Madhesis, who share a strong cultural and family bonds with Indians, have imposed a general strike in southern Nepal, thereby causing shortage of fuel and other essential goods in the country. Madhesi leaders have submitted an 11-point demand to the Nepal Government. Their demands include re-demarcation of the provinces, fixing of electoral constituencies on the basis of population and proportional representation.

Congress dubs Centre’s Smart City project as ‘unconstitutional’

“This money will be used by the government for various purposes like waiving off school fees of children and payment of electricity bills of farmers. The government anyway has to do all these works when it declares drought,” he said. The former chief minister also said BJP’s ally Shiv Sena is “aware that Fadnavis is only a man of words and not action”, but cannot do much about it due to the “compromise” it has done with the BJP on several issues. “This has now reduced the Sena into a party that needs to compromise on issues to stay afloat. It has no relation with ‘Hindutva’ and ‘Marathi manoos’ anymore,” he said.

Preliminary work on Kalam memorial begins

The Tamil Nadu Government has alloted 1.30 acre land for the memorial at Pei Karumbu, where Kalam was buried after his death in July last. The commencement of the construction work came days after media reports stated that the place where the memorial of the former President was proposed to be built was lying neglected.

Centre suggests morality provisions for lawyers

The Centre has suggested the Supreme Court make a ruling to debar lawyers for the commission of any offence involving moral turpitude as do other professions like medicine, CA and engineering, as the existing law for advocates is silent.The government also said that the Apex court and high courts have power under the Constitution to frame rules with respect to contempt of court by lawyers.Filing a compilation on the consequence of contempt in related professions other than law, the government said that in professions like medicine, architecture, engineering, charted accountancy, company secretary etc, the respective Acts regulate the professions by debarring professionals on the commission of an offence related to moral turpitude.However, in the Advocates Act there is no provision to debar a lawyer who commits any serious offence involving moral turpitude. Even the Bar Council of India and the state bar councils have the power to suspend or disqualify only when the lawyer is found guilty of the offence, the government said.Furthermore the Advocates Act does not have any provision to debar lawyers from the profession for commission of any serious offence like rape, murder or corruption etc.Suggesting that the Supreme Court should interpret the law and rule on the issue, the government said “The Supreme Court of India should interpret section 24 A of the Advocates Act and give it wider meaning, including in its ambit the provision of debarring a professional if he commits an offence of moral turpitude.”Every high court in India under section 34 (1) of Advocates Act and the Supreme Court under Article 145 of the Constitution of India has the power to frame rules with respect to the contempt of court committed by the lawyers,” the government also said.On November 26, while hearing a contempt plea against an advocate for contempt of one of the courts in Uttar Pradesh, the Apex court had sought the Attorney General’s assistance. The court also asked him to give detailed legal provisions in regard to other professions dealing with debarring professionals for the commission of an offence involving moral turpitude.The Allahabad High Court had found the lawyer guilty of contempt of court for his ” repeated” misconduct towards a judge more than a decade ago . While the city Congress on Thursday claimed that government increased the amount of compensation for the victims of December 7 fire at Damunagar slum in suburban Kandivali due to the party’s agitation, NCP termed the aid as a joke. Mumbai Congress president Sanjay Nirupam said the party workers’ relay hunger strike forced the state government to hike the compensation from Rs 3,800 to Rs 25,000 per family. However, Mumbai NCP president Sachin Ahir termed the amount as “meagre” and a “joke”. In a statement, Nirupam said the devastating fire had rendered over 2,000 families homeless, but no BJP or Shiv Sena leader bothered to visit them. The relay hunger strike by Congress forced the government to increase the compensation to Rs 25,000 per family, he claimed, adding that the government also agreed to probe the cause of the fire and accepted Congress’s demand for rehabilitating the victims on the same site or nearby. <!– Dna_Article_Middle_300x250_BTF –>The government should waive school fees of the children from affected families, he said. Ahir, on the other hand, termed Rs 25,000 aid as “meagre”. “This is like playing a cruel joke on the affected families. The government is trying to dodge the demand of on-site rehabilitation,” he alleged. Ahir demanded Rs five lakh to the kin of the deceased, Rs 1 lakh to the injured, Rs 50,000 to the affected families and permanent houses for them. Congress-NCP regime had rehabilitated the affected slum dwellers of Nargis Dutt Nagar in Bandra on the same site, he claimed.

The Winter Session gives rise to a few legitimate thoughts which I must share.On Parliamentary Democracy:Parliamentary Democracy has been India’s foremost strength. Different shades of political opinions, regions, States, communities, tribes, all find their way in the decision making process in Parliament. Parliamentary protests are not unheard of in India. In extreme cases there are precedents of disturbance in the past. But the last two sessions have witnessed a clear stand of the Congress Party that Parliament shall not be allowed to function. Most of the congress leaders, in private, have expressed helplessness over the decision of their leadership that Parliament must be disturbed continuously. The moot question which arises for the Congress Party is, ‘how does India legislate?’ The Standing Committee mechanism which worked exceedingly well since 1993, has been weakened in the Rajya Sabha, by the House repeatedly appointing Select Committees, questioning the opinions of the Standing Committee. If this tendency continues, a successful institution of Standing Committee could be hurt. The Government, therefore, has adopted an alternative option of a Joint Committee to consider the Bankruptcy Law. There are other options being suggested, such as to pass legislation without a Standing Committee or drafting laws in a manner to fit them into the definition of Money Bills. The latter two are not preferred options. The Congress Party leadership must seriously explore that its disproportionate and irrational approach in dealing with Parliament is hurting institutions. If Pandit Nehru can be credited in the initial years of our democracy of having laid down of healthy precedents being established, the current generation in control of the Congress Party will find a place in history of having weakened what their ancestors established. Has the country not lost out by delaying the GST since the last year’s Budget Session? How far is it desirable to pass important legislations on the last day without discussion? Statistically, we have passed a law. But has Parliament applied its mind to the law?Vulgarity:Is vulgarity the new norm of Indian politics? I hope not.Some months ago a few Members of the Bharatiya Janata Party made statements which were not appreciated even by the Party. The Party President cautioned them and advised them to refrain from making such statements. The result of the caution are visible.What about the statements made by the Hon’ble Chief Minister of Delhi about the Prime Minister and others, both inside and outside Delhi Assembly? If any functionary of the Government of India were to use such language, it would witness a nationwide outrage. People in positions are expected to act with restraint. They cannot be outlandish.Vulgarity is not a right available to them. The political discourse cannot be couched in vulgar language. Falsehood delivered with vulgar overtones is not a substitute of truth. Lumpenisation of public discourse can never be high point of politics. Functionaries of the Delhi Government and its supporters have lowered the level of political discourse. They rely heavily on general falsehood without ever stating the specifics. The Aam Aadmi Party’s success in Delhi seems to have misled the Congress Party that vulgarity brings votes. Indian public opinion has a sense of fairness. It is time that public opinion expresses its outrage against the lowering of the level of public discourse.

The State government on Wednesday informed the Bombay High court that it has decided to appeal against the acquittal order given to actor Salman Khan in the Supreme Court, in the 2002 hit and run case. Government pleader Abhinandan Vangyani said that the sanction has been given by the state law and judiciary department and the appeal would be filed in January. The Prosecution recently sent its recommendations and suggestions to the State Home department suggesting the points based on which the government can appeal against the judgment of the Bombay High Court acquitting actor Salman Khan of all charges. <!– Dna_Article_Middle_300x250_BTF –>The high court had while completely discarding the evidence of star prosecution witness deceased constable Ravindra Patil, had noted that the evidence was recorded before the magistrate court when the charge against Khan was under section 304 (A) (causing death due to rash and negligent act). However, when the serious charge of culpable homicide not amounting to murder was added and the case was being heard before the sessions court, Patil was not available for examination by the prosecution and cross-examination by the defence thus his evidence could not be accepted.High Court in its 304-page judgment said the prosecution has failed to prove all charges against Salman khan beyond a reasonable doubt. There were several infirmities and improvements in the testimony of witnesses. The court has also held that the prosecution is not able to prove its case beyond reasonable doubt and the trial court had erred in wrongly appreciating the evidence brought on record by the prosecution. It was also held that Khan was drunk and driving the car at the time of the accident.Khan was acquitted of the charge of drunk and driving and causing the death of one person and injuring three others in 2002.

In a frenzied sword attack, a 28-year-old software engineer, on Tuesday, left 22 people including his parents and three constables injured before being fatally shot by police.The attacker’s parents and an auto driver are in a critical condition. Delhiites may have to cough up a fine of Rs 2,000 for violating the odd-even rule as the AAP government’s transport department has proposed a penalty scheme during the 15-day trial period of road-rationing experiment starting January 1. CM will take a decision in a review meeting soon to be held on odd-even scheme. Once government gives its nod to proposal, it will be sent to Lt Governor for his approval,” a source said.They also said that government was also contemplating to give special powers to the traffic police, as it was delegated during Commonwealth Games 2010 to implement the odd-even formula so that cops can “strictly” prosecute drivers.To curb rising pollution level in the national capital, the AAP government has decided to introduce odd-even scheme to be implemented starting January 1. The parents of the victim protested in the national capital yesterday. Hundreds of sympathisers joined them at Rajpath near India Gate to show solidarity. The victim’s mother had said that she wanted justice for her daughter and said steps should have been taken long before to not set him free. Six persons, including the juvenile, had assaulted and raped Nirbhaya in a moving bus in south Delhi on December 16, 2012. The victim succumbed to her injuries in a Singapore hospital. Four of the accused were awarded death penalty by the trial court which was later confirmed by the Delhi High Court. Their appeals are pending before the Supreme Court. Another accused, Ram Singh, had allegedly committed suicide in Tihar Jail in 2013.

The political slugfest over DDCA affairs intensified on Sunday with the capital’s AAP government announcing a Commission of Inquiry to go into alleged irregularities there and Union Finance Minister Arun Jaitley deciding to sue Delhi Chief Minister Arvind Kejriwal by slapping civil and criminal cases against him and five other AAP leaders in Delhi courts on Monday. With the battlelines drawn, the Delhi Government announced setting up of the inquiry commission under chairmanship of former Solicitor General Gopal Subramanium to probe alleged irregularities including financial bunglings in the capital’s cricket body, the Delhi and District Cricket Association. The decision came amid AAP’s fierce attack on Jaitley over alleged irregularities in DDCA during his 13-year-old tenure as its chief till 2013. The tussle between the universities and human resource development ministry over autonomy of the university system is not new.

As the government plans to fix accountability for universities in the New Education Policy (NEP), central and state level universities demand more autonomy for the universities before fixing accountability. In the North zone vice chancellors meet called by the Association of Indian Universities (AIU) in Delhi, academicians also raised concern over the rapid and unplanned expansion in the higher education sector.The tussle between the universities and human resource development ministry over autonomy of the university system is not new. The universities hold the opinion that their autonomy should not be compromised in the quest for NEP. Making a reference to the government’s decision of introducing common syllabus across universities and painting them with the same brush, eminent legal scholar and former Delhi University VC Professor Upendra Baxi said, “Treating all universities as same violates the plural and the diverse character of the university system.” Baxi’s whose fight with the government over universities autonomy goes back to the time when late Arjun Singh was the HRD minister also added that if the government wants to make the universities accountable, it has to stop interfering with their autonomy.<!– Dna_Article_Middle_300x250_BTF –>The meeting that was attended by 70 VCs from central and state universities also raised concern over HRD ministry’s pace of expansion and making announcement for establishing new universities. To a query on whether Railways have provided any financial assistance for rehabilitation of rape victims, Sinha said, in one such case, financial assistance of Rs 2.5 lakh had been provided from the Railway Minister’s Welfare and Relief Fund.

As many as 54 incident of rape have taken place in the train compartments or at railway stations since last year and 51 accused have been arrested, Rajya Sabha was informed today.In 2014, 20 cases were reported – six from train compartments and 14 from railway stations, and till November this year, 34 cases have been reported – eight from compartments and 26 from railway stations, Minister of State for Railways Manoj Sinha said in a written reply. New Year gift to home buyers: Maharashtra government unlikely to hike RR rates

In what could well be termed a new year gift to the home buyers, the Maharashtra government, it is learnt, has decided not to increase the ready reckoner (RR) rates in 2016. The move, in view of the perennial glut in the property market, is expected to help stabilise the property prices. The stamp duty and registration are charges imposed on the government rates. According to senior state officials, the government increases the RR rates annually on the eve of the new year. After efforts to contact revenue minister Eknath Khadse for reaction failed, dna spoke to his senior official, who said they are getting the feedback that there is no scope for a rise in RR rate.<!– Dna_Article_Middle_300x250_BTF –> “We have decided to support the real estate industry so that the slowing market could be revived. There is also an opinion that such a move may deprive the government of huge chunk of revenue. The final decision is yet to be taken,” said the official on condition of anonymity. Kapoor said it’s high time the government take a step further and slash the RR rates. “That will ease the property market in real sense. Currently, with the developers constantly increasing prices and the government doing the same with RR rates, the property market has turned unproductive,” he added. Shailesh Puranik, MD, Puranik Developer welcomed the government move. He said the stamp duty has already been increased and increasing the RR rates doesn’t make sense. “There is no movement in the market. The government decision will bring the cheer in the market,” he said. He further said that RBI has also made some positive changes in the lending calculations formula that will also give more relief further. “As a result, the interest rates of the home loan and other loans are likely to come down. It will be a double bonanza for the consumers and developers. By this decision, the positivity will be enthused in the market,” Puranik added.

The Report concluded in relation to the DDCA being registered under the Companies Act, that:- “thus, in a nutshell, there are certain irregularities / non-compliance or technical violations, but no fraud (was) noticed as alleged,” he wrote. “These technical and procedural violations were all compoundable and were compounded by Members against whom they were alleged. The SFIO, under the UPA regime, investigated and could not find a shred of evidence against me. No personal allegation was ever made against me nor did I ever feel the need of contradicting it. There are fake allegations such as escalation of cost of construction of a stadium. When work expands, cost escalations are integral. A brand new 42,000 capacity world class stadium was constructed by the EPIL, a public sector body at a total cost of around Rs.114 crores. At the same time, the UPA Government renovated two stadiums. The Jawaharlal Nehru stadium was renovated at a cost of over Rs.900 crores and Dhyan Chand stadium was renovated at a cost of over Rs. 600 crores,” he added. “I have felt the need for stating the above in order to counter any unsubstantiated, non-specific allegations. The Akhilesh government even took the unseemly step of passing a Bill in the UP Assembly to divest the CJ of this power. However, the Governor had refused to sanction this Bill. The government finally dropped the idea after the Governor had returned Justice Yadav’s file a record four times.

Prime Minister Narendra Modi-led Committee on Wednesday met and is understood to have decided on the new Chief Information Commissioner (CIC), a post lying vacant for about a fortnight.The meeting of the Committee, held in the Prime Minister’s office in Parliament, was attended by Finance Minister Arun Jaitley and Leader of the Congress Party in Lok Sabha, Mallikarjuna Kharge, official sources said. The name of the next CIC has been finalised, they said. However, the name was not disclosed.The Central Information Commission is working headless, for the second time since the BJP Government came into power in 2014, after Vijai Sharma completed his tenure on December one. The ban on registration of diesel-run vehicles in the national capital can be “successfully tackled” if the measure is implemented in neighbouring states too, Delhi Government has said in its action plan submitted to the Supreme Court on air pollution reduction. In its submission to the apex court, the government contended that diesel vehicles get registered by agencies in neighbouring states and hence, it was required the ban is extended there too.”The issue of diesel vehicles can be successfully tackled if registration of all diesel vehicles is banned by all neighbouring states too in addition to Delhi, otherwise, the problem will not be resolved as diesel vehicles get registered by these other state agencies,” the government told the SC, according to a statement issued by it.<!– Dna_Article_Middle_300x250_BTF –>As part of its measures to bring down the air pollution level, the government also expressed its readiness to take over Environment Compensation Charge (ECC) collection from its Concessionaire, SMYR Consortium LLP, with effect from April 1, 2016 “on the same terms and conditions” between the said Concessionaire and MCD.”It is also proposed that committee of representatives of the Government of India, Delhi Government, other stakeholders and experts be constituted and the constitution of EPCA be reviewed and reconstituted,” the government said.The plan was finalised in a meeting, which was attended among others by Chief Minister Arvind Kejriwal, his deputy Manish Sisodia and PWD Minister Satyendar Jain who is the nodal Minister to implement the government’s action plan on air pollution reduction, held on Sunday.Among other measures, the government informed to have taken decisions like implementing odd-even vehicles number formula for curbing pollution between January 1 and January 15, 2016 and based on the experience, further decisions will be taken. The scheme will be implemented from 8 AM to 8 PM every day. However, Sundays will be exempted. In the existing nine clusters, 1000 new cluster buses will be added in three months, it said. The government also informed to carry out vacuum cleaning of all PWD roads in the national capital beginning next fiscal at regular intervals.To avoid dust rising from unpaved footpaths and central verges, the process of putting grass/ plantation on them will start from next month onwards, it added. The government has also closed proposed to close down coal-based Rajghat and Badarpur power stations. It will also make appeal to NGT to close down Dadri power plant “which is very old and a major source of pollution” for Delhi, the Government has said.The Kejriwal dispensation has also proposed to increase suitably the timings of Delhi Metro both in morning and at night.

Rejecting the allegations made by the Aam Aadmi Party (AAP) led Delhi Government; the Central Bureau of Investigation (CBI) on Wednesday said that they did not conduct the raid at the Chief Minister’s Office, adding that efforts were being made to discredit the investigation agency.”Blatant incorrect information is being spread by certain quarters since yesterday to discredit agency with intent to obstruct investigation. CBI categorically denies having seized any material during searches which are not relevant to investigation. Seizures during searches at all places were in presence of independent witnesses, as per procedure,” CBI spokesperson Devpreet Singh told media.<!– Dna_Article_Middle_300x250_BTF –>”The search cum seizure memo containing details of all seized items will be produced before the competent Court. The CBI has already clarified that office of Chief Minister was neither searched nor sealed. Entire operation of laying trap and arrest of SP Singh was conducted by CBI on its own after receipt of complaint followed by independent verification,” Singh said.Meanwhile, Delhi Chief Minister Arvind Kejriwal’s Principal Secretary Rajender Kumar was on Wednesday again questioned by the CBI in connection with a corruption case. Earlier, he was questioned by the CBI for about seven hours late on Tuesday night after the probe agency sleuths raided his office at the Delhi Secretariat.Kumar has been booked under various sections of the Indian Penal Code (IPC) on charges of criminal conspiracy, and also under various sections of the Prevention of Corruption Act for allegedly favouring a private company in five contracts worth Rs. 9.5 crores during 2007-14.

Karti Chidambaram, the son of former finance minister P Chidambaram, on Wednesday said that neither he nor any of his family members were shareholders or directors of any of the firms raided by the central agencies.”Some officers of the investigating agencies visited my offices today. I made it clear to the investigating officers what I had publicly stated earlier. Neither I nor any member of my family is a share holder or director of any of the said firm. We do not have any economic interest in the said firms,” Karti said.P Chidambaram in a statement said that the Government must target him directly, if they wish to do so. That evening, they put out a statement saying that no politician or any member of his family is a shareholder or a director in these two firms. The matter has ended there,” Chidambram told ANI.

Govt blocked 844 social media pages this year: Ravi Shankar Prasad

The number of social media pages blocked by the government for carrying objectionable content rose to 844 till November this year, Parliament was informed on Wednesday.Out of the total, the government blocked 492 web pages under Section 69A of Information Technology Act, 2000 based on recommendation of a committee set up in this regard, compared to 10 blocked in 2014, Telecom Minister Ravi Shankar Prasad said in a written reply in the Lok Sabha.Under Section 69A of IT Act, the government has power to block any information in any computer resource in the interest of sovereignty and integrity of India, national security, friendly relations with foreign states or for maintaining law and order.<!– Dna_Article_Middle_300x250_BTF –>”A total of 136, 13 and 10 and 492 URLs of social media websites were blocked in 2012, 2013, 2014 and 2015, till November 30, 2015, respectively under Section 69A through the Committee constituted under the rules therein,” Prasad said. The social media links that were blocked on court orders stood at 352.”Further, a total of 533, 432 and 352 URLs of social media websites were blocked in compliance with the directions of the competent courts of India in 2013, 2014 and 2015, till November 30, 2015,” Prasad said.The minister said that the government does not separately maintain data on web pages blocked for anti-religious content. He said that in 2014, a total of 4,192 cases were reported under Section 66A of IT Act which had provision of jail term for sending offensive messages online, but the section is no longer valid since Supreme Court annulled it in March 2015.As per data of 2014 shared by Prasad, 2,423 persons were arrested, out of which 1,125 were charge-sheeted and 42 were convicted under Section 66A of IT Act.

Pakistan Prime Minister Nawaz Sharif on Tuesday said his recent meetings with his Indian counterpart Narendra Modi and External Affairs Minister Sushma Swaraj yielded “encouraging results” with both countries agreeing to resume the comprehensive bilateral dialogue.Sharif said this during his meeting with Premier Li Keqiang in the central Chinese city of Zhengzhou where he briefed the Chinese leader on his recent meetings with Modi and Swaraj.
