As the debate for the Juvenile Justice Act, 2000 rages on in the public and Parliament, Enakshi Ganguly Thukral, co-founder of Haq – Centre for Child Rights says, “When one considers penalties for a juvenile, it is important not to be swayed by public opinion. One must consider and keep the offender as the primary focus and not the offence.” According to a social worker at SPYM, “It costs Rs3,000 per day to do smack, that makes it Rs90,000 per month. A child on the street hooked on drugs has no option but to take to crime to support this habit,” he added. According to the National Crime Records Bureau (NCRB), the incidence of juvenile crime was 0.5 per cent in 2001, and the number rose to 1.1 per cent in 2011. However, the NCRB statistics attribute this rise in figures mainly due to the increase of the upper ages of juveniles from 16 years to 18 years according to the Juvenile Justice (Care and Protection) Act, 2000. Another reason for the increase can be credited to the addition of 11 new special and local laws added to the list in 2014. Though there is much furore about the rise in crime, statistics also show that there has been a decrease in violent crimes among juveniles in the year 2014. “When a child is deprived of his basic needs, he takes to crime. We have thus economically empowered children who have come in conflict with the law,” says Father Anthony, founder of Empowerment of Child Human rights Organisation (ECHO). Father Anthony has more than 15 years of experience towards understanding juvenile delinquency. “In my experience, I have achieved 100 per cent success rate with juvenile reformation and rehabilitation,” says he. His work with the juveniles have created successful customs officers, traffic police assistants and some are even working in multi-national organisations and jewellery stores. There are around 33,000 juveniles in the system. According to statistics, juveniles are responsible for less than 5 per cent of all rapes. Atiya Bose, Director of a Mumbai-based NGO Aangan feels that “The main issue and the reason why rehabilitation is important for young people is because they are amenable to reform. I have seen huge changes in juveniles when one has worked with them comprehensively on all fronts that includes a combination of a support system.” Bose went on to add that “Juveniles who commit crimes serve the punishment as metted out to them according to the law. Should they then be vilified and damned for life?” Short staff board While the Juvenile Justice Board has been in existence for a while, there does not seem a concerted or well thought out programme. It is understaffed and not enough resources have been allocated for the welfare of children who come in conflict with the law. With public sentiments swaying opinions, experts feel the main issue is being lost in the noise.

Pakistani Marine Security Agency (MSA) on Sunday apprehended around 70 fishermen and seized their 11 boats from international waters off Jakhau coast of Gujarat, fishermen association said in Ahmedabad. “Pakistani MSA has today apprehended 70 fishermen from international waters off Jakhau,” National Fishworkers Forum secretary Manish Lodhari said. “The fishermen were in 12 boats, but one of the boats somehow caught fire and drowned during the MSA operation. We don’t know the reason on how it happened. Fishermen of the drowned boat were rescued. Six fishermen of Pudukottai district were arrested by Sri Lankan navy while they were fishing near the Lankan coast, authorities said on Sunday.Assistant director of the fisheries department, Sekar, said the fishermen of Jegathapattinam village were fishing at Neduntheevu last night when the Lankan navy arrested them.The fishermen along with their boat were later taken to Kangesanthurai, he added. The Delhi Commission for Women on Friday said the High Court’s refusal to stay the release of the juvenile convict in the December 16 gangrape case was a “dark day” in the history of the country and it would appeal against his release. Maliwal stressed that an analysis needs to be carried out to assess the mental health of the juvenile convict.”Some kind of a analysis needs to be done as to what kind of a reformation this man has gone through. India needs to know what reformation he has gone through,” Maliwal said.The convict along with five others had gangraped and murdered the 23-year-old paramedical student in a moving bus, an incident that shook the nation and led to protests in the country as well as abroad. He was sentenced to three years in a reform home, a punishment which drew criticism from several quarters saying it was not adequate and disproportionate in view of the heinous crime he had committed and there were demands of he being tried in an adult court.Following the incident, government had proposed amendments to the Juvenile Justice Act, so that teenagers involved in heinous crimes can be tried as adults.

Bhambani had represented Hema in the case.According to police, Hema’s domestic help had filed a missing complaint at Santacruz police station on Saturday after she did not return home whole of Friday. Bhambhani’s younger daughter Anita had also filed a similar complaint at Matunga police station the same day.Hema was last seen by the watchman of her apartment building at 11 am on Friday. According to Anita, Bhambhani had left his King Circle home in Matunga to meet Hema at around 6.30 PM on Friday. Investigators said Bhambhani met Hema at her art studio in Andheri around 8.30 PM on Friday before talking to his wife on phone. Thereafter the Bhambhani family could not establish any contact with him despite calling him several times.Police suspect that an unidentified person known to the duo had called the lawyer to give fresh evidence in a property dispute involving Hema, who was suspected to have been strangled with Bhambhani by the perpetrators of the crime.Additional Commissioner of Police (North Region) Fatehsingh Patil claimed his team was “very close” to cracking the case.. Police said Bhambhani’s car, in which he had left for the meeting, is still to be traced.

The two bodies that were found in Kandivli (W) on Saturday have been identified as those of artist Hema Upadhyay (43) and her lawyer Harish Bhambani (65). Hema was involved in an acrimonious divorce battle with Chintan Upadhyay, a celebrated name in the art world, in the Bombay High Court. The bodies were found in two gunny bags inside two cardboard boxes in a drain near Dhanukarwadi around 7:30 pm on Saturday. On Sunday, the Mumbai police detained three people and questioned Chintan for over six hours. Sources in the Mumbai police told dna that a fourth suspect, a metal fabrication artist called Rajbhar, could turn out to be the key suspect. The police are on the look-out for him.<!– Dna_Article_Middle_300x250_BTF –> According to sources, Rajbhar is believed to have called Hema, claiming that he has clinching evidences against Chintan, which would help her in the divorce case. “We learn that Rajbhar wanted to meet Hema to hand over some proof against Chintan. It seems that they were murdered after they reached the place where Rajbhar was waiting,” said a source.”It looks like that the idea was to kill Hema, but as Bhambani was accompanying her, he became a collateral damage,” he said. The bodies were first spotted by some local sweepers. When they found something amiss, they informed the police. When the boxes were opened, the police found two bodies – one of a male and the other of a female – wrapped in plastic sheets. “Initially, the identity of the bodies could not be ascertained as the murderers did not leave any personal possessions of the victims. Their cellphones, wallets and jewellery were missing,” said an officer from the Kandivli police station. “Bhambani’s hands were tied and his mouth was gagged with a cloth and had a cello tape on it. Hema’s body was just wrapped in a plastic sheet,” he said. The identities of the bodies were ascertained on Sunday. “Both of them were strangulated to death and there are no external injury marks on the bodies,” said an officer. “We have sent the bodies for autopsy,” he said. An officer privy to the investigation said that before leaving his residence in King’s Circle around 6:30 pm on Friday, Bhambani had told his family that he has a meeting with a client in Andheri. Hema left her residence in Juhu on Friday morning and headed straight to her studio in Laxmi Industries off Veer Desai Road in Andheri (West). Around 6:30 pm, Hema made a call to her help, Hemant Mandal, asking him not to expect her for dinner. “The CCTV footage collected from the area of Laxmi Industries Estate establish that both Hema and Bhambani left the studio around 8:30 pm in the lawyer’s Honda City,” said an officer. “Their last cellphone tower location was in the Kandivli area. We have not yet recovered the missing car”. When Hema did not turn up home on Friday night, Mandal made several calls to her. When she did not answer, he approached the Santa Cruz police station and registered a missing complaint on the wee hours of Sunday. Even Bhambani’s family registered a missing complaint with the Matunga police station. As the Kandivli police launched an investigation into the double murder, the Mumbai crime branch also started a parallel investigation. Hema had filed for divorce in 2010, citing domestic violence. The family court had passed a decree in favour of Chintan. But Hema challenged it in the Bombay High Court and Bhambani was representing her. The celebrated artist-couple were in the news in 2013, when Hema filed a criminal case against Chintan for sketching obscene paintings on the wall of their bedroom. “Prima facie, personal enmity seems to be the reason behind the murder but investigations are still on and we are checking for further leads,” the police said.

While Hisar experienced a cold night at 4.5 degrees Celsius, three notches less than normal, minimum temperature in Ambala however, settled within the normal limits at 9.3 degrees Celsius. In Punjab, Amritsar had a cold night at 6 degrees Celsius while Ludhiana also experienced the chill at 6.8 degrees Celsius.

No tug of war between court and government over cleaning of Ganga: CJI Thakur

Chief Justice TS Thakur on Sunday dispelled impressions about his hard-hitting remarks during the judicial proceedings on the government’s ambitious Clean Ganga project, saying the judicial process was “not an impediment” and “intervention” was needed for its honest implementation.”There is no adversarial element in it. Ganga ki safai ko lekar court aur sarkar ke beech koi kheenchtan nahi hai (There is no tug of war between the court and the government over the cleaning of Ganga),” the Chief Justice said in an interaction with mediapersons here. “We will intervene. 7 of a family returning from Haridwar killed in mishap on Hisar-Delhi highway

The car was on its way to Jandwa village from Haridwar when it was hit by the truck, the official said, adding that the accident took place around 4 am.

Seven members of a family, including four women, were killed on Sunday when the car they were travelling in collided with a truck on Hisar-Delhi National Highway near Garhi village, about 50 kms from here. Three others were injured, two of them seriously, in the mishap which took place in the wee hours. All the deceased hailed from village Jandwa in Churu district of Rajasthan, a police official said.The car was on its way to Jandwa village from Haridwar when it was hit by the truck, the official said, adding that the accident took place around 4 am. Indian Army Chief’s visit ‘matter of concern’, says PMK chief Ramadoss

Chennai: A day after Army Chief General Dalbir Singh Suhag left for Sri Lanka to review bilateral defence ties, PMK chief Ramadoss on Monday said the visit was a “matter of concern” and wanted the Centre to declare a policy that it would never provide arms and military aid to the island nation.

On Sunday, the Army Chief embarked on a four-day visit to Sri Lanka during which he would review the bilateral defence ties and discuss new avenues of cooperation.

Referring to the visit, Ramadoss said there was “nothing wrong” in the army chief of a country travelling to another country to deliberate military cooperation.

“However, the country of his travel (Sri Lanka) and the intention of his visit is a matter of concern,” he said.

He claimed that the main reason for Suhag’s travel was to “give Lanka new war planes, arms, tanks and anti-aircraft weapons system.”

“There is no doubt that such weaponry would be only used to annihilate Tamils. Thousands of reasons can be listed to deny supply of weaponry to Sri Lanka,” he alleged.

Hence, Ramadoss said the central government should give up the “decision to give Sri Lanka weaponry and also declare that it would never give arms and military aid to that country as its policy.”

An official statement had yesterday said among the countries of the Indian Ocean Region (IOR), Sri Lanka was the “most important partner and one of our most important neighbours.”

Noor Jehan now hopes that PM’s praise will help her in getting some financial aid from the government so that she can raise the number of lamps to 100. “There is no power in the village and therefore, the demand for solar lamps is increasing as more and more people want to make sure their children get to study even during the night hours,” she said.

SpiceJet says to order over 150 planes in current financial year | Reuters

DUBAI Budget airline SpiceJet plans to order more than 150 planes in the current financial year, the airline’s chairman said on Sunday.

“We are in the process of placing a large aircraft order. The airline will order in excess of 150 planes – we hope to do that in this financial year,” Ajay Singh, SpiceJet’s chairman and managing director, told a news conference in Dubai.

The financial year will end in March.

He said the airline was generating enough money internally but had unused credit lines that could be utilised to pay for the aircraft.

SpiceJet has no intention of diluting equity to pay for the planes, he said.

OSLO Government negotiators at a U.N. climate conference in Paris will meet on Sunday, a day earlier than planned, to let them get down to work before world leaders arrive for a summit on Monday.

The U.N. Climate Secretariat said on Wednesday that senior officials from almost 200 nations would meet in the conference hall on the outskirts of Paris on Nov. 29 at 1600 GMT.

Until now, they had been due to meet for the first time only after about 140 world leaders including U.S. President Barack Obama and Chinese President Xi Jinping attended on Monday to give speeches of encouragement.

Officials who oversee the talks “considered that an early opening of the session will offer an opportunity to make the best possible use of the very limited time available to finalise negotiations”, the Secretariat said in a statement.

The conference, lasting until Dec. 11, is seeking to agree a deal that signals a break with a rising reliance on fossil fuels, blamed by a U.N. panel of scientists for causing more floods, heat waves and rising sea levels.

Four militants killed in two encounters in Kashmir

Srinagar: Four unidentified militants were killed on Monday in two separate encounters with security forces in Kupwara and Anantnag districts of Kashmir, officials said in Srinagar.

Three militants were killed in an encounter with security forces in Asghmuqam area of Anantnag district this afternoon, an army official said.

The gunbattle started when militants opened fire on security force personnel who had cordoned off Siligam village to carry out a search operation, the official said.

He said the search operation was still in progress while the identity of the slain militants was being ascertained.

In a separate operation in north Kashmir’s Kupwara district, which entered its 11th day on Sunday, the security forces killed one militant while efforts were on to flush out his accomplices, the official said.

The unidentified militant was killed in the encounter in the dense forests of Manigah, where Colonel Santosh Mahadik was killed last week, he said.

Security forces are continuing a massive search operation in the forest near the Line of Control (LoC) since 13 November following information about presence of a group of heavily-armed militants.

On 17 November, an encounter between the militants and the security forces left Colonel Mahadik, Commanding Officer of 41 Rashtriya Rifles, dead.

In another exchange of fire on Sunday, two army personnel including a Lt Colonel were injured in the district yesterday.

Besides ultras, security forces have to battle the poor visibility and inclement weather conditions given the high altitude area.Security forces suspect that the militants are still hiding in the area under the cover of rocky caves and dense foliage. That is why they have cordoned off around five square kilometre area to plug all the holes so that the ultras are unable to escape.”Temperatures are dropping fast and they cannot sustain for long. Gujarat Congress on Sunday alleged that thousands of voters in Ahmedabad could not exercise their franchise for the municipal polls held on Sunday as their names were deliberately removed from the list by the State Election Commission (SEC) at the behest of BJP-led Gujarat government. Alleging that “removal” of voters’ names was part of a “larger conspiracy”, Congress called for a thorough probe into it, even as the ruling BJP said the government or the party had no role preparation of voting lists.Gujarat Congress president Bharatsinh Solanki claimed that 1,000 to 4,000 names in each of the 48 wards of the city were deleted from the final electoral rolls by the SEC without informing the voters or candidates. The Congress leader claimed that when voters reached the booths, they began to complain that they found their names deleted without any prior information. “We learnt that around 1,000 to 4,000 names in each ward were deleted from the final list in the city. Not just city, it has happened across the state today. Woman committed suicide by jumping in front of the Delhi metro, say police

Delhi: An unidentified young woman allegedly committed suicide by jumping in front of a Delhi Metro train on Sunday evening, police said.

A Central Industrial Security Force officer said that the CCTV footage showed the woman who was in her mid-20s, wandering aimlessly at the metro station for more than 10 minutes before jumping in front of an arriving metro train at platform number three.

“We did not recover any suicide note from her possession. Metro services on the route were disrupted for around 20 minutes after the incident,” the officer said.

According to investigators, Sheena was blackmailing Indrani that if she did not give her a 3 BHK flat in the city, she would expose her by telling people that she was Indrani’s daughter, and not sister, as the latter had claimed.

Meanwhile, Peter’s interrogation would end on Monday and to seek further remand, the CBI officials have called Rahul to reveal more facts in the case against him, the officer added.

Peter was arrested by the CBI on Thursday in connection with the sensational murder case. On Friday, he was charged with murder and criminal conspiracy by the CBI, which said he had played an active role in the killing.

Other prime accused, Indrani Mukerjea, her former husband Sanjeev Khanna and former driver Shyamvar Rai, have been remanded to judicial custody till December 3, police said.

India test-fires indigenously developed supersonic interceptor missile

Balasore: As part of efforts to develop a full fledged multi-layer Ballistic Missile Defence system, India on Sunday test-fired its indigenously developed supersonic interceptor missile, capable of destroying any incoming ballistic missile, from a test range off Odisha coast.

“The test was conducted to validate various parameters of the interceptor in flight mode,” said defence sources.

The interceptor, known as Advanced Air Defence (AAD) missile, was engaged against an electronically prepared target which simulated the trajectory of a hostile ballistic missile.

After getting signals from tracking radars, the interceptor, positioned at Abdul Kalam Island (Wheeler Island), roared through its trajectory at around 9.46 am to destroy the incoming missile mid-air, in an endo-atmospheric altitude, defence sources said.

The ‘kill’ effect of the interceptor was being ascertained by analysing data from multiple tracking sources,” a Defence Research Development Organisation (DRDO) scientist said soon after the test was carried out.

The interceptor is a 7.5-meter long single stage solid rocket propelled guided missile equipped with a navigation system, a hi-tech computer and an electro-mechanical activator, the sources said.

The interceptor missile had its own mobile launcher, secure data link for interception, independent tracking andhoming capabilities and sophisticated radars, the sources said.

After the Rashtriya Swayamsevak Sangh (RSS) criticised the Akhil Bharatiya Hindu Mahasabha for commemorating Nathuram Godse’s death anniversary as ‘Balidan Diwas’, the extreme right wing outfit has lashed out at the Sangh, claiming it is the ‘biggest traitor’.According to an English news daily, Ashok Sharma, national vice-president of Akhil Bhartiya Hindu Mahasabha, said, “The RSS is the biggest traitor that has betrayed not only the country but also the Hindus. Few are aware of the fact that the Hindu Mahasabha (HM) was the parent body of RSS. But, after Mahatma Gandhi’s assassination in 1948, RSS leaders severed all ties with the Hindu Mahasabha and joined hands with Nehru and tried to distance themselves from Gandhi’s killing.
