Madhya Pradesh government will provide a lifetime monthly pension of Rs 5,000 to those people who have lost vision in one of their eyes due to the botched cataract surgery, Chief Minister Shivraj Singh Chouhan told the Legislative Assembly . Chouhan also constituted a high-level panel to probe the incident, which he termed as a “blot” on the face of state government. The announcement was made by Chouhan while replying to an adjournment motion moved by Ramniwas Rawat and other members of the Congress on the issue. Over 40 people lost vision in one of their eyes due to a botched cataract surgery conducted at a government camp in Barwani district last month. The Congress has sought resignation of Health Minister Narottam Mishra who also holds portfolio of Parliamentary Affairs.<!– Dna_Article_Middle_300x250_BTF –>Chouhan, who turned up in the House when the Congress members had refused to listen to Mishra’s reply and boycotted the proceedings, said his government will take care to ensure that such incidents do not recur in the future.”The opposition has not shown any patience on the issue. It could have been better if our friends from the opposition would remain in this House which is a temple of democracy to listen to their charges. The incident was a blot on the face of the state and we took it as a lesson. We will ensure that such incidents will not recur in future,” he said.Chouhan said that besides getting the monthly pension of Rs 5,000 for lifetime, the affected persons will also get an assistance of Rs 2 lakh as announced earlier. He said free treatment will be provided to them to cure their affected eye and also another eye which is also affected with cataract and blurred their vision.Chouhan also announced setting up a high-level panel which will be headed by Additional Chief Secretary (Finance), to probe the incident. Other members of the panel are the Dean, Government MGM Medical College, Indore and an expert from AIIMS Bhopal.”The committee will submit its report within a month’s time and based on its recommendations, action will be taken against those responsible for the incident including the drug suppliers. Nobody will be spared,” he added. The CM said the cataract eye surgery camps will not be organised in the state until the panel submits its report and its suggestions are implemented. Before Chouhan came to the Assembly, Congress member Rawat, along with former Leader of Opposition, Ajay Singh, senior Congress MLAs, Mukesh Nayak and Bala Bachchan among others pressed for Mishra’s resignation on the issue. They alleged that a fungal-infected drug was used for conducting the surgery and that large-scale corruption had taken place in its purchase. The Congress members boycotted the proceedings of House when they found that Mishra was replying on the issue instead of Chouhan as demanded by them. When they insisted that they will listen only to the Chief Minister and inquired about his absence from the Assembly on the issue, Mishra told them that he will come.”..But as a Minister, I am also supposed to give the reply to the opposition’s baseless charges on the issue,” he said. When the Congress members failed to get any confirmed response from treasury benches on timing of the CM coming to the House, they refused to listen to Mishra’s reply and walked out of the House. Strongly opposing their conduct, Rural Development Minister, Gopal Bhargava and Transport Minister, Bhupendra Singh condemned the Congress members for their “undemocratic behaviour”.Bhargava requested Speaker Sitasharan Sharma to make a guideline that if the opposition moves an adjournment motion on any issue, they must remain present in the House to listen to the reply. However, the Speaker ruled that he cannot compel anyone to listen to the replies in such matters and it is better if the matter is leaved at their “discretion.”Later resuming his reply, Mishra asked the Congress members, especially Ajay Singh whether his father and former chief minister (late) Arjun Singh had resigned after the Bhopal gas tragedy in 1984 which claimed thousands of lives. As Chouhan arrived in the House while Mishra was replying, the latter said only the CM will now reply on the issue.

If Delhi Police is bad are police forces elsewhere also bad?” Mishra, Senior Special Commissioner (Law and Order), reportedly said.Mishra’s reported comments on rape in the wake sexual assault of two minors on Saturday elicited sharp response from the AAP government with Chief Minister Arvind Kejriwal terming it “shameful”. <!– Dna_Article_Middle_300x250_BTF –>Kejriwal and Sisodia took to twitter to slam Mishra. “This is shameful. Completely insensitive. Hope PM and his LG don’t subscribe to it,” the chief minister said. “Yes it is politics. Specially when we see such irresponsible attitude from top cops, this politics is much needed,” Sisodia tweeted. Two children, including a two-and-half-year-old, were brutally raped in the capital, a week after the grisly sexual assult on a minor. In the first case, the two-and-a-half-year-old girl was kidnapped by two motorcycle-borne men from a Ramlila event in west Delhi’s Nihal Vihar locality last night. If Delhi Police is bad are police forces elsewhere also bad?” Mishra, Senior Special Commissioner (Law and Order), reportedly said. When contacted, Mishra said that the reactions to his “misunderstood” comments were “out of context”. “I essentially said that rape is a social evil which can happen anywhere and it is high time that we all should put our head and heart into the eradication of the social menace,” Mishra said. Earlier, Kejriwal hit out at police, saying it had “completely failed” to provide safety to the citizens, while urging PM Narendra Modi to “either act himself” or give AAP government the authority over law and order in the capital.Reacting to BJP’s allegation that the chief minister is playing “shallow politics” over rape, he said, “Yes we are in politics and it’s politics against crime. Not to protect rapists-murderers like many politicians doing shamelessly everyday.” Two children, including a two-and-half-year-old, were brutally raped in the capital, a week after the grisly sexual assult on a minor. Coal scam: Former PM Manmohan Singh’s plea to be heard by special bench, says Supreme Court

The bench, also comprising justice Arun Mishra, said that this matter will be listed next week. Minutes after the development, senior advocate Harish Salve appearing for Hindalco, mentioned the plea before the bench and sought the hearing after Diwali vacation. The plea was resisted by Sibal.

The Supreme Court on Wednesday made it clear that the appeal of former Prime Minister Manmohan Singh, challenging the trial court order summoning him as an accused in a coal scam case, would be heard by a special bench which has been hearing such cases. The observation was made by a bench headed by Chief Justice H L Dattu when senior advocate Kapil Sibal, appearing for Singh, sought an early hearing of the appeal filed by former Prime Minister.”This is the matter which is not entirely related to the coal allocation case,” Sibal said.<!– Dna_Article_Middle_300x250_BTF –>”We will refer this to the coal bench and you go before that bench and convince them that this is not a coal matter,” the bench said. The bench, also comprising justice Arun Mishra, said that this matter will be listed next week. Minutes after the development, senior advocate Harish Salve appearing for Hindalco, mentioned the plea before the bench and sought the hearing after Diwali vacation. The plea was resisted by Sibal.”These all are that matter. They should be heard together,” Salve said. The submissions of Salve were supported by another senior advocate K K Venugopal who appeared for former minister of state for coal Santosh Bagrodia, also an accused in another coal scam case. The bench, which tentatively agreed with Salve’s plea and fixed the matters for hearing on November 17, later asked the lawyers to arrive at a consensus with regard to the date of hearing and then mention it together before the bench.Earlier, the Supreme Court had ordered deletion from its list of business of September 21 the batch of appeals filed by Singh and others. The apex court had on April one stayed the trial court order summoning former PM as accused in a coal block allocation case and the proceedings before it.The relief was also extended to Hindalco Chairman Kumar Mangalam Birla, whose company was granted Talabira-II coal block in Odisha in 2005, former Coal Secretary P C Parakh, two Hindalco officials Shubhendu Amitabh and D Bhattacharya and the company itself. While staying trial court’s order, the apex court had said that the consequential proceedings arising out of the summoning order shall also remain stayed. The Special CBI Judge Bharat Parashar had on March 11 rejected the CBI’s closure report and summoned Singh and the other five as accused. While issuing the summons, the trial court had said that prima facie it was clear that the criminal conspiracy which was initially conceived by Birla, Hindalco and its two officials, was carried out further “by roping in Parakh, and thereafter the then Minister of Coal, Manmohan Singh”.It had said that Singh’s approval to allocate coal block to Hindalco “prima facie facilitated windfall profits” to the private firm resulting in loss to state-owned PSU Neyveli Lignite Corporation Ltd (NLC).

Dadri lynching: It was planned by Hindutva forces, claims JNU, DU fact finding committee

New Delhi: The lynching of a 50-year-old Muslim man in Dadri over rumours of eating beef did not happen on the “spur of the moment” and was planned by certain Hindutva forces, a ‘fact-finding’ committee of academicians from JNU and Delhi University, among others, has claimed.

The group, Janhastakshep, also accused the Uttar Pradesh government of allowing “free play” to the communal forces and demanded a high-level inquiry into killing of Iqlakh and
punishment to the guilty.

“There was ample evidence available to suggest that the incident did not take place on the spur of the moment and had been well planned by the Hindutva forces.

“It was implemented through a maze of front organisations other than those associated with Sangh Parivar so it is established that such an event cannot be directly attributed to the Sangh,” Ish Mishra, Janhastakshep convenor told
reporters.

The team came out with its findings after visiting the Bishada village where Iqlakh was bludgeoned to death on September 28 by a 200-strong mob over rumours about storing
and consuming beef. His 22-year-old son Danish was grievously injured in the assault. Cow slaughter is banned in Uttar Pradesh.

“Our investigation of the events leading up to the murder and grievous injury sustained by his son reveals that the incident is an extension of new genre of low intensity, high
impact communal tension targeting the Muslims and instilling the fear of brute power of the majority community among the Muslim masses,” said Vikas Bajpai, a JNU professor while
releasing the report.

The group also condemned the remarks made by Union Minister Mahesh Sharma, terming the incident an “accident resulting from misunderstanding”, and demanded that he be removed from the Ministry and an FIR be filed against him.

“We also demand that action be taken against local police for its failure to restrain the local communal elements and for failing to keep track of the activities of numerous senas which have been active in vitiating the atmosphere in the area,” Mishra said.

Supreme Court concerned over alarming pollution level in Delhi

“My wife has asthma. My daughter has asthma and I had to take steroid first time two days back,” Salve said.

The Chief Justice of India and a senior lawyer today observed that they and their kin had fallen victims to the “alarming” levels of air pollution in Delhi and favoured wide coverage of the discourse on the matter in the Supreme Court. Usually critical of the reportage on the observations made during its hearings, the apex court today had a word different on it. “This is one case where newspapers should report as to what transpired in the court during the hearing,” a bench headed by Chief Justice H L Dattu said.<!– Dna_Article_Middle_300x250_BTF –>”My grandson wears mask due to pollution,” the CJI said when senior advocate Harish Salve submitted that he had to take steroid for the first time a few days ago. “My wife has asthma. He said: “We will write a letter to the President of India, the Prime Minister, the Governor and others to direct the state government to strictly follow the law against cow slaughter.”

“We also demand special task force and special court to arrest people involved in cow slaughter and conduct their trial in courts.”

Mishra said: “There is no mechanism to keep a watch on slaughter houses.”

Maharashtra police used to torture me: JNU student Hem Mishra

JNU student Hem Mishra accuses two years of torture and rights abuse against investigative agencies

JNU student Hem Mishra

JNU student Hem Mishra, who this week returned to campus after spending two years in jail, for allegedly acting as a courier for naxalites, leveled serious allegations of abuse against the Maharashtra police as well as other investigative agencies probing him. “Two years and 19 days I was in prison. The first 19 days I was in held in police custody and the rest in Nagpur jail, an experience I would never be able to forget. But the time in police custody was the worst. There was this piece of wood used in spinning wheels and the police used to hit me with it twice a day, during the questioning session,” Mishra (34) told dna adding police called the torture weapon ‘Bajirao’, name of a noted Maratha general of the 18th century.<!– Dna_Article_Middle_300x250_BTF –> A second-year student of Chinese language, Mishra was arrested by Gadchiroli police on August 20, 2013 in Chandarpur district’s Balharshah area. Police alleged that Mishra was in transit to a jungle hideout of some senior Naxal leaders to pass on some communication. Mishra maintains that he was in the area to meet Dr. Prakash Baba Amte, a social worker who received Magsaysay award for community leadership. Dr Amte has been working on health issues faced by Adivasi community. “I thought they were kidnapping me. Around 10 to 15 men grabbed me and started hitting me till they took me to the local police station. I even cried out for help, but soon came to know who these men were,” Mishra said. Over the next 19 days, various agencies including the Intelligence Bureau, Maharashtra state intelligence unit and police from Chattisgarh and Uttarakhand, his hometown, took turns in interrogating him. “Back home many cultural activists were arrested and we had worked hard for their release. I suspect it was from there that I landed in their so-called radar,” Mishra said. Lodged in a ‘Naxal ward’, Mishra along with 168 prisoners went on a nine-day hunger strike in February last year to protest against the jail authorities. “Hunger strike ended only when a retired judge was sent to intervene. But me and 21 other prisoners, most of whom were arrested for being Naxalites, were sent to the isolated ‘anda cell’ where I spent the rest of my term. 15 hours we used to spend in the cell and rest of the time we used to roam on a patch of land not more than 40 metres,” said Mishra. He said the only consolation was ‘respect from other prisoners’. “A majority of inmates were poor adivasis, Dalits and Muslims and somehow they believe that activists raise the issues they face. These people are in jail because they have no money to defend themselves,” he said. dna spoke to Sandip Patil, Superintendent of Police (SP), Gadchiroli, who said, “This is the strategy used by the naxalites to put police on the backfoot. They make such allegations to ensure they get sympathy of the rights activists.” He added, “The urban supporters are the brains behind the movement and they come up with such strategy so that the police are on the receiving end. I don’t think there is any truth in the allegations”.

Coming down hard on some lawyers from Tamil Nadu for storming into courtrooms shouting slogans against judges and going on strike, Bar Council of India has suspended 15 advocates, including Secretary of Madurai Bar Association A K Ramasamy, and its president P Dharmaraj, who are facing contempt proceedings.BCI Chairman Manan Kumar Mishra sent an intimation on Thursday to this effect to Bar Council of Tamil Nadu and Puducherry and directed all 15 to appear before the disciplinary committee formed by it on October 4 in the premises of Bar Council of Karnataka. It directed the committee to conclude proceedings within four weeks from today.<!– Dna_Article_Middle_300x250_BTF –>The order said the lawyers are suspended from practice and during the suspension period, they would be debarred from practice in any court or before any authority or person in India. BCI also requested Advocate General of Tamil Nadu either to present himself or to send his representative to attend the proceedings, if he feels necessary. It also directed Bar Council of Tamil Nadu and Puducherry to serve notices to them. The copy of the order was sent to the Secretary General of the Supreme Court, the Registrar General of the Madras HC and to the Secretary, Ministry of Law and Justice, with a request to place it before the Union Minister.Mishra referred to the report of the Chairman of Bar Council of Tamil Nadu and Puducherry that the Madras HC judges were in a ‘fear psychosis’ due to constantly having to watch out for slogan-shouting lawyers storming court rooms and said “this is a very strange and unfortunate situation.” He castigated lawyers in Madurai who were reportedly on strike for long opposing the Madras HC making wearing of helmet mandatory, saying ‘such ridiculous stand or demands by intellectuals of society is beyond imagination. No prudent men could be expected to make such irresponsible demands.” Mishra recalled he had ordered BCTP Chairman to identify these lawyers and also that they be suspended immediately and to conclude disciplinary proceedings in three weeks. However, the Chairman had expressed his inability to do so particularly leaders of the advocates, ‘because of their muscle power, bad antecedents and criminal history,” he said.Recalling that Madras HC judges had to enter court halls with tight police cover after adjournment of contempt case against Ramasamy, he said “such grave and improper conduct by lawyers is really unforeseen and needs immediate stern action.”On such issues, in my opinion the time has come when Bar Councils will have to make a drastic change in their attitude, while dealing with cases of professional misconduct, failing which the profession will lose its importance.”Mishra said the matter was discussed by Council members, all of whom felt that the lawyers’s licenses should be suspended and a disciplinary committee be formed to initiate disciplinary proceedings.

With dengue menace refusing to relent and hospitals in the city having a huge rush of patients, AIIMS Director said the disease will persist till November and then till will decline.”Until October 15, we will get more cases. After that the temperature will cool down and November onwards we will see the decline and naturally in December, January, it would disappear. There is humidity, temperature and the total environment that the mosquito gets to breed and which starts with the monsoon setting in. So the cases have started coming in from mid-June onwards and after that there has been a surge. September has been bad from that perspective,” AIIMS Director M C Mishra said.<!– Dna_Article_Middle_300x250_BTF –>He, however, urged people not to panic citing the mortality in dengue is very low and that people should start taking enough fluids if they contract the disease.”If you look at the hospitalised patients, who are selected patients, sick patients, even in those, the mortality has been really low and it is in the range of 7-10 per cent (in case of sick patients). The mortality in dengue is is less than half per cent and even less than that. So people must have the confidence that most dengue fever is a common fever which is mild in nature and majority of people will recover from it. But, in occasional cases it does turn into a dengue shock syndrome or Hemorrhagic fever which is far more tragic and that takes the toll,” he said.Meanwhile, experts at AIIMS have advised people not to fall for “herbal cures” citing there is no scientific proof that they help fight the disease even as the demand for giloy and papaya leaves, aloe vera and goat milk shot up in Delhi with dengue patients opting for these to increase platelet count.”We don’t recommend these ‘herbal cures’ like aloe vera, papaya leaf and goat milk. We would also advise people not to scramble for these as there is no scientific evidence or research based on which it can be conclusively said that these herbs and fruits can be effective in the treatment of dengue,” said S K Sharma, Head of Medicine Department at AIIMS.Dengue till now has affected close to 4000 people and claimed 28 lives unofficially as the official figure of death toll which is 17.

Sanitary napkin vending machines installed at Nirman Bhawan

Experts notice that this owes largely to a stigma attached to the product in India, where women hesitate to buy sanitary napkins from retail shops.

In a move aimed at advocating hygienic practices among women, four sanitary napkin vending machines have been installed in women’s washrooms at Nirman Bhawan, which houses the Union Ministry of Health and Family Welfare. Delhi gets its third law minister in six months!

Kapil Mishra on his way out?

The national capital has got its new law minister in a span of just six months. Delhi chief minister Arvind Kejriwal on Monday gave the law ministry’s charge to deputy chief minister Manish Sisodia, removing Kapil Mishra, who was holding the crucial portfolio.Mishra was appointed as the law minister in just June this year, after his predecessor Jitendra Tomar was arrested over allegations of his fake law degree. During AAP’s first stint of 49 days, Somnath Bharti was appointed the law minister. He had drawn flak after his controversial midnight raid that targeted Nigerian women in his constituency. <!– Dna_Article_Middle_300x250_BTF –>According to sources, Mishra’s over-enthusiastic style of functioning was the reason for his ouster from the portfolio. Four days ago, in a letter to Kejriwal, Mishra had requested him to file an FIR against former Delhi CM Sheila Dixit over the report of a ‘fact finding committee’ on water tanker management distribution system of the Delhi Jal Board (DJB), mentioning how Dixit and the then DJB chairman had bypassed laws that led to a loss of Rs400 crores. The Delhi government is yet to make the committee report public.“This is a big expose and I am afraid that immediately after this expose, there will be attempts to destabilise our Government in Delhi and also to remove me from this chair,” he had written, as a premonition perhaps. He had also shot another letter to Sisodia recently, asking for an urgent meeting to ensure that terrace restaurants are brought to the city soon. Sources informed that another reason for the change was that the law department demanded a stricter head.Mishra, however, will continue to be in charge of the water and tourism ministries. He had led the campaign within Aam Aadmi Party for the removal of Prashant Bhushan and Yogendra Yadav, following which he was appointed as a minister of the Delhi government.

Radical change in thinking led to elimination of maternal and neonatal tetanus, says additional health secretary

According to Mishra, despite the fact that India’s rate of increasing immunisation was only 1 per cent per year, it had already covered about 80 per cent children in all sorts of difficult geographies.

At the truly international stage of the third Global Call to Action Summit, India made the commitment to achieve 90 per cent immunisation coverage by 2020, an ambitious target given its current status of around 65 per cent. It also, through the Prime Minister, offered to share its experience with vaccination drives with SAARC countries, given its success with polio. Speaking to dna the Additional Health Secretary CK Mishra explained just how that was possible, and what gave India the legitimacy to champion its immunisation programme on such a global platform.<!– Dna_Article_Middle_300x250_BTF –>According to Mishra, despite the fact that India’s rate of increasing immunisation was only 1 per cent per year, it had already covered about 80 per cent children in all sorts of difficult geographies.”We started at very low levels of immunisation, as there was no plan to reach out to the child. Instead we waited for children to come to us,” said Mishra. A radical change in this thinking is what’s led to the country’s success with polio in 2014, and now with eliminating maternal and neonatal tetanus in 2015. A large part of this is due to creating a “robust supply chain management” so as to ensure no problems in the supply side of vaccines. It was in 1985 that the concept of Universal Health Coverage was extended to rural populations, and only in 2005 did that become part of the National Rural Health Mission, a move that gave a crucial push to immunisation.”We have an army of people on the frontlines trained in logistics and geared with vaccines reaching out to mothers and children,” Mishra explained.A question repeatedly raised during the summit had been of the quality of drugs, vaccines and medical devices produced for outreach. Experts stated that nearly 16-20 per cent of drugs in developing nations were substandard or counterfeit. However, Mishra emphasised that India’s vaccine testing system was so thorough that “till date there has not been a single complaint”.He explained further the system,”The government has the National Technical Advisory Group on Immunisation, which has further technical sub committees looking into all the details before making recommendations to the government. Additionally the Drug Controller of India also examines the data.”It is through this system that the Rotavirus Vaccine, India’s next big step in immunisation, has emerged. The vaccine was pushed vehemently during the summit, as it aims to combat the millions of diarrhea deaths caused among young children by the rotavirus. This push in immunisation is also the driving force behind Mission Indradhanush, another of India’s schemes proudly showcased to global health experts. “We knew at the current rate we would not have increased our coverage beyond maybe 2 per cent each year,” said Mishra. However, with the Mission, he explained in the first 201 district the government has already covered half of the children previously not immunised or not fully immunised. “We’ve already reached 20 lakh children out of the 42 lakh who were not under the immunisation coverage.”Mishra, one of the key speakers of this summit was quoted by many others when he said “more money for health and more health from money”. He elaborated on this phrase by saying that each penny spent on public health care had to count. However, he was more choosy with his words when talking about the slashes to India’s annual health budget, already impacting many of the government schemes. “We will keep trying with what we have,” he said, adding, “We must encourage states to perform better and look for whatever alternative means of funding possible.”

Delhi government orders review of INTACH agreement stalls restoration of 18 city monuments

In what could be a setback to heritage enthusiasts, work on restoring and conserving 18 long-lost, lesser known monuments in the national capital, such as Bhuli Bhatiyari Ka Mahal, Sarai of Basant, tomb of Shaikh Ziyauddin Rumi, has been stalled for now.The reason is the Delhi government’s recent call for fresh review of the five-year agreement between them and the INTACH — an NGO the Delhi chapter of which works on restoration and conservation of historic monuments and heritage sites in the city.According to sources, the detailed project report (DPR) of the 18 ancient structures was ready and the restoration work on them was to start in days. The review process may delay this work by months.<!– Dna_Article_Middle_300x250_BTF –>Delhi’s monuments –that roughly sums up to 1,200, is a tourist attraction that speaks volumes of the city’s history. Barring a handful of them, most of these monuments have reported rampant encroachments and are in a dilapidated state.Realising the importance of their urgent revival, the Delhi government’s archeology department, along with INTACH, had selected 250 lost and lesser known monuments and heritage structures in the city, for their phase-wise restoration. The first agreement was made in 2008 for three years, following which it was renewed for five years in 2012 by the then Sheila Dixit government. In the first and the second phases, restoration work on 18 and 16 structures was taken up respectively. The fresh set of 18 more structures was to be taken in the third phase of the work. However, the review which would also include reshuffling or setting up a technical committee, have halted the work for the moment. The funds allocated for the work will be sanctioned only after the review of the agreement is completed.“Restoration and conservation work of monuments and heritage structures suffers because of bureaucratic red tapism. We have now got used to such delays,” AGS Menon, convenor of INTACH Delhi chapter.Urban planner KT Ravindran said he has no doubt about INTACH’s integrity, even though it may be legitimate for the ruling government to review an agreement.Despite repeated attempts Kapil Mishra, minister of the Delhi government’s department of tourism and art and culture was not available for comments.

1997 Uphaar fire tragedy: Ansal brothers walk free; no jail term, only fine

In a huge relief to industrialists Sushil and Gopal Ansal, the Supreme Court on Wednesday allowed them to walk free in the 1997 Uphaar fire tragedy case in which 59 cine-goers had died of asphyxia, on furnishing of a whopping fine of Rs 30 crore each within three months. Awarding the jail term for a period already undergone by the industrialists, the three-judge bench of Justices A R Dave, Kurian Joseph and Adarsh Kumar Goel asked them to pay the total fine of Rs 60 crore in three months and deposit it with the Delhi government, which in turn will spend the money on welfare schemes.<!– Dna_Article_Middle_300x250_BTF –>While Sushil Ansal has spent over five months in prison, Gopal has spent jail time of over four months. The bench rejected the submissions of senior advocate Harish Salve, appearing for CBI, that the convicts be sent to jail to serve the remaining jail term.”My instruction from CBI is to press for their custody,” Salve said, when the court sought his views. Senior advocate KTS Tulsi, who represented the Association of Victims of Uphaar Tragedy (AVUT), also said that the convicts not only be jailed, but rather their punishment should be enhanced.Fifty-nine people, trapped in the balcony of the theatre, died of asphyxia following the fire and over 100 were injured in the subsequent stampede on June 13, 1997 during the screening of Bollywood film “Border”.Earlier, a bench of justices T S Thakur and Gyan Sudha Mishra (since retired) had on March 5, 2014, held real estate barons Sushil and Gopal Ansal guilty, but differed on the quantum of sentence to be awarded to them. It had concurred in holding that there was “contemptuous disregard” of civic laws on part of the Ansals that led to the tragedy as they were “more interested in making money than ensuring safety of people”.Justice Thakur had concurred with the 2008 verdict of the Delhi High Court which had awarded one-year jail term to both Sushil and Gopal Ansal. However, Justice Mishra had reduced the jail term to the period already served in jail by Sushil considering his age and enhanced the sentence of Gopal to two years.

Ex-servicemen keep PM Narendra Modi on tight leash

Caught in Catch 22 situation on One Rank One Pension (OROP) issue, Prime Minister’s Office (PMO) tried to pacify the agitating ex-servicemen by calling them in for a meeting through chief of army staff General Dalbir Singh Suhag but failed to make them agree to discontinue or suspend their stir. The maximum bargain PM’s principal secretary Nripendra Mishra could extract from representatives – Lt Gen Balbir Singh (Retd), president of Indian ex-servicemen movement and Maj Gen Satinder Singh – was no further escalation in the agitation till August 25, the time given for the PM to meet and take a final decision on OROP.<!– Dna_Article_Middle_300x250_BTF –>The effort from PM’s office came in the backdrop of a third ex-serviceman joining fast-unto-death ultimatum on Tuesday, thereby signaling an escalation of sorts.Speaking to dna, Maj Gen (Retd.) We also asked him to get the PM on board as promised by defence minister Manohar Parikkar by August 24-25,” said Singh.Giving little leeway to the government to manoeuvre, Maj Gen Singh said we have clear to Mr Mishra that definition of OROP will remain the same as presented before the parliament which implies that “uniform pension be paid to armed forces personnel retiring in the same rank with the same length of service, irrespective of their date of retirement, and any future enhancement in the rates of pension be automatically passed on to the past pensioners.”“We have also sought an assured date for implementation of OROP and the date of effect will remain from April 1, 2014 as was decided by the government,” Maj Gen Singh said. The mood was upbeat at Jantar Mantar, the place of agitation, where Jt Commissioner of Delhi Police M K Meena was sent by the government to tender an apology for Delhi Police’s bad behavior with agitating ex-servicemen on the night of August 14 trying to forcibly evict them on security grounds. Meena assured the protesting ex-servicemen that such a thing would not happen in future.“On August 14, misunderstanding had taken place. We have discussed the issue in detail. At times some confusion takes place. We will try to take corrective action. I want to say that our intention was not to hurt the soldiers. Whether they are in service or not, we respect them as they take care of external security. We are with you and this force will be for your service and not to control you,” said Meena while tendering an apology.

They added that the students had also created words such as ‘Welcome’ and ‘Thank you’, reports The Hindustan Times.Delhi’s transport and labour minister Gopal Rai said that the government did not like the idea of such display of Kejriwal’s name at the event. He also said that the government found out having the chief ministers name displayed in that way. “We enquired about it and came to know that it’s a tradition. This has been happening which is not right,” Delhi Transport Minister Gopal Rai said. The government also released pictures showing similar designs — one showing Najeeb Jung’s name and the other Sheila Dikshit’s — created on previous such occasions. “I think it is deliberate mischief. Last year school children had displayed LG’s name at I-day function. Before that name of CM was regularly displayed at I-day celebrations. School children displayed variety of placards, why selective targeting?” a government spokesperson said.Later, CM Kejriwal too tweeted about the issue saying that he did not about the practice and he would bring an end to it. While laying siege upon a Maoist hideout in the Lakhari village of the said district, the slain officer laid out his strike team in an strategic fashion and began the assault but later was hit by enemy fire and the bullet pierced through his right eye and exited from the back.Jha collapsed on the spot but not before giving a tactical advantage to his team-mates and draining out the bullets and ammunition of the Naxals. Jha’s the then commanding officer, Inspector General (IG) R K Mishra said he was one of the “bravest men” in his team.”He was extremely brave and hard working. I very clearly remember that the officer climbed a hill under heavy rains in the dead of the night to plan an early morning ambush. We lost a very promising officer in this operation,” Mishra, now IG (Operations) for CRPF in Jharkhand, told PTI.A colleague recounted how Jha volunteered to be posted in the anti-Naxal operations grid after he had various stints in Jammu and Kashmir and insurgency-hit areas of North East. Jha joined CRPF in 1999 in the entry-level officer rank of Assistant Commandant. The officer hailed from Ranchi and is survived by two young children and wife. The ‘Shaurya Chakra’ is the third highest peacetime gallantry medal and other than Jha, two policemen from Jammu and Kashmir police have been decorated with the award this time.

A Sukhoi conducted a numbers of recce in the past two days but failed to scan the probable area which is covered with dense forest.

The Dauphin chopper of state-run Pawan Hans went missing with Tirap deputy commissioner Kamlesh Kumar Joshi and two pilots Captain MS Brar and Captain Rajeev Hoskote, after it had taken off from Khonsa in Tirap district at around 10.45 am on Tuesday.

Joshi’s relatives, including his wife have arrived at Khonsa.

Director General of Civil Aviation has ordered a preliminary inquiry into the incident, while Pawan Hans
authorities deputed teams from New Delhi and Guwahati and ordered an internal inquiry.

NH7 widening: NTCA makes no mention of mitigation measures in their affidavit to NGT

The omission of mitigating measures from NTCA’s affidavit is glaring, as a lot of controversy has brewed over the environment ministry’s and National Highway Authority reluctance to adopt extensive mitigating measures.

The National Tiger Conservation Authority (NTCA), in their affidavit to the National Green Tribunal (NGT) on the NH7 widening case, made no mention of the mitigation measures suggested by Wildlife Institute of India (WII) to facilitate tiger movement. The NTCA had been asked to reply to a petition filed by Srushtri Paryavaran Mandal, who have prayed for quashing of the NH7 widening as it will cut through the critical Pench-Kanha tiger corridor. The omission of mitigating measures from NTCA’s affidavit is glaring, as a lot of controversy has brewed over the environment ministry’s and National Highway Authority reluctance to adopt extensive mitigating measures. The WII had suggested construction of 1km long elevated road and 750m long underpasses to ensure smooth movement of tigers across NH7, in what is one of the best tiger habitats in the country<!– Dna_Article_Middle_300x250_BTF –>In their four-page affidavit to the NGT bench chaired by Swatanter Kumar, NTCA has admitted that the Pench-Kanha corridor landscape is one of the best that exists with two source populations. But during the hearing, senior counsel Pinka Mishra who was representing NHAI, attempted to show the bench that the tiger corridors are not in the purview of notified protected areas. To this, the bench asked NTCA member secretary BS Bonal, if there is evidence of tiger movement. Bonal replied in affirmative. To this, the bench asked him if they had approved any mitigation plans, and Bonal once again replied in affirmative. But, contrary to Bonal’s claims, the NTCA has not approved or finalised any mitigation plan and a proposal is pending with the chief wildlife warden of Maharashtra forest department, sources confirmed. Also, counsel for Srushti Paryavaran Mandal advocate Ritwick Dutta highlighted that despite Bonal’s affirmative reply, NTCA’s affidavit made no mention of the mitigation plan.Curiously, in contradiction to the NHAI’s stand up till now of building only underpasses of 50m, senior counsel Pinaki Mishra, while replying to Dutta’s charge that mitigation measures have not been accepted, said, “NHAI is willing to build 750 metres long underpasses for animals. Dutta also added later, that rather than the Ministry of Environment, Forests and Climate Change (MoEFCC) and NTCA, it is the NHAI who is suggesting mitigation measures. TheThe NGT, after being informed that Nagpur high court has allowed felling of trees in an order this week, has said that it will not give up its powes and the interim order, staying tree felling stays. The bench has fixed the next hearing for August 5.

CBI extends probe to Madhya Pradesh transport department

The total number of seats in the department were increased from 198 to 332 by a government notification number 198 in 2012 and RTI activist Ajay Dubey alleges that the motive behind the increase was to get candidates who had bribed the officials, jobs in the transport department.

The Central Bureau of Investigation on Wednesday took over the investigation into the alleged alteration in optical mark recognition (OMR) sheets by employees of Vyapam in connection with Transport Constable Recruitment Test 2012. The development was, perhaps, the most awaited one for the petitioners in Vyapam scam case who believe that while frauds committed in the fields of medicine, engineering and police training can only drag in middle-rung culprits, the job scam involving the Madhya Pradesh transport department holds the key to implicate the chief minister Shivraj Singh as well as his wife Sadhna Singh.<!– Dna_Article_Middle_300x250_BTF –>The total number of seats in the department were increased from 198 to 332 by a government notification number 198 in 2012 and RTI activist Ajay Dubey alleges that the motive behind the increase was to get candidates who had bribed the officials, jobs in the transport department.A week before the CBI took over the probe into the massive admission and recruitment scam, the transport department situated in Gwalior was gutted in fire allegedly caused due to a short circuit. Whistleblowers as well as opposition parties had suspected foul play and claimed that filed related to Vyapam were deliberately destroyed. “Jobs in transport department are more lucrative than other fields like medicine or engineering,” Dubey told dna.In June last year, an RTI query was filed by Kamal Maurya, additional IG, STF, seeking information on the transport scam. Two months later when an RTI query was filed by Dubey seeking details provided to STF official, the asked information was not provided.According to him, chief secretary of Madhya Pradesh, Antony Disa (who then was additional secretary in transport department, Manish Shrivastav, transport secretary and Jagdish Devda should have been questioned by the STF. “We will request the honorable court to direct the agency to question all the accused,” said Dubey who would be present in the next Vyapam hearing set to take place on July 24.Sources in the CBI said that the probe agency is taking up every single complaint related to the Vyapam scam and it was a matter of time that all the cases would be taken over. Yet it remains to be seen whether the CBI will question the names mentioned by Dubey. In its cases registered in the transport scam it has only named ex-education minister Laxmikant Sharma and his OSD OP Shukla.”There are 39 FIRs registered in the transport department alone. 35 people joined in as constables and four others as other officials. More importantly 17 people were selected during recruitment didn’t even join after the STF probe,” said KK Mishra, Congress spokesperson in MP, He claimed the 17 candidates got through the transport constable recruitment test by forging documents and they are all suspected to be from Sadhna’s home district of Gondia in Maharashtra. “The STF was pressurised into neglecting the transport department because it leads to the doors of MP’s chief minister,” Mishra alleged. The CBI officials, however, did add that no amount of political pressure will deter the agency from taking action. “CBI action will not discriminate,” said Kanchan Prasad, spokesperson of the probe agency.

The police had reportedly called journalist Raghavendra Dube to cover another case of a missing journalist, reported CNN-IBN.

According to the police, journalists Santosh Mishra and Shashi Sharma, who work for a local magazine, had gone to the White House bar in Naya Nagar area of suburban Mira Road to cover a police raid, reported The Hindu.

The report added that the two journalists were allegedly attacked by the staff of the bar as they were clicking photographs of the raid.

The Times of India reported that Sharma sustained serious injuries and is currently being treated at the Indira Gandhi civic hospital in Mira Road. Mishra has been admitted to the Bhaktivedanta hospital.

The report adds that Dube arrived at the spot after the assault on Mishra and Sharma and then went to the Mira Road police station, where a group of bar owners and staffers were present. The police said that Dube left the police station at around 5 am and a few hours later, Dube’s body was found lying near SK Stone on the Mira-Bhayander road.

The body had several injury marks and has been sent for autopsy.

Dube’s death comes just a day after another woman TV journalist and three of her colleagues were manhandled and abused by some miscreants while covering an incident of cylinder blast in suburban Santacruz on Thursday.

“This incident should not be seen as a standalone event and it is yet another incident of attack on journalist community in Mumbai and elsewhere in Maharashtra when they are in the line of duty,” a release issued by Rajesh Mascarenhas, secretary, Press Club, had said after the assault on the woman journalist.

“We request the law-makers to discuss the attack on journalists and as promised and assured earlier (they) must come out with a law making attack on journalists a cognisable and non-bailable incident,” it had said.

Celebrated cinematographer Santhosh Sivan, actress Pallavi Joshi and National Award-winning filmmaker Jahnu Barua have resigned as members of the FTII Society in support of the striking students.

Film personalities like Adoor Gopalakrishnan, Anupam Kher, Rishi Kapoor, Ranbir Kapoor, Amol Palekar, Resul Pookutty, Kiran Rao, Rajkummar Rao, Sudhir Mishra, Sayeed Mirza, Nawazuddin Siddiqui, Kundan Shah, Aziz Mirza and Piyush Mishra among others have voiced their strong reservations over Chauhan’s appointment.

But unfazed by this opposition from the Bollywood fraternity and other quarters, Chauhan is adamant  that he has been appointed on the basis of merit. He has spent 34 years  in showbiz. Best known for his role of Yudhisthira on TV epic “Mahabharata“, his filmography is, however, not that impressive and includes movies like “Jungle Love”, “Khuli Khidki” and “Vasna”, which are considered B-grade.

FTII has, however, taken a hardline stance on the situation. FTII Director DJ Narian on Wednesday served a notice to the striking students asking them to terminate the protest immediately or face “strong” administrative action which may include “rustication”.

Two years on, parents of 23 kids who died in 2013 Bihar mid-day meal tragedy still awaiting justice

Patna: Two years after 23 children died after their mid-day meal at a school in Bihar, their parents and families are still waiting for justice.

The children died on 16 July, 2013 after eating contaminated mid-day meal in the government-run primary school in Gandaman village in Saran district, around 100 km from here.

“Soon after the tragedy, everyone from the state government to local police officers promised to conduct a speedy trial to provide justice to 19 families, who have lost 23 children. But where is the speedy trial,” asked Ahilanand Mishra, who lost his son Ashish, while speaking to IANS.

23 children died after consuming poisonous midday meals in Bihar. AFP.

It was Mishra, who filed the FIR against Meena Devi, the principal of the school. He said that he was disappointed as neither the main accused was punished nor the exact cause behind the tragedy was known till date.

“We are still waiting for justice and parents as well as families have been fed up and tired with the ongoing trial in the court and recording their statements before police and court,” Mishra said.

Surendra Rai and Asha Devi, who lost their daughter Mamta in the tragedy, said that the court should complete the trial as soon as possible in the case.

“We want a harsh punishment to the accused,” they said.

According to police officers involved in the case, till date, 22 witnesses have appeared in court.

“Those who appeared and recorded their statements include parents who lost their children, doctors who conducted the post-mortem and the cook who prepared the meal,” police said.

Rai said some mothers are still in a state of shock and the health of some mothers has deteriorated.

“My wife Asha is still in the shock and her health has deteriorated,” said Rai.

Besides, Mishra said his wife Putul Devi is in depression.

A forensic report confirmed the presence of toxic insecticide strains in the cooking oil used for making the food at the school.

Mishra and Rai said that most of the villagers blamed the mid-day meal tragedy for neglect and failure of the government.

Mishra recalled during the last Lok Sabha polls, many leaders passed through the nearby roads but no one cared to visit the village as they were afraid to enter the village and face angry villagers.

Vinod Mahto, who lost three of his four children in the tragedy, said a Special Investigating Team (SIT) formed by the Bihar government to probe the deaths is yet to submit its report.

“We are waiting for the report to know the exact cause of the tragedy that claimed lives of our innocent children. Let’s hope for justice,” he said.

The state government has constructed a memorial for 23 children in the village in Saran district.

Soon after the tragedy, the Bihar government announced a special scheme to turn Dharmasati-Gandaman into a model village with a high school, a public healthcare centre, a metalled road, drainage system and potable water facilities.

Meena Devi, principal of the school, who has been charged with murder and criminal conspiracy, was arrested in July 2015 and is in judicial custody for the past 720 days.

In Bihar, 16 million students in 72,000 schools daily get food under the mid-day meal scheme.

CBI officials turn into ‘bhakts’ to nab fraudster living as ‘sadhu Badrinath’

Interestingly the accused was located by the probe agency after it learnt about a suspected Facebook profile by the name Swami Durgesh Mahraj, which was believed to be run by the accused himself.

A man living as a sadhu at an ashram located right opposite to the historical Badrinath Temple of Uttarakhand, was finally arrested by the Central Bureau of Investigation after absconding for over 12 years.Interestingly the accused was located by the probe agency after it learnt about a suspected Facebook profile by the name Swami Durgesh Mahraj, which was believed to be run by the accused himself.Thrown off by the appearance of the accused, whom the CBI identified as Durjodhan Mishra, investigators in order to verify that he was the same person, became his bhakts or disciples for over two weeks, listening to his prachaar (sermons) along with thousands of other followers. It was only after a period of time that the officials were able to confirm the identity of the accused who had grown a long hair and beard in order to deceive possible investigators.<!– Dna_Article_Middle_300x250_BTF –>Strangely, Mishra’s Facebook account, which appears to have been opened in 2010, barely had any activity until March this year. On his Facebook account he had shared his personal mobile number with 153 people on his friends list. His friends list which is full of people from a range of professions, also enlists a number of foreigners. Mishra, like his, ‘followers’ seem to be a regular at performing yoga, as made evident by the Facebook pages he has liked. Mishra, the CBI said, is fluent in Hindi, Bengali, Maitheli and Bhojpuri languages and communicates with his followers in the same.According to officials of the CBI, Mishra, a native of Madhubani in Bihar, was working as an agent in Kolkata in 2003 and served as a liaison between the postal department and people seeking Kisan Vikas Patra (KVP) certificates. It was during this period when he forged 263 such certificates worth Rs2.63 crores and escaped taking the money. The West Bengal postal department officially lodged a complaint and the case was registered by the CBI on December 2, 2004 and a chargesheet was filed in the same month. However the accused remained untraceable. According to officials, he had then stayed briefly in Rajasthan where he brought some property and then finally moved to Uttarakhand.”We got a clue that the family of said absconder was residing at Bikaneer and Jodhpur in Rajasthan. On enquiry in the locality, it could be gathered that his wife, along with his three children, was staying there since 2006 but her husband never visited their address in Jodhpur. It was found that calls used to be received on every night in the phone of his wife were from two particular phone numbers of Badrinath,” said a senior CBI official.According to sources, the numbers belonged to two female followers of Mishra.”After connecting the dots, a team was sent to Badrinath to get embedded among the followers in the Manav Vikas Ashram where Mishra was also a trustee. Days later he was nabbed,” CBI official added. The arrested accused was produced before the Designated Court, at Kolkata on Monday and was remanded to Judicial Custody till July 20.

The plea has sought framing of guidelines to prevent adulteration of food and other consumables like fruits, vegetables, dairy products, edible oils, honey, meat, spices and pulses throughout the country.

“Existing laws regarding food adulteration are incapable of punishing the offenders who contribute to the menace of rising food adulteration by their wrongful acts and also the existing laws and guidelines are insufficient in totality to control the problem of adulteration of food and other consumable products in our country,” the petition said.

It also sought a direction to the government to ensure the closure of those companies which are committing serious offence of food adulteration.

“Issue direction to Union of India and all the respondents to immediately formulate the guidelines and limits regarding the use of antibiotics, chemicals etc. as per international food standards and also immediately forfeit, seize and destroy those food products which are known to be violating the normal standards regarding use of antibiotics and chemicals,” the plea said.

It added that the government was not doing anything to ensure the protection of lives of citizens from the menace.

However, the state BJP has denied any wrongdoing and said the appointments were done on the basis of merits even as Congress hit out at Chief Minister Shivraj Singh Chouhan for allegedly “obliging the BJP Central leadership“.

Senior BJP leader Sushma Swaraj has been embroiled in a row for facilitating travel documents for tainted former IPL boss Lalit Modi in London, prompting opposition Congress to demand her resignation.

The response to an RTI query, filed recently by activist Ajay Dubey, revealed that the State government had appointed Swaraj’s husband Swaraj Kaushal and daughter Bansuri Kaushal as government lawyers in 2009 and 2013, respectively.

Dubey alleged that the Chief Minister “favoured” Swaraj with appointments as he wants to consolidate his position in the BJP.

Reacting to the findings, MP Congress unit’s chief spokesman KK Mishra said Chouhan was not missing an opportunity to oblige Central ministers.

“By make Bansuri and Kaushal State government advocates, he (Chouhan) has politically obliged Swaraj. Chouhan was obliging the BJP Central leadership to save his chair in the wake of his involvement in MP Professional Examination Board (MPPEB) scam,” Mishra alleged.

He further alleged that the government has paid lakhs of rupees to Bansuri and Kaushal from government coffers as legal fees and demanded cancellation of their appointment.

Meanwhile, the state BJP unit said the government has not indulged in any wrongdoing, illegal act or impropriety in appointing Kaushal and Bansuri as government lawyers.

MP BJP media in-charge Hitesh Bajpai said the appointments were done on the basis of merits.

“Kaushal was a senior lawyer. Many States hire Kapil Sibal, Manish Tewari, KTS Tulsi of Congress to present them in Supreme Court,” he contended.

POCSO accused victims of circumstance, say experts

It is a fact that Protection of Children from Sexual Offenses Act (POCSOA) is misused many a time and as a result lives of many youths take a wrong turn. Experts on the Act believe that more often than not, the accused are victims of circumstances and that us why they and get to the root of the cases in order to get the them out of the imbroglio.Advocate Digajmaan Mishra, who handles POCSOA cases, said, “Young minds are always influenced by the power games which go in jails, and thus our main intention is to reform the youth by forcing them to engage in studies; so that they do not become hard-core criminals after witnessing the conduct of the criminals behind the bars.”<!– Dna_Article_Middle_300x250_BTF –>Advocate Prakash Salsingekar, who also deals with POCSOA cases, claims: “It is a fact that the time the accused approaches us to defend them before the court of law, they need to tell us the truth, so that we can find out a way to defend them. It is that moment when we realise that in most of the cases men between the age group of 19 and 22 are easily targeted and a complaint under the stringent POCSOA is added against them. Also, the police machinery is very slow and because of the delay caused by the police for their vital investigation, the bail in such cases is delayed. In instances where we realise that the cases are fake, we try to force our clients to get involved in studies, so that they are less attracted to the anti-social elements in jails.”Mishra explains about a case where a 19-year-old was arrested for molestation. “After going through it, I reaslised that the case against him does not appear genuine. To ensure that he doesn’t get attracted to the criminal atmosphere in jail, I have told him that if he concentrates on his studies, it will help him to seek bail. Though it is not a ground to get bail, we use this as a tool to ensure that their minds are not diverted.”Advocate Salsingekar added that there are two types of accused, one is a habitual while the other is a victim of circumstance. “Our main aim is to reform the accused who are victims of circumstance,” said Salsingekar.

I congratulate the Indian Army on this successful launch,” said Sudhir Mishra, CEO and MD of BrahMos Aerospace.

The BrahMos missile has been jointly developed by India and Russia.

The multi-mission missile, having a range of 290-km and a Mach 2.8 speed, is capable of being launched from land, sea, sub-sea and air against sea and land targets.

The air version BrahMos is being readied for flight trials soon on Indian Air Force’s Su-30MKI strike fighter.
