companies and there were huge irregularities in the team selection.AAP spokesperson Raghav Chadha said an additional expenditure of Rs 90 crore was incurred to renovate the Feroz Shah Kotla stadium. “Payments were made to five companies whose registered addresses were same and were headed by same director,” he said. Chadha demanded that the PM ask Jaitley to resign so that there is a fair investigation. “Most of the investigating agencies are under finance ministry,” he said.DDCA’s working president Chetan Chauhan, soon held a counter presser and said Jaitley had in fact worked for the betterment of cricket in general and had made the Feroz Shah Kotla stadium into a world class facility. Now, Congress seeks JPC probe into DDCA scam

Taking animosity to next level, thus making washout of winter session now a certainty, main Opposition Congress on Wednesday demanded constitution of a joint parliamentary committee (JPC) to look into irregularities in Delhi District Cricket Association (DDCA) and resignation of Union finance minister Arun Jaitley, who happens to be a former president of the cricket body. Jaitley, however, dismissed the allegations, saying they are without any basis.Delhi chief minister Arvind Kejriwal on Tuesday had attempted to link the CBI raid on his secretariat to the DDCA enquiry report and other related files. He had proposed to order a commission of inquiry into the report of the committee to go into the cricket affairs.<!– Dna_Article_Middle_300x250_BTF –>In a virtual tit-for-tat, Congress launched an attack on Jaitley and the affairs of the DDCA, claiming it was a Section 25 non-profit company, and could not divert its funds to non-cricketing activities, as alleged in the committee report. Jaitley had levelled almost similar allegations over the National Herald affairs, implicating Congress president Sonia Gandhi and vice-president Rahul Gandhi for diverting funds from a Section 25 company, without proper authorisation.Flanked by Leader of Opposition in the Rajya Sabha Ghulam Nabi Azad and party leader in Lok Sabha Mallikarjun Kharge, senior spokesman Ajay Maken said that pending the completion of inquiry through a JPC, Jaitley must step down. He also accused the Delhi chief minister of sitting on a three-member committee report for over a month now. The chief minister had on November 12 asked a three-member committee to go into the DDCA affairs within three days. He wanted to know why Kejriwal did not proceed to take action by registering a first information report or writing to the Delhi High Court for a court-monitored CBI inquiry.Maken said four persons in the DDCA, who have been “known for their proximity” to Jaitley, have been named as “officers in default” by the Registrar of Companies in his order of August last year. “How can a fair probe into the issue be possible as long as Jaitley is the finance minister with corporate affairs portfolio as well,” he wondered.Maken noted that virtually all enforcement authorities – ED, IT, Revenue intelligence, Serious Fraud Investigation Office – directly report to Jaitley. “The same agencies are supposed to take action against DDCA for infraction of various rules and norms of the Companies Act and under criminal law,” he said.Maken, who has earlier been sports minister at the Centre, said the Registrar of Companies has “proved” the charges of irregularities after he had complained to the then corporate affairs minister M Veerappa Moily, who had ordered the ROC inquiry. He said the investigation by the Serious Fraud Investigation Officer had found that the reconstruction of the Ferozshah Kotla stadium was carried out between 2002 and 2007 which saw an escalation of costs by Rs 90 crore. He said the initial budget was Rs 24 crore but eventually it went up to Rs 114 crore.Maken claimed that it was also revealed by SFIO probe that there was no record of tender for most of the contracts issued by the DDCA for the construction of the stadium. He said the report found that many companies that were given contracts were actually owned by the office bearers of the DDCA.

A day after the CBI raided the third floor of the Delhi secretariat housing the chief minister and his secretary’s office, the Delhi government claimed it has seized files containing “cabinet decisions” during its day-long raid. CBI sources said that two other accused in the case were questioned by agency sleuths. The accused included A K Duggal and GK Nanda – both former directors of Intelligent Communication Systems India Ltd. (ICSIL) After verbal assault launched by various Aam Aadmi Party leaders, including Delhi deputy CM Manish Sisodia, the probe agency seemed to be in an aggressive mode in the evening. After claiming that CBI was acting at the behest of the Centre, AAP accused the agency of seizing documents not related to the probe against Kumar. AAP leaders also claimed that the money in bank accounts that the CBI had searched was Kumar’s life savings from his 27 years of service. “Blatant incorrect information is being spread by certain quarts since yesterday to discredit the agency with the intent to obstruct investigation. CBI categorically denies having seized any material during searches which are not relevant to the investigation,” the agency said in a statement. The agency also took a dig at the Delhi government by bringing up another Principal Secretary who arrested by the agency on charges of accepting bribes earlier this month. Following the arrest of IAS officer SP Singh, AAP held a conference stating that the complainant who informed CBI about the corrupt practices of Singh, was an AAP volunteer.Kejriwal had claimed the complainant approached CBI on the directions of AAP government. The agency today responded that no functionary of Delhi government ever contacted or was ever in touch with CBI. “The entire operation of laying the trap and arrest of SP Singh was conducted by the CBI on its own after receipt of complaint followed by independent verification.”

A mobile shop owner had complained to the CBI that Income Tax Inspector Mukesh Kumar Meena was demanding Rs 1 lakh from him for settlement of a tax matter, CBI sources said.

An Income Tax inspector was on Wednesday caught red-handed by CBI while accepting a bribe of Rs 25,000 from a mobile shop owner in Jodhpur. The CBI sleuths arrested him from the shop and recovered the money from him.A mobile shop owner had complained to the CBI that Income Tax Inspector Mukesh Kumar Meena was demanding Rs 1 lakh from him for settlement of a tax matter, CBI sources said.”The deal was finally settled on Rs 50,000, which was agreed to be taken by Meena in two instalments of Rs 25,000 each”, said CBI spokesperson R K Gaur.<!– Dna_Article_Middle_300x250_BTF –>Meena had visited the shop to collect first instalments of this evening when the CBI sleuths caught him. Supreme Court pulls up CBI for delay in coal scam cases

Expressing unhappiness over the “prolonged delay” in the investigation of coal scam-related cases by the Central Bureau of Investigation (CBI), the Supreme Court on Monday said, “it could not be an unending affair.””Something has to be done. It can’t go on like this,” said a bench of Justice Madan B Lokur, Justice Kurian Joseph and Justice A K Sikri reminding the investigating agency that it was supposed to wrap up all the investigations by December 31, 2014 and that now 2015 is going to end.Noting that a “considerable time has already been taken”, the court granted the CBI time till March 31, 2016 and asked it to complete the investigation as early as possible.<!– Dna_Article_Middle_300x250_BTF –>The court observation came after the investigating agency sought its nod for relieving one of its senior officers, who is supervising investigations into coal scam-related cases, upon his “prestigious” appointment to the National Defence College.The court said that such movement of officers from the investigating agency delays the investigation after CBI’s counsel Amarendra Sharan tried to impress upon the court that movement of the senior ranking officer for another posting may not affect the pace of investigations.”It can’t go on like this. We are very clear about it. You have to be clear as well,” the court the CBI.Sharan said the investigation was not into the old cases but in the 15 new cases that were taken up later, adding the probe into these case was “very fast”.Meanwhile, the bench was also unhappy with the Directorate of Enforcement’s provisional orders for the attachments of properties worth Rs186 crore, Rs 24.5 crore and Rs 2 crore but no complaint has been filed so far in two cases wherein the investigating agency in its progress report till September 11 had said that it would be filing “complaint shortly”.In the third case also it failed to file the complaint.Sharan told the court that in the first two cases, the complaints was with the special public prosecutor R S Cheema who is heading the prosecution of the coal scam cases by the CBI. He also sought time till end of this month to file a fresh status report.

VVIP chopper deal: Interpol notices issued against 2 Italians

An RCN, according to Interpol, is issued “to seek the location and arrest of wanted persons with a view to extradition or similar lawful action” in a criminal case probe.

Interpol has issued Red Corner Notices (RCNs) against two Italian nationals, alleged to be the middlemen in the Rs 3,600-crore VVIP chopper deal from AgustaWestland, on charges of money laundering pressed by the ED. Officials said the global warrant for arrest has been issued against Carlo Gerosa and Guido Ralph Haschke after a special court here had issued non-bailable warrants (NBWs) against them on the plea of the Enforcement Directorate some time back. An RCN, according to Interpol, is issued “to seek the location and arrest of wanted persons with a view to extradition or similar lawful action” in a criminal case probe.<!– Dna_Article_Middle_300x250_BTF –> The latest notice against the duo states the foreign nationals are “wanted by the judicial authorities of India for prosecution/to serve a sentence” under various sections of the Prevention of Money Laundering Act (PMLA). Another accused of the ED in the same case, British national Christian Michel James, has already been notified for arrest by the Interpol earlier this month on the request of the CBI which is also parallely probing the case. Sources privy to the case said while ED had also obtained an NBW and requested for an RCN against James, the Interpol warrant issued on the behest of the CBI “may well serve their purpose as well.” “Charges under PMLA may be inserted in the already published Interpol notice against Michel. With these two RCNs coming, the agencies have obtained global warrants against whom they wanted in their respective probes till now,” they said. While making a plea for the world-wide warrant, the ED had told the court that the Italians were required to be interrogated on many aspects of the case after its probe established their role in the case. ED had earlier claimed in the court that AgustaWestland had allegedly paid a “kickback” of around 70 million Euros, out of which around 30 million Euros was paid to James and his firm Global Services FZE, Dubai, while Gerosa and Haschke had cornered the rest. ED, in July 2014, had lodged a separate case under PMLA against several persons after taking cognisance of a CBI FIR registered earlier. Late last year, the central probe agency filed a chargesheet in the case against businessman Gautam Khaitan and others, including Gerosa and Haschke for alleged offences committed under various PMLA sections.CBI had named a number of persons in its FIR in the case including former Indian Air Force chief S P Tyagi. Tyagi, and others, including Gerosa, James and Haschke are among the 13 individuals named as accused in CBI’s FIR.CBI has alleged that during his tenure as IAF Chief, Tyagi and “with his approval”, the Air Force had “conceded to reduce the service ceiling for VVIP helicopters from 6000 metres to 4500 metres as mandatory” to which it was earlier opposed on the grounds of security constraints and other related reasons.It had alleged reduction of service ceiling — maximum height at which a helicopter can perform normally — allowed UK-based AgustaWestland to get into the fray as, otherwise, its choppers were not qualified for submission of bids.CBI had also alleged AgustaWestland managed to introduce a comparative flight trial with non-functional engine and eventually succeeded in getting the contract for supply of 12 AW-101 VVIP helicopters from the Defence Ministry mainly due to softening of IAF on service ceiling, after Tyagi took over as its chief.

A Mumbai Magistrate court on Monday extended the judicial custody of former media baron Peter Mukerjea till December 28 in the Sheena Bora murder case, even as he moved an application seeking homemade food in jail on account of his ailments.”The judicial custody is extended till December 28,” ordered magistrate RV Adone after Peter’s 14-day custody granted on December 1, expired on Monday.Meanwhile, the application moved by Mukerjea’s lawyer Kushal Mor, sought home food for Peter in jail as he is a senior citizen, having heart ailments and has been taking medicine to lower his cholesterol. “In CBI custody it was being ensured that he gets proper healthy diet, now that he is in jail we need to ensure that he gets proper diet according to his medical needs,” Mor told the court. He was later taken to Delhi by CBI for conducting a polygraph test on him and brought back to Mumbai by month-end.Sheena (24) was allegedly strangled in a car and then her body burnt and dumped in a forest in Raigad, about 84 kms from Mumbai. Indrani (43), her former husband Sanjeev Khanna and her ex-driver Shyamvar Rai have been charge sheeted in the case. The victim was Indrani’s daughter from an earlier relationship.CBI, while maintaining that financial transaction was the motive behind the murder of Sheena, had earlier said that Peter, during his interrogation, disclosed investments of crores of rupees made by him and Indrani and is expecting information from Interpol on the details of an account opened by Indrani in a bank in Hong Kong.

Parliamentary panel slams judicial activism, Supreme Court monitoring of probes

Anil Sinha, who took over as CBI chief December last year, tried to distance himself from the scathing criticism the agency faced from the Supreme Court during the tenure of his predecessor, saying “that was then, not now”.

CBI Director Anil Sinha on Friday sought to dismiss claims that the agency was acting as a “political tool” and asserted that during his tenure no political leader had called him seeking any favour. The CBI Director also sounded optimistic as he claimed that efforts were on to bring back Dawood Ibrahim and all the agencies of the government are working towards it.”I cannot give any time-frame (on bringing back Dawood) but no one should have any doubt… In this case (on Chhota Rajan), we got cooperation from many international agencies. The problems of the senior bureaucrat, who was nearing retirement, seem to have multiplied overnight.According to the Central Bureau of Investigation Singh, besides being the owner and co-owner of at least eight properties in Delhi-NCR area, had quite a taste of expensive items, which have now been allegedly recovered by CBI sleuths.<!– Dna_Article_Middle_300x250_BTF –>Expensive watches, more than 300 bottles of foreign liquor (including expensive scotch) and jewelry, whose net worth is yet to be calculated are some of the items recovered by the CBI. All the items have now have been confiscated by the agency after sleuths conducted multiple raids at atleast eight flats owned by the senior bureaucrat and his wife.The flats that CBI raided, also have come under scanner of investigators who have calculated the net worth of the properties somewhere between 15-20 crores rupees. Among the flats, three are located in Noida, two in Greater Noida, two in Gurgaon and one in posh Safdar Jung enclave area of south Delhi. The flats in NCR are also located in some of the most expensive sectors and most of them are currently occupied by tenants.”Pearl Gateway, Amrapali, Unitech High and Unitech Habitat are among the gated societies and towers where the CBI on Wednesday conducted raids. All of the flats are located in some of the most expensive sectors of NCR.For instance Sector 44,15, 50 of Noida and Greater Noida and Sector 56 in Gurgaon. We will investigate if the said properties qualify for a disproportionate assets case against the accused,”said an official source.Singh, (an IAS officer of 1984 Batch of AGMUT cadre), was appointed as the head of department of welfare of scheduled castes, scheduled tribes and minorities in August 2014, when the national capital was being governed by L-G Najeeb Jung. A Sikh youth was put under preventive detention for allegedly trying to attack senior Congress leader and 1984-riots accused Jagdish Tytler and hurling abuses at him at a marriage function in South Delhi’s Chattarpur area.According to police, 23-year-old Sehaj Umang Bhatia allegedly threw a piece of glass at Tytler, who escaped unhurt, and abused him during the function at a farmhouse in Mehrauli on Saturday night.”Tytler was there to attend a wedding last night at 11:15 pm when Bhatia threw a piece of glass at him and abused him.
