A local court has disallowed a police plea to conduct a lie detector test on a juvenile who has been made a key witness in the case of death of priest Fr Bismarck Dias under mysterious circumstances. The Goa Crime branch is probing the death of Dias, whose body was found in a river at his village St Estevam near Panaji on November 7. Dias, who was part of almost all environment protection movements in the coastal state, was last seen with the minor. The Juvenile Court rejected the application of the Crime Branch to subject the minor witness to a lie detection test even as his parents had given their consent for the same.However, the victim assistance unit of the court had objected to it. <!– Dna_Article_Middle_300x250_BTF –>Meanwhile, the Judicial Magistrate First Class (JMFC), Panjim has already allowed a lie-detector test on another prime witness in the case. The parliamentary affairs ministry has rejected most of the recommendations of a panel of MPs, ranging from canteen facilities on the lines of defence personnel to a fourth of travel fare as incidentals.Not just this. Even former MPs would be entitled to diplomatic passport, have access to VIP lounges in airports and be exempted from toll tax, if the Joint Committee on Salaries and Allowances of Parliamentarians had its way.The parliamentary affairs ministry has struck down nearly 75 per cent of the 65 proposals made by a committee headed by BJP’s five-time MP from Gorakhpur Yogi Adityanath, according to sources.<!– Dna_Article_Middle_300x250_BTF –>The Committee wanted the word ‘spouse’ to be replaced with ‘companion’ to accompany MPs in AC First Class train travel citing the reason that they could need assistance. The ministry was of the opinion that while single MPs could be given the option of taking a “companion”, the facility can be extended only to spouse in the case of married parliamentarians. As of now, a companion gets a second AC seat. If single, a member can declare a companion and travel together.The Committee also suggested increase in number of free air tickets between sessions for MPs from 34 to 43 and travel allowance during sessions, which have also been turned down. Besides it sought CGHS facilities for even their grand children, on which the ministry was of the view that the benefit should be confined to spouse and children.On the recommendation for ex-MPs to have access to guest houses and VIP lounges, the ministry saw no reason why they needed this after completion of tenure. Several of the demands were seen as unreasonable by the ministry while some did not fall in its jurisdiction, they said.The ministry also was of the view that status quo should be maintained on the existing Rs16 per kilo metre granted to members, rejecting the proposal to enhance it.It also struck down the demands for personal assistants of MPs to be given access to VIP lounges and providing a local phone when members traveled abroad on official work, the sources said. On the proposal to increase the car loan amount from existing Rs four lakh, the ministry was of the view that it should be availed from the market.The demands on which the ministry said “ayes” included enhancement of constituency allowance and salary to PAs from Rs 45,000 to Rs 75,000, raising pension from present Rs 20,000 and doubling monetary ceiling on furniture from Rs 75,000.On the question of increasing daily allowances from Rs 2,000 to Rs 5,000, the ministry said it should be performance linked.The panel sought increase in quota in Kendriya Vidyalayas from ten to 15 a year, a proposal which was left to the HRD ministry. The ministry said the recommendations on housing society for MPs, exempting former parliamentarians from toll tax, car facilities to committee chairpersons in inter-sessions and their security, guest houses for MPs in every state capital and giving access to personal assistants to VIP lounges were not in its jurisdiction and referred these to various ministries. Free air ticketsThe Committee also suggested increase in number of free air tickets between sessions for MPs from 34 to 43 and travel allowance during sessions, which have also been turned down. Besides it sought CGHS facilities for even their grand children, on which the ministry was of the view that the benefit should be confined to spouse and children. While MPs are given lifetime rail travel card, the panel sought ten free air tickets per year for former MPs. “Let’s not talk about caste— I have nothing to do with it,” says Nagraj Manjule, the name which has become synonymous with award-winning film Fandry. A poet, director and also an actor, Manjule said that Fandry—meaning pig in the nomadic Kaibadi language—was always his first choice and a conscious decision for the title. Manjule won the Best Director award for the film at the first edition of Ajeenkya DY Patil University Filmfare Awards 2014 (Marathi) held on November 20, 2015, at Thane.Born in a small village in Solapur district of Maharashtra, Manjule says that he experienced caste discrimination right from childhood. “It was always there. It is omnipresent. I have experienced it all my life,” he says.<!– Dna_Article_Middle_300x250_BTF –>After his first short film Pistulya won a national award a few years ago, Manjule wanted to do some more work on caste-based discrimination. “I was never very serious about studies. I was always an average student, having fun with friends. It was only after I failed my Class X exams that I began reading. So the only pastime was reading,” he explains as he draws parallels between his school life and that of the lead character in Fandry. He went on to complete Masters in Marathi Literature from Pune University.Manjule doesn’t agree that caste system is prevalent only in the villages of India. “It is very much present in the cities too. Only the format is different in the cities,” he says. He, however, is quick to tell us that he doesn’t like the ‘Dalit’ tag that goes with literature produced by the Dalit authors. “Why do you need it? Humanity is the largest truth of life. But yes, it is coming.”When asked about casting non-actors in Fandry, he says that it wasn’t at all difficult to make them act. “It is a director’s job and that is what I did. They are rather more realistic than the professional actors,” he explains.When asked about his upcoming movie Sairat, he only says that it is a love story and that he wouldn’t want to give away further details right now.Given his interest in the subject of caste and his recent success, Manjule has become a role model. He, however, immediately rejects the label, saying, “I don’t think this helps. No one can learn anything from reading my message. Everyone has independent ideas. I don’t believe in these things about giving anyone any message.”

Facebook’s CEO and wife to give 99 percent of shares to couple’s foundation | Reuters

SAN FRANCISCO Mark Zuckerberg will put 99 percent of his Facebook Inc (FB.O) shares, currently worth about $45 billion, into a new philanthropy project focussing on human potential and equality, he and his wife said Tuesday in a letter to their newborn daughter.

The plan, which was posted on the Facebook founder and chief executive officer’s page and has attracted more than 360,000 ‘likes’, follows other high-profile billionaires such as Warren Buffett and Bill and Melinda Gates, who have set up foundations to dedicate their massive fortunes to philanthropic endeavours.

Zuckerberg, 31, who will control the new initiative and remain in charge of the world’s largest online social network, said he would sell or give up to $1 billion in shares in each of the next three years.

He will keep a controlling stake in Facebook, valued at $303 billion as of Tuesday’s close, for what the company called the “foreseeable future.” According to Facebook’s most recent proxy statement, Zuckerberg owned 4 million Class A shares and 422.3 million Class B shares, which have 10 times the voting power of A shares. Combined he held 54 percent of the voting power of the company’s shares.

Zuckerberg said he plans to remain CEO of Facebook for “many, many years to come.”

The move is not Zuckerberg’s first in the world of philanthropy. When he was 26, he signed the Giving Pledge, which invites the world’s wealthiest individuals and families to commit to giving more than half of their wealth to philanthropy or charitable causes over their lifetime or in their will.

“Mark and Priscilla are breaking the mould with this breathtaking commitment,” billionaire investor Buffett said on Facebook. “A combination of brains, passion and resources on this scale will change the lives of millions. On behalf of future generations, I thank them.”

Buffett himself pledged Berkshire Hathaway Inc (BRKa.N) stock worth $31 billion at the time to Gates’ foundation in 2006, which was the largest single gift at the time.

Zuckerberg is relatively young to commit so much of his wealth. Microsoft Corp (MSFT.O) co-founder Gates was 45 in 2000, the year he and his wife founded the Bill and Melinda Gates Foundation. Buffett was 76 in 2006, the year he committed to give away all of his Berkshire Hathaway stock to philanthropic organizations.

About $350 billion is given away each year in the United States by charities, said Stacy Palmer, editor of the Chronicle of Philanthropy. She said Zuckerberg and his wife Priscilla Chan’s announcement was remarkable not just because of the size of the donation, but because of their ages.

“Our lists of the top donors are usually dominated by people in their 70s or 80s,” she said. “This is a message to other young people who are deciding what to do with their great wealth.”

In welcoming the birth of his first child on his Facebook page, Zuckerberg posted a photo of himself, his wife and their new daughter, Maxima, nicknamed Max, along with a post entitled “A letter to our daughter.”

In the 2,220-word letter, Zuckerberg and Chan touched on issues including health, education, Internet access and learning before announcing the Chan Zuckerberg Initiative, which aims to “advance human potential and promote equality.”

They plan to give away 99 percent of their Facebook shares over their lifetimes to advance the initiative, which was formed as a limited liability company controlled by the two. It will begin by focussing on curing disease, Internet connectivity, community building and personalized learning – or the idea that technology can help students learn at different paces.

Maxima Chan Zuckerberg was born early last week — though Facebook did not specify her birth date — and weighed 7 lbs 8 ounces (3.4 kg) at birth. Last month, Zuckerberg announced he would take two months of paternity leave after the birth.

Chan and Zuckerberg have so far committed $1.6 billion to their philanthropy. They have given several donations this year, including to public schools, initiatives to bring better wireless Internet access and to San Francisco General Hospital, where Chan works as a paediatrician.

Zuckerberg and Chan said they will share more details when they return from their maternity and paternity leaves.

Zuckerberg has started his leave, a company representative said, and will be available if “absolutely needed.” Sheryl Sandberg, chief operating officer, and Mike Schroepfer, chief technology officer, will run the company in Zuckerberg’s absence.

Kerala police on Satturday arrested one Shahnaz, a suspected aide of Bangalore blast case accused T Nazeer, for allegedly exchanging letters with the militant while he was brought in a local court near here in connection with a robbery case. Police said at least eight-odd letters have been seized from Shahnaz–most of them allegedly written by Nazeer, an alleged LeT militant. Content of some of the letters written by Nazeer allegedly deals with cases related to Bangalore blast, police said. Tamil Nadu: Teen stops her marriage by walking into police station

On Thursday, the girl Lakshmi reportedly walked into the Vepanapalli police checkpost near her village and told the police about her upcoming marriage and the fact that she was underage. The wedding which was supposed to be conducted on Friday, was then stopped.According to a report in The Hindu, the Vepanapalli police took a written statement from her parents that they would not conduct the marriage. The girl’s mother has stated that she earned only Rs 150 a day and getting Lakshmi married off would mean fewer mouths to feed at home. Lakshmi had dropped out of school after Class 6 and was working in a Coimbatore mill under the Sumangali Scheme for the last four years. Tamil Nadu: Class 6 girl raped by school owner’s son in Salem

In Salem, a girl studying in sixth standard was allegedly raped by the school owner’s son. A report in The New Indian Express states that the 11 year-old girl had gone to the school owner’s son home to play with his daughter aged three. The girl was studying in Class 6 at a school in Vasanthapuram near Hasthampatti . On Wednesday, she had gone to David Livingston’s house, the son of Jayaraj Christ who owns the school. The 11-year-old was staying in the hostel and she used to go their house on the weekends to play with his three-year-old. According to reports, Maharashtra State Board of Secondary and Higher Secondary Education’s new paper pattern design for students will include a component where there will be one question related to composing text messages for mobile phones.The change was announced by the state board’s monthly magazine in its latest edition on September 17. Although the details of the new design has not been set out clearly yet but most teachers have welcomed the inclusion of the component. The crisis of unemployment has compelled even PhD holders and B Tech qualified candidates to apply for the post of peons advertised recently by the Uttar Pradesh government.Officials overseeing the recruitment exercise are stunned and virtually non-plussed with the kind of response that has inundated them after the advertisement for the post of peons in the state secretariat. For the 368 posts of ‘chaprasi’, the number of applications received has crossed a whopping 17.50 lakh, and the flow doesn’t seem to ebb till the last date.<!– Dna_Article_Middle_300x250_BTF –>”Our staff is desperately looking forward to Friday evening which is the deadline for receiving the applications. By then, we expect this number to touch the two million mark,” a senior official at the government secretariat told dna.The numbers themselves speak of the magnitude of the unemployment problem. As many as 201 of the applicants are PhD holders, 20,056 have completed their masters (MSc., MCom or MA). Besides, 1.23 lakh-plus candidates are either BTech, BEd, BSc, BCom or BA pass. The number of those who have done their intermediate (Class XII) is close to six lakh.The maximum number of applications for the post of peon have understandably come from those who have passed their high school (Class X) which was prescribed as the minimum qualification for this apparently much-coveted post. This figure is about 8.20 lakh.”We never expected such a deluge of applications running in lakhs for just 368 ‘chaprasi’ posts,” says an official of the Secretariat Administration Department (SAD) which is the nodal department for the recruitment of secretariat staff.The situation is such that the rooms of many SAD officials are overflowing with the applications, to the extent that some officials have had to leave their offices and are temporarily functioning from rooms they are sharing with other similarly harried officials.”We had planned to finish off the recruitment process in a month or two. But, considering the huge number of applications, sorting them out itself could take two to three months,” said a visibly stressed SAD official. President of Maharashtra OBC organisation Professor Shravan Deore recently met BJP MP Subhash Bhamre, who is the member of OBC MP Forum in this regard and urged him to raise the issue in the Parliament.Deore said the Maratha community in Maharashtra, Jats from Uttar Pradesh and Haryana and Patel community from Gujarat are demanding to be included in the OBC category, when they already belong to the upper class.”These communities are upper class landlords and rulers as they have been in power since last several years. Doctors on Friday successfully terminated a 25-week pregnancy of a minor rape victim after Supreme Court intervened in the girl’s favour, in what might be a first of its kind case in the Indian medico-legal history.”A team of five doctors successfully terminated the 25-week pregnancy of the minor rape victim late tonight, who was admitted here yesterday,” Dr M M Prabhakar, Medical Superintendent of Civil hospital, where the girl is kept, told PTI on Friday. “The girl’s health is normal after the foetus was terminated,” Prabhakar added.<!– Dna_Article_Middle_300x250_BTF –>One of the family friends of the victim said the foetus termination would now give a new life to the 14-year-old girl, who studies in Class X. The process of medical termination of pregnancy started this morning and doctors expected that it would take 24 to 36 hours. The girl became pregnant after being allegedly raped by a doctor Jatin Mehta whom she had visited for treatment of typhoid earlier this year.The girl and her family had to pass through a long drawn legal process for getting the order of termination of pregnancy in their favour as earlier Himmatnagar Sessions Court and later the Gujarat High Court had denied permission to abort the foetus as it was older than 20 weeks.

Stabbed 35 times, teenage girl brutally killed in Delhi for resisting molestation

A 19-year-old girl was allegedly stabbed to death by two youth in New Delhi in the Anand Parbat area, police said on Friday.

The Class 11 student, was allegedly stabbed by Jaiprakash and his brother on Thursday, when she went to a market, a police officer told IANS.

The girl was allegedly stabbed 35 times by the attackers, according to IBNLive. “That girl ran from them and landed in my gallery. They entered and stabbed her here too. She was unconscious by then. They used to irritate her a lot,” IBNLive quoted a witness as saying.

“The neighbours there did not help her. She could’ve been saved if they helped her. She entered a neighbour’s house as she was getting beaten. The neighbours whose house she entered, threw her out of their house, saying that they did not want to get involved in the matter. That is why they (the accused) got to assault her and they ran away after that,” the report quoted the victim’s sister as saying.

The girl’s mother was also injured while trying to save her, the police said. Both were taken to the Ram Manohar Lohia Hospital, where the girl died from her injuries.

Police said that both the attackers have been arrested, charged with murder. Investigation is now underway.

The report added that the victim was being eve-teased by the attackers. In 2013, the girl had filed a molestation complaint against the attackers.

NDTV reported that the teenage girl’s family alleged that she was killed by Jaiprakash, his brother and their mother because she had registered the complaint against the brothers.

Not correct to expect govt to keep post of one’s choice vacant: Madras High Court

Disposing of the petition by one S Amuthavalli who sought appointment on compassionate grounds for her son after the death of her husband in 2005, Justice S Vaidhyanathan noted that she had been offered the post of sweeper in 2007. Without joining the post and making representations and levelling charges against the officials was not correct, he added.

The Madras High Court bench on Monday observed that it was not correct for a petitioner to expect government to keep one post of her choice ready to provide employment to her or her son after obtaining the qualification on compassionate grounds.Disposing of the petition by one S Amuthavalli who sought appointment on compassionate grounds for her son after the death of her husband in 2005, Justice S Vaidhyanathan noted that she had been offered the post of sweeper in 2007. The petitioner’s case had been considered and she was given a post of sweeper in 2007.”If the petitioner felt it was below her dignity to join the post, she cannot expect the government to keep a post of her choice ready to provide employment to her or her son (who got qualified for Junior Assistant’s post), the judge said.The officials had considered her case and the government had no objection for the respondents to appoint her, he said.The Judge said it was open to the petitioner to indicate her willingness to join the post in 30 days, failing which the the government offer would stand automatically cancelled. He also made it clear that if the post was not available now, the petitioner could be accomodated in some other post in Class III or IV and thereafter posted in sweeper post.The petitioner contended that there were vacancies in the town panchayat for the post of Junior Assistant and her son got qualified now and the post be given to him. But the judge felt that as she had already applied for herself, she was only entitled to the Class III or Class IV.The woman’s husband worked in Oddanchattiram municipality as a sweeper. She applied for a post on compassionate grounds but did not join when offered it. Then she sought appointment for her son as Junior Assistant. Hence she filed this petition.

Eating out, holidays, call rates to cost more from tomorrow as service tax goes up to 14%

NEW DELHI: People will have to shell out more from tomorrow while using mobiles, eating out and travelling as the service tax rate goes up to 14 per cent.

Finance Minister Arun Jaitley in his Budget had proposed to raise service tax from 12.36 per cent (including education cess) to 14 per cent. The proposal takes effect from June 1.

The tax is levied on all services, expect a small negative list.

Some of the key services that will attract higher tax and hence become costlier are: railways, airlines, banking, insurance, advertising, architecture, construction, credit cards, event management and tour operators.

Mobile operators and credit card companies have already started sending messages to subscribers conveying the increase in service tax rate which will have a bearing on the bills.

According to railway ministry officials, fares for First Class and AC classes in passenger trains, besides freight charges, will go up by 0.5 per cent from June 1.

“Currently, 3.7 per cent service tax is levied on train fares for AC Class, First Class and freight. This will go up to 4.2 per cent from June which means the rise is only 0.5 per cent,” the official said. Currently, there is abatement of 70 per cent on passenger services.

Jaitley had proposed to raise the service tax rate to 14 per cent to facilitate a smooth transition to the Goods and Services Tax (GST) regime, which the government wants to roll out from April 2016.

Once implemented, GST will subsume service tax, excise and other local levies.

“To facilitate a smooth transition to levy of tax on services by both the Centre and the States, it is proposed to increase the present rate of service tax plus education cesses from 12.36 per cent to a consolidated rate of 14 per cent,” Jaitley had said in Budget speech.

Education cess, which is levied on service tax, will be subsumed in the service tax rate with effect from June 1.

Although the Budget also proposed a 2 per cent Swachh Bharat cess on selected services, the government is yet to come out with a notification in this regard.

CBSE Class 10 results out: Girls outperform boys, heavy traffic downs board website

New Delhi: The Central Board of Secondary Education (CBSE) announced the results of Class 10 board examinations in New Delhi on Thursday with Girls performing better than boys in the exam, official said.

The percentage of girls who qualified for higher class is 97.82, while for boys it was 96.98.

There was a drop in the overall pass percentage this year, which was 97.32 as compared to the 98.87 in the 2014.

The overall percentage of candidates qualified for admission in higher class in Thiruvananthapuram region is 99.77, which is the highest among all regions.

Schools can access the results on internet by giving their school code and e-mail-ID after registering themselves on www.results.nic.in, www.cbseresults.nic.in and www.cbse.nic.in

“The results of Class 10 for all the regions have now been announced,” the CBSE official said.

The official, however, admitted that the board website was down because of heavy traffic.

“I have been trying for 15 minutes to check my result but the website is not responding. The server is down,” a student complained.

According to a CBSE statement, a total of 13,73,853 students were enrolled for the Class 10 board examination, an increase of 3.37 percent over 2014 figure.

A 17-year-old girl allegedly committed suicide in adjoining Dewas district on Monday after failing to clear her Class XII examination, police said.Shivika Nimbalkar, who studied in a private school, poured kerosene and set herself ablaze. She was depressed after not being able to clear her class XII exams, the results of which were announced on Sunday, Dewas Kotwali Police Station Inspector Vijay Choudhary said. India Navy set to launch newest destroyer called Visakhapatnam

New Delhi: Indian Navy’s new destroyer, Visakhapatnam, with enhanced capability to operate in nuclear, biological and chemical atmosphere, will be launched in Mumbai on Sunday.

The ship is the first of the four follow-up order of the Kolkata Class warships and will give a major boost to India’s maritime capabilities when it is inducted. The total cost of the project is little over Rs 29,600 Crores.

“Kolkata Class did not have a full-fledged Total Atmosphere Control System (TAC). The TAC system provides you with the capability of operating in a fall-out region, be it a nuclear, chemical or biological almost endlessly, because the complete air being taken inside is through nuclear, biological and chemical filters except in the machinery compartment,” Rear Admiral A K Saxena, Director General (Naval Design) told reporters.

Those entering the machinery compartment in a fall-out region will have to wear specialised masks to protect themselves. The ship, named Visakhapatnam (Project 15 B), a stealth destroyer, is 65 percent indigenous and has a number of weapon systems which have been made at home.

At 7,300 tonnes, Visakhapatnam will be the largest destroyer commissioned by the Indian Navy and will be equipped with the Israeli Multi Function Surveillance Threat Alert Radar (MF-STAR).

This will provide targeting information to 32 Barak 8 long-range surface to air missiles onboard the warship, that is being co-developed by India with Israel. The Barak 8 missile is being integrated in to the Navy’s new destroyer, INS Kolkata and will be test-fired by October, Navy officials said.

The ship will also be carrying 8 BrahMos missiles. Project 15 and Project 15-B will share the same hull-design and Ukrainian-built Zorya gas turbines. Navy officials said the Visakhapatnam is likely to be inducted in the Indian Navy by 2018.

Academic session on but no text books for students in Odisha’s Ganjam district

Berhampur (Odisha): The academic session has begun but most students of schools in Odisha’s Ganjam district are yet to have their text books.

The textbooks, which are to be supplied to students of government schools up to Class VIII free of cost, are in short supply to the district. Only about 45 per cent of the students have received the text books.

About 5.23 lakh students are reading in the district in 4,061 primary and upper primary schools in the district.

About 23.56 lakh textbooks were required for students of different classes, but only about 45 percent of these have been supplied.

As against the requirement of 3.74 lakh textbooks for Class VIII, barely 50 per cent of the requirement has been met. Similarly, about 1.5 lakh books of Class V have reached the district as against the total requirement of 2.91 lakh.

“We have already placed the requirement of textbooks and hope that these will be supplied before the summer vacation begins,” said District Project Coordinator of Sarva Sikshya Abhiyana (SSA), Sudam Mandal.

The textbooks are directly supplied to block offices and are distributed to schools through the block education officers (BEOs).

However, sources claimed that despite the lack of supply of textbooks, classes were not affected. “Most of the students are managing their studies through the old books,” said Gopal Mishra, a teacher here.

Similarly, CBSE students in the town are also grappling with the shortage of NCERT books. The students are facing the problem to procure NCERT books in the town, as there is not distributor to give away the NCERT books.

Over 5,000 students study in the five Kendriya Vidyalayas in the district. The KVs are functioning at Ambapua, Aska, Bhanjanagar, Digapahandi and Gopalpur, sources said.

Bihar cheating scam: Family members climb buildings, pass chits to students taking exams

A large-scale examination cheating scam was exposed in Khagriya and Hajipur in Bihar on Thursday when friends and family of Class 10 students taking the Bihar board exams were caught climbing school building walls to pass chits to students inside.

The shocking fact is that this incident is taking place on a large-scale and open manner despite inspection authorities and police personnel posted outside the exam venues, reported NDTV. In fact, some of the police personnel were reportedly aiding people involved in ‘helping’ the students. “Some observers also alleged that the police are accepting bribes from people wanting to get into the examination halls,” said the report.

The students were also reportedly being helped by invigilators and school staff, according to CNN-IBN. Some of the students were even openly referring to textbooks inside the examination hall.

Despite this incident being caught on camera, local officials claimed that the exams were held as usual and no such cases of cheating were reported.

CNN-IBN also reported when Nitish Kumar came to power in Bihar in 2005, a crackdown on this malpractice was undertaken by the government. But after two or three years, the government, realising that the crackdown resulted in great public anger, stopped it.

Bihar Education Minister PK Shahi went as far as to say that the government was “helpless” with respect to this cheating scam. “The government is helpless to stop the dishonest practices unless parents and students cooperate for the same,” The Times of India quoted Shahi as saying. “Over 14 lakh students are taking the examination. You tell us what can the government do to stop cheating if parents and relatives are not ready to cooperate? Should the government give orders to shoot them?”

Supreme Court upholds quota for bank workers during promotions

In a significant judgment, the supreme court has ruled that SC and ST employees in public sector banks are entitled to reservation in the promotion of officer grade and directed banks to provide quota for these employees in the Promotion from Management Grade Scale-I (Scale-I) upto Scale VI officers. What happens if there aren’t SC/ST applicants?While disposing of a batch of petitions on the issue, the court, however, clarified that promotion in the officers cadre cannot be given on the ground of non-adequate representation of SC/ST employees. What dis Central Bank want?The court rejected the Central Bank of India ‘s argument that there is no rule of reservation for promotion in the Class A (Class-I) to the posts having basic salary of more than Rs 5,700 and their promotion should be based on the standard of performance.According the bank, the rule of reservation is followed for promotions from clerical grade to the lowest rank in the officer Grade (scale-I) but for above scale only a concession for promotion is provided for officers belonging to SC/ST category,but there is no mandatory provision of reservation. What prompted SC ruling?A bench of justices Chelamenswar and AK Sikri has allowed the pleas of SC and ST bank employees while relying on an office memorandum of the Department of Public Enterprises issued on November 8, 2004 under which, the salary limit has been revised from Rs 5,700 to Rs 18,300 as per the 5th Central Pay Commission and in the case of Public Sector Undertakings like banks the limit is fixed at Rs 20,800.”…..The said pay ceiling is achieved in the appellant Banks only when an officer reaches Scale-VII. As a result, the policy of no reservation in the matter of promotion is applicable only from Scale-VII and above. It, therefore, clearly follows that insofar as promotion from Scale-I to Scale-II, Scale-II to Scale-III, Scale-III to Scale-IV, Scale-IV to Scale-V, Scale-V to Scale-VI are concerned, reservation is to be provided. The appellant Banks, therefore, cannot take umbrage under the Memorandum (1997) and deny reservation in favour of SC/ST employees while carrying out promotions upto to Scale-VI,” the bench said. What worries banks?The bench rejected the bank’s contention that grant of reservation in promotion from Scale-I level onwards would affect efficiency and the officers belonging to SC/ST have been promoted only on the basis of their own merit/performance.
