Allahabad High Court sets a precedent by announcing generous award for a rape survivor and her child

The fate of the minor rape victim, who delivered a baby girl on October 26, hung in balance as the court along with a panel of senior lawyers mulled how to ensure a secure future for the girl and her child.

It also directed the government to pay a compensation of Rs10 lakh to the 13-year-old mother besides the Rs3 lakh the government had already announced. The amount would be in the form of a fixed deposit in her name, which she would be able to use on attaining the age of 21 years.<!– Dna_Article_Middle_300x250_BTF –> The court has also asked the state government to finance her studies and give her a job when she is 18 years of age. By the time the family came to know of the pregnancy, it was too late to abort the foetus. The girl, who had told the court earlier that she would give up the child for adoption as she did not want to live with the ‘stigma’ all her life, had second thoughts. The father, too, who was of the firm view that the baby girl should be given in adoption, finally gave in due to his daughter’s ’emotional attachment’ to the infant.

Women empowerment themed Durga Pujas

one of the oldest community durga pujas in Gurgaon, has decided upon the theme, ‘India Let Her Live- Save the Girl Child’.

Durga Puja

The existing paradox of Goddesses being worshiped and women being discriminated against in the same land will come alive this year in Durga Pujas across the national capital region with pandals sporting themes, which endorse women empowerment. Maruti Vihar Sarbojanin Durgotsav (MVSD), one of the oldest community Durga pujas in Gurgaon, has decided upon the theme, “India Let Her Live- Save the Girl Child,” drawing inspiration from the Prime Minister’s “Beti Bachao, Beti Padhao” programme. “The theme was chosen to highlight the plight of the girl child, particularly in Haryana where female foeticide is still rampant. The lowest among all Indian states, Haryana’s sex ratio shows that the mindset of the society has not changed despite the country’s progress in different domains,” says Anit Kumar Ghosh, President, MVSD.<!– Dna_Article_Middle_300x250_BTF –> Seeking to project the anticipated evolution of society from such social evils to a state of enlightenment, the initial stretch of the venue is adorned with dark art works representing female foeticide and gradually transforms into a brighter, positive ambiance finally culminating at the idol of Goddess Durga, the greatest example of an empowered woman. “We believe that in order to bring about a change, government alone is not enough. Citizens should also play their part in the society. It is with this spirit that MVSD has chosen this theme,” he says. The designs for both the concept and the idols have been conceptualised by the internationally acclaimed sculptor Biswajit Majumdar, best known for his iconic teracotta gate at the Surajkund Mela, which is held annually in Faridabad. “While the framework and the bodies of the idols are being made at Chittaranjan Park in Delhi by local artisans under the supervision of Majumdaer and his team, the faces, costumes and jewellery have been procured from the sculptor’s studio in Krishna Nagore in West Bengal,” says Ghosh. The committee which will be celebrating its silver jubilee this year, will host a youth festival on the same theme, with activities like debates and cultural competitions for college students. “We will hold a Youth Festival ‘YOXY GEN 2015’ that will witness performances by bands and dance groups from different colleges. Debates and street plays on the theme will also be a part of the festival,” he says. Using the Raahgiri platform in the city, MVSD also organised a three kilometre long “Run to Save the Girl Child” marathon earlier this year, besides a T-Shirt designing contest on the theme. “The winning design was used on the T-shirts that were worn by the participants at the run,” he says.

However, the accused did not turn out to be the duo whose image was captured in a CCTV footage, in which two persons were seen taking a girl in a motorbike.

The persons who were seen taking a child on a motorbike were identified, but they turned out to be locals who were travelling with the daughter of one of the two riders and had nothing to do with the incident, said Pathak.

It is yet to be verified whether only one of the accused juveniles raped the girl or both took turns, Pathak added.

According to the police, the accused and the victim were at a Ramlila event in the neighbourhood on Friday night.

The girl was with her grandmother when she went missing after a 10-minute-long power cut in the locality around 11.30pm.

Arvind Kejriwal guns for Narendra Modi, police as two minors get gangraped in Delhi

The girl’s abduction was captured on a CCTV camera installed in the area, but the footage has so far been of no use to police. The investigators have not been able to identify either the culprits or the vehicle which they used to abduct the child.

Delhi chief minister Arvind Kejriwal took on the Centre yet again on Saturday after two minor girls were gangraped, merely days after a horrific sexual assault of a five-year-old girl surfaced in the national capital. Even as the victim of the brutal rape from earlier this week was recuperating in a city hospital, two minor girls – aged five and two – were gangraped in West and East Delhi respectively, prompting angry residents to hold a demonstration highlighting the growing crimes against women and minors. The first incident was reported from Ranhol area on Friday night where a two-and-a-half-year-old minor was abducted by two bike-borne men, who used the cover of a power outage to carry out the dastardly act. The girl was playing with her grandmother when she ran onto the main road only to fell into the hands of the culprits.<!– Dna_Article_Middle_300x250_BTF –> The girl’s abduction was captured on a CCTV camera installed in the area, but the footage has so far been of no use to police. The investigators have not been able to identify either the culprits or the vehicle which they used to abduct the child. According to residents, the child’s cries for help were heard by hundreds gathered for a Ramleela event, just metres away. The grandmother too cried for help, but the abductors gave neighbours a slip. The girl was later found abandoned in a nearby park, bleeding profusely. In another incident, three men, allegedly under the influence of intoxicants, gangraped a five-year-old girl on Anand Vihar area, east Delhi, on Friday evening. The accused were neighbours, and the victim’s parents, both labourers, were not at the residence, at the time of incident. “The girl was alone at home and was lured by one of the accused to the second floor of the same building where two other men were waiting. The accused trio was caught by the locals after the girl’s aunt, hearing her cries, alerted the neighbours,” said police. The accused, who were trying to escape, were thrashed by the public and later handed over to the police. The Delhi chief minister, who visited the family of the victims, took the lead in unleashing a scathing attack on Prime Minister Narendra Modi, Lieutenant Governor Najeeb Jung and the Delhi police. Kejriwal said the police have “completely failed” to provide safety to women in the city and once again demanded that its control be transferred to the state government. “If the PM wants to have Delhi police under his control, he has to be answerable. I request the PM to take some time out and meet the LG and find out ways to deal with crime against women in Delhi,” he said adding the Centre has “only one job, which is to interfere with the day-to-day working of Delhi government”.

A man in his twenties has been detained by the Delhi police in connection with the brutal rape of a four-year-old girl last week. The accused identified as Rahul, had been named as a key suspect by the father of the girl. The Delhi police after recording statement of the victim’s father had launched a massive man hunt to nab the accused who had carried out the dastardly act.The suspect was finally detained late on Sunday night after police had questioned more than 100 persons in the case. Deputy Commissioner of Police Vijay Singh while speaking to dna described the incident as horrific and said that his department will work round the clock to make sure that the most vulnerable of the city are protected. “Unfortunately slum clusters are very over crowded and children there have working parents so it becomes difficult at times for parents to keep a check on their children. On our end we can make sure that such spaces are provided with maximum security,” the DCP said.Meanwhile, family of a six-year-old girl who was allegedly raped and then abandoned in a forested area in South West Delhi’s Najafgarh have accused the police of inaction. The case bears similarities to the more recently reported Keshav Puram incident as the victim was first lured and then taken away to the secluded area where the alleged crime was committed. According to the girl’s father, the man they suspect that their neighbour, a young man and a fellow tenant of the same landlord, is the accused as he has been absconding since the incident. He also pins the blame on the police for not taking timely action allowing the man to escape.

Allahabad High Court upholds minor girl’s marriage as legal

The order pronounced by a bench comprising Justices Ajai Lamba and Ashok Pal Singh could have wide-ranging ramifications in the interpretation of the Hindu Marriage Act if the technicality of age could be overlooked due to other circumstances.

Is the marriage of a minor girl legal under the Hindu Marriage Act 1955? The obvious answer would be a resounding “no”. However, in a landmark judgment, the Lucknow bench of the Allahabad High Court has ruled in one peculiar case that the minor girl’s marriage could not be termed void ab initio (not maintainable since the very beginning) only because she was below 18 years of age.The order pronounced by a bench comprising Justices Ajai Lamba and Ashok Pal Singh could have wide-ranging ramifications in the interpretation of the Hindu Marriage Act if the technicality of age could be overlooked due to other circumstances.<!– Dna_Article_Middle_300x250_BTF –>The order was passed on a petition moved by the girl through her husband. It stated that she was being forcibly kept in a women’s protection home on an order passed by the magistrate in a lower court. She said that she was being held under duress and that she should be allowed to live with her husband whom she had married out of her free will. The court ordered that the girl be released immediately as keeping her at the women’s home violated her freedom as guaranteed under Article 21 of the Constitution. The court observed that merely because the girl was a minor, the fact that she was now married could not be denied. The judges upheld the marriage as legal and valid. In her petition, the girl had stated that her father and brother wanted to marry her off to a much older man for a sum of Rs 50,000. When she eloped and married the man of her choice, they had lodged an FIR in the Imaliya Sultanpur police station of Sitapur district in central UP alleging that the girl had been abducted. The girl was soon caught and produced before a magistrate who sent her to the Rajkiya Mahila Sharanalaya, Lucknow. The girl then moved a petition seeking issuance of a writ of habeas corpus directing the Rajkiya Mahila Sharanalaya to release the detenue. The judges opined “that liberty of the petitioner has been curtailed without any legal cause” and ordered her immediate release.

St Stephen’s molestation case: Delhi HC stays professor’s arrest till 17 August

New Delhi: The Delhi High Court on Friday stayed the arrest of St Stephen’s college professor Satish Kumar, accused of molesting a PhD student, till 17 August.

Justice Indermeet Kaur also issued notice to Delhi Police on Kumar’s plea directing it to file a status report with regard to the progress made in the investigation of the case before next date of hearing.

St Stephen’s College. Image courtesy: college website.

“Notice. Status report be filed by the respondent (Delhi Police). Meanwhile, the petitioner (Kumar) should join the investigation as and when asked by the respondent,” the judge said, adding that till next date of hearing, 17 August, the petitioner will not be arrested.

The court’s order came on the plea filed by Kumar, an Assistant Professor in the college’s Chemistry Department, challenging the trial court’s June 23 order by which the relief sought by him was declined.

Senior advocate N Hariharan, appearing for Kumar, sought anticipatory bail, claiming that the allegations levelled by the girl were “concocted” and there was not a single eyewitness to any of the incidents mentioned in the complaint.

Hariharan, also assisted by advocate Nitin Kumar Swaroop, informed the court that most of the allegations levelled by the girl were of October 2013 and the mail she had annexed in the complaint clearly says that her work was not in progress so she had sought help from the accused.

“No allegation of molestation was levelled in the mail or the complaint she (girl) wrote to the college principal. The allegation levelled in the FIR were false and fabricated,” Kumar’s counsel said.

Kumar’s plea for relief also stated that the professor could not have molested or followed the girl as he was 85 per cent physically disabled and walked with the help of a stick.

However, the counsel appearing for Delhi Police opposed Kumar’s anticipatory bail saying on Thursday the complainant (girl) handed over tape of the conversation between accused and the principal in her presence and Kumar was heard influencing the college head.

The student had on 19 June lodged an FIR against 40-year-old Kumar, alleging that she was sexually assaulted by him and that the college principal tried to protect him when the matter was reported to the college authorities.

Kumar’s counsel also contended that the student had written three complaints to the college principal and the institution’s Internal Complaint Committee (ICC) which also do not reflect any sexual harassment.

He said that anticipatory bail be granted as Kumar will cooperate fully with the ICC of St Stephen’s college and Delhi Police.

The lawyer contended that till date nothing incriminating has been found against the applicant so he be protected from arrest.

Hariharan also submitted that there is no chance of his client absconding.

However, Kumar’s plea was opposed by the public prosecutor and the victim’s advocate on the ground that the allegations against the assistant professor were very serious and that he was in a dominant position.

The police counsel said that the girl was allegedly molested by Kumar on 15 October, 2013, in the college laboratory and after this incident, he kept stalking her.

The counsel said that on the day of the incident, Kumar had called the girl at least 25 times on her mobile phone but she did not answer his calls and later tried to assure her that it will not happen again.

The student had on June 19 lodged an FIR against Kumar, 40, alleging that she was sexually assaulted by him and that the college principal tried to protect him when the matter was reported to the concerned college authorities.

Kumar sought anticipatory bail on the ground that allegations levelled by the girl were “concocted” and there was not even a single eye witness to any of the incidents.

Singh said that crimes of serious nature were regularly taking place in the state and “fear and insecurity are prevailing among people because of such incidents”.

“The SAD-BJP government has lost the will to govern and hence the President’s rule is the only option (left),” he said.

Singh also condemned the “hush-hush” manner in which the Moga incident victim was cremated.

“The Badals behaved like the Britishers, who had cremated Bhagat Singh in the night to avoid public outburst,” he said.

Earlier, the Congress leader expressed his condolences to the parents of the girl, saying that he was pained by the incident and his party stood by them in their hour of grief.

He gave Rs 2 lakh to the girl’s parents on behalf of his party and assured them of bringing the culprits to book.

Addressing a dharna outside the civil hospital, where the the girl’s parents are undergoing treatment, Singh said “he will ensure that the Badals were thrown out of Punjab”.

Moga molestation death: Teen’s family finally agrees to compensation, cremation of body

Moga (Punjab): Ending a four-day protest that had embarrassed the ruling Badal family, the father of the girl molested and pushed to death from a moving bus today accepted the Punjab government’s offer of compensation and a job and also agreed for the post-mortem and cremation of the body.

The body of the teenage girl was consigned to flames at her village Lande Ke at 8.35 pm amid tight security arrangements after the last rites were performed by the father, who insisted there was no compromise with the state government to end the deadlock.

Punjab Chief Minister Parkash Singh Badal met the father and other members of the victim’s family here this evening and remained with them for 30 minutes.

Badal described the incident as “intolerable” and “painful” while the police said all the four accused had been arrested.

“I want to request that I want to perform the last rites of my daughter,” the victim’s father told reporters here.

He also said that he had agreed for the post-mortem “without any pressure”.

The father had so far been refusing to perform the cremation till a case was filed against Deputy Chief Minister Sukhbir Badal and others who own the Orbit bus service and cancellation of licence to it. He had been staging a sit-in along with some local politicians to press his demands.

“Whatever the state government has offered to us is acceptable to me. They (state government) have fulfilled our demands and have assured us that my daughter’s killer will be punished,” the victim’s father said.

About compensation, he said he did not know about the quantum. “I cannot say about compensation. Whatever has been given to me is sufficient for me. I am happy that I will move away from here with my daughter,” he said.

The government had earlier offered a compensation of Rs 20 lakh, a government job for her injured mother, her free treatment and holding trial of the case in a fast track court but the family had rejected it.

Moga Deputy Commissioner Parminder Singh Gill said that Rs 24 lakh compensation to the affected family would be paid
by Orbit Aviation, owners of the bus, instead of district administration. The money will be deposited with Red Cross Moga from where the money will delivered to affected family.

The girl’s father also sought an end to the protest launched over the incident. “This protest should now come to an end…my daughter has already died. If my wife (who is in hospital) dies, then what will be the use of my life? Now I want to lead a normal life.”

Thanking those who supported him, he insisted, “Nobody including government or any officer has ever threatened me (for compromise).”

In view of security, the girl’s body which was in a mortuary at Singhpura village here was taken to Guru Gobind Singh Medical College and Hospital at Faridkot, 55 km from here, for postmortem, official spokesman said here.

After the autopsy was completed at 7 PM, police took the body to the village for cremation through a longer route in order to prevent any law and order situation.

The girl’s injured mother, who has been admitted in civil hospital, also attended the cremation. Punjab Congress Chief Partap Singh Bajwa, Congress MP Santokh Chaudhary, ex-MLA Malti Thapar and Congress leader Inderjit Singh Zeera were also present there.

Nobody from the ruling party, including the local MLA, attended the cremation. However, when the cremation was going on, activists of Congress, PPP walked out of the ground, shouting slogans against Punjab government.

The breakthrough today came during a meeting between senior civil and police officials and family members even as protesters alleged that the state government forced its decision on the family.

A senior police officer said the family was convinced when informed about the progress in the investigation and the arrest of all four accused.

The district administration had announced compensation of Rs 24 lakh, out of which Rs 4 lakh would be for their son’s education, besides Rs 6 lakh by Punjab SC BC Commission and government job to the girl’s injured mother. The expenses incurred on her treatment will also be borne by the government.

Opposition parties were demanding that the compensation should be borne by the bus owners rather than payment be made out of state exchequer.

The state government was under fire from several quarters including AAP and Congress over the incident, particularly since no cabinet minister yet had gone to meet the family of victim at Moga.

Meanwhile, facing severe criticism over “not properly handling the matter”, Punjab Police ADGP Iqbal Singh Sahota today met the victim’s family and took their son for identification parade of the accused.

Sahota, who is director of recently constituted Bureau of Investigation by the state government, assured the family members that there would be “proper and flawless” investigation in this matter.

Police had come under fire from several quarters for not recording the statement of the boy, who was also in the bus along with girl and his mother at the time of incident.

Meanwhile, the Chief Minister has assured the affected family that the justice would be delivered in full. Expressing deep sorrow over death of the teenage girl, he said in the morning had said one could not compensate the loss of death.

“CM is personally overseeing the Moga crisis. He assures justice will be delivered in full to the family,” Harcharan Bains, Advisor (National Affairs & Media) to Punjab CM, said in Chandigarh today.

Police, however, insisted that no case could be registered against bus owners. “Law does not permit that we take action against a person who even does not have any knowledge of crime,” Moga SSP J S Khehra said.

Yesterday, district administration had ruled out the possibility of registration of case against bus owners, saying it was not legally possible.

Humanity is ultimate religion, says Muslim girl after winning competition on Gita

In a written competition that tests knowledge on Bhagwad Gita, a Mumbai-based Muslim girl pipped 3,000 competitors to emerge the winner.

Maryam Siddiqui, who studies in Cosmopolitan High School, Mira Road won the first prize at the ‘Gita Champions League’ contest, which was organized by International Society for Krishna Consciousness (Iskcon) in January, reports Times of India.

Maryam went though the material provided by Iskcon for almost a month before giving the test in English.

“I have always been inquisitive about religions and I often read up on them during my free time. So when my teacher told me about this contest I thought it would be a good chance to understand what the book is about. My parents too supported my idea of participating in the contest,” said Maryam, according to the Times of India report.

Amid communal tension in the country, Maryam and her parents’ view comes as a refreshing change. “Our family believes that one needs to respect and accept all religions. No religion preaches hatred or wrong”, said her father Asif Siddiqui, in this New Indian Express report.

Earlier this month, Haryana Chief Minister Manohar Lal Khattar said that government will introduce teaching of Bhagavad Gita in schools across the state from coming academic session. The Gita, believed to be the divine advice of Lord Krishna, is a 700-verse Hindu scripture that is a part of the literary epic Mahabharata.

“It is a matter of joy that a Muslim girl has won the first prize. Whether it is Gita or Quran, these are religious scriptures. Religion unites and not divides,” Muslim cleric Maulana Umer Ahmed Ilyasi said, according to this CNN-IBN report.

Maryam’s universal and open-minded thoughts are best expressed in a line she said in this interview to ANI, “Humanity is the ultimate religion.”

If it is ascertained that she has not flouted any rule laid down by Indian conventional wisdom – that  she had not consumed alcohol, was not alone or dozing off in a cab,  not dressed in a way that send the vulnerable, uncontrollable Indian male hormone raging – the popular reaction sways between  sympathy and dismissal.

The ‘wronged’ woman in India is now a bit of a social reality that has to be lived with – like potholed roads, pollution, red tapism and traffic snarls. The abused woman probably makes you fleetingly sad, but has lost the power to make India anxious. Also, it is a fact that a greater section of the society chooses not to be anxious about it.

However, the country never tires of imagining and losing sleep over the grave many ways in which a woman might wrong a man. The undercurrent of anxiety about the power scales tipping to the ‘other’ gender is so strong that it leads a sizable section of even the educated middle class to raise a loud alarm over the attack of the manipulative Indian woman, even when there is no sign that the woman is actually  wrong.

The alleged molester on the Indigo flight. YouTube.

The latest incident to highlight this hypocrisy is the video that went viral showing a woman chastising a man who tried to touch her on a flight to Bhubaneshwar. The woman is seen in the video loudly berating the man, abusing him, calling him an ‘old pervert’. The man is seen trying to cover his face with his hands and also apologising on two instances. A second video that has surfaced following the incident, the man is seen talking to the woman saying, “Everyone makes mistakes in life. This was a mistake.” He goes on to admit that he had touched her.

However, the moment the video surfaced and started doing the rounds on social media, alongside tweets and comments praising the girl’s actions, there were a flurry of comments expressing doubt over the authenticity of the incident, accusing the girl of fabricating allegations.

This, despite the fact that the video clearly shows the man apologizing and never once denying that he had tried to touch her inappropriately. While there were some tweets expressing deep doubt, most of the comments that expressed doubt over the girl’s version of the story were posted on Twitter, on news websites which carried the story, under the convenient cover of anonymity.

Following just a few responses, of the dozens, on the report on Firstpost itself, posted by anonymous commenters:

“indeed such culprits must be punished
another probability!
any man can be defamed by mere allegation
woman may be used as bait or an accomplice to frame men &/OR their families/companies
this has indeed been happening.”

“1. Filing an FIR and carrying out the due process of law is the right step – the lady has shown great courage to proceed with her complaint. 2. However, discussing these episodes on social and mainstream media is dangerous – nowhere in the video is the man shown to be touching the lady. So, how does one pronounce the man to be guilty and shame him ? Just imagine, tomorrow no one will want to sit next to a lady in a flight simply to avoid even misunderstandings or blatant blackmail by women.”

“Somehow feel the whole video is fake…The girl is doing this for publicity… Remember “Rohtak Sisters” ??? Feminists and Feminized Males are inflicting a lot of damage to the society… What is the proof that the “event” described above is genuine ?”

“Just hear the accent and grammar of the girl’s English, she is trying to portray her as an educated, sophisticated girl, which is certainly not the case, which gets more clear by hearing her Hindi accent. Even the guy says in the video that “you are purposefully doing this.” He has understood that he has fallen into a trap. There are many flaws in this video just like the rohtak sisters case.”

Similar comments flooded the comments sections of most news websites that have reported the news.

Be it the Rohtak girls, like people are pointing out, or be it this incident, the idea of claiming justice being within the power of the woman in India seems to be extremely disturbing to a great section of Indians. There are two ways of looking at the mobile phone and the mobile video revolution. One, as a heartening one that slightly aids the battle against  rampant sexual repression of women in India. And two, as a tool to frame innocent men for nothing, a comparatively rare occurrence in India. However, instead of welcoming the the new tool of bringing harassers to book – something that was sorely missing in India – the concerns about the medium being used to falsely attack men seem to be louder.

There’s an obvious reason behind the panic. In India, a woman is painstakingly tutored how her go-to source of wisdom, safety and financial sustenance is a man. The legal, judicial, police establishments are driven mostly by men with women being a peripheral presence in them. From registering an FIR to fighting your case, the process of seeking justice in India passes through many institutions manned by men. Ideally, that wouldn’t have been a problem if all these systems weren’t patriarchal. But they are, making the process gruelling and even humiliating.

However, a video is a weapon that scares patriarchy. The proof, like in the Indigo case, is mostly undeniable. It leaves the woman with more power than usual to fight for her own cause with little need of either empathy or logistical help from a man. It pins a man down for his crimes with little scope of escape.

The letter written by actor Shenaz Treasurywala was defended by many men, and women, pointing out that men are indeed the ones in the position of power in India and it is up to them to take responsibility for the women of the country. This Indigo video proves otherwise. No wonder, then, it has caused some heartburn for ones who like playing protecters.

Viral Video: Girl berates businessman filmed on Indigo flight in a second video

On Monday, a YouTube user Shreyas Rao, uploaded this video of the man who inappropriately touched a girl aboard an Indigo flight. The girl was in no mood to take the abuse silently and retaliated, filming him and shouting at him.

The video, which went viral, was taken in two parts — one with the man on the Indigo flight and the other with the man at the airport. In the second video, the 60-year-old is seen smiling shamelessly when confronted by the girl and one other man.

The man, a businessman, says: “Everybody makes mistakes. I made a mistake, a big mistake,” he says smiling awkwardly. Then he says, “I am a father of a girl.”

The girl although was in no mood to buy the man’s apology and she threw a fit when the man brought in the fact that he is a “father of a daughter.”

Screenshot from the video.

When the girl asks, “If someone does the same thing with your daughter or a woman from your family and apologises will you be ok with it,” the man says, “If they apologise, we should forgive.”

The girl then tells the man to get someone from his family and “we’ll see what you do once something like this happens to a woman from your family.”

“You are the father of a girl? With this audacity? I pity that girl!”

According to the description put by Shreyas, the video was forwarded to him by the girl who sent along this description:

“This man on the seat behind mine, put his fingers in the seat gap to touch me!!! I was very shocked for sometime to react. By then the flight went to landing mode. Then the moment flight touched down, i got up. Saw his hand was again on the side ready to take up any opportunity to touch me!!! I created such a scene, humiliated him in front of the whole flight! He thought like usual girls will keep quiet and he can get away with this! I have lodged an FIR now! He is a very rich man of bhubaneswar and is now very humiliated in front of the people who know him. Cant believe the ordeal i had to go thru but being silent is a crime! The police officer was very helpful and the Indigo staff remained with me throughout. The man is under police custody currently.
I clicked his pictures and made videos, shouted so loud that the entire plane came forward to see him! i made sure i humiliate him as much as possible because i know law will do nothing'”

What is not-at-all surprising or shocking is that no one on the flight bothers to call either the flight staff or the attendants or even ask the man accused of the act to move ahead.

The video went viral on social media with Twitter and Facebook chiding the man for the shameful act and congratulating the girl for taking on her assaulter.

PTI quoted an official at the airfield police station as saying “The man was arrested based on the complaint lodged by the woman. A case had been registered under Section 354 of the IPC.” The official further added that the incident took place on January 27.

However, the police allowed the businessman to go home after serving notice to him. “Yes we can allow the accused to go home in cases which have punishment (of) less than seven years,” said the police officer, adding that the accused has to appear before the court when the case comes up for hearing.
